Panama Papers: I-T slaps criminal charges under anti-black money

New Delhi, Nov 19: Stepping up probe into the Panama Papers, the Income Tax Department has slapped criminal charges under the new anti-black money Act and launched fresh assessment of stashed offshore income against more than six Indian entities in the list, official sources said.

They said the department has detected undisclosed assets and stashed funds located in foreign countries in case of seven individuals and entities named in the leaks and the taxman has begun investigations against them under the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015.

Sources privy to the probe said the tax department has ordered fresh assessment and also re-assessment of the income of these entities and will soon launch criminal prosecution against all of them as the entities had reportedly not disclosed offshore properties to Indian tax and banking authorities in the past.

These are the first set of cases of undisclosed foreign assets which are being probed under the new anti-black money Act, that has criminal sections for prosecution under the law.

Under the new anti-black money law, cases of overseas illegal assets, which till recently were probed under the regular and civil Income Tax Act of 1961, attract a steep 120% tax and penalty on undisclosed foreign assets and income besides carrying a jail term of up to 10 years.

Prosecution of these seven entities under the Prevention of Money Laundering Act (PMLA) would also be initiated in the coming days, as the anti-black money Act of 2015 qualifies to be a predicate offence for money laundering investigations, they said.

The sources refused to divulge the identities of the seven entities citing the overriding global tax information exchange secrecy clauses between various countries.

The Central Board of Direct Taxes has recently said that investigations in the Panama Papers leak cases till now have resulted in the I-T Department detecting undisclosed wealth of Rs 792 crore so far and the probe in these cases is on in "full swing".

Bengaluru, Jun 10: Congress' Rajya Sabha candidate from Karnataka and senior leader Mallikarjun Kharge and his son received threat calls on Sunday, with the latter filing a complaint with the state police chief. Kharge, a former Union Minister, received the call in the wee hours of Sunday on his landline while his son Priyank later got a call from a private number on his mobile phone.

Priyank lodged a complaint with the Director-General of Police Praveen Sood and former MLC Ramesh Babu shared the copy of the complaint on Twitter on Tuesday. In his complaint, Priyank Kharge stated that at about 1.30 am on Sunday, his father received a call on the landline where the caller spoke in Hindi and English and used invective against the Congress veteran.

The caller, according to the complaint, spoke about the Rajya Sabha election and threatened Kharge. Police are looking into the matter. Kharge is the Congress' pick for the June 19 Rajya Sabha election from Karnataka. JD(S) supremo and former Prime Minister Deve Gowda and two BJP candidates have also filed nominations for the election to the upper House.

Aligarh, Jul 20: The son of a motor mechanic in Aligarh, who had received a scholarship, topped at his high school in the United States.

Mohammad Shadab, son of the motor mechanic, told ANI, "Last year, I received the Kennedy-Lugar youth exchange scholarship worth Rs 20 lakh from the US government. Following this, I went to the States to pursue my high school education."

Out of 800 students, Shadab was also selected Student of the Month at his school. On his achievement, he said, "It was an achievement for me to be awarded this tag."

"I have worked really hard to top the high school," Shabad said.

Shadab said, "The condition at home was not good and it is still not that good. I want to support my parents and make them feel proud."
He also thanked the Indian government. "I am thankful to the Indian government for making me the flag-bearer in another county and choosing me for this scholarship."

Shabad's father, Arshad Noor, who is working as a motor mechanic for the past 25 years, said, "We had sent him to the US for his education and I am happy that he topped at the school."
On being asked about his son, Arshad said, "I want my son to become an IAS officer and serve the country."

But Shadab expressed the desire to work at the United Nations as a human rights officer.

Mumbai, Feb 9: Given the slow progress on the ongoing Rs 38,000-crore capacity expansion at the four largest metro airports, and also the surging traffic, the snaky queues will continue at least till 2023, warns a report.

The four largest airports -- New Delhi, Mumbai, Bengaluru and Hyderabad -- handle more than half of the traffic and are operating at 130 per cent of their installed capacity. These airports are under a record Rs 38,000-crore capex but the capacity will not come up before end-2023, says a Crisil report.

“With the dip in traffic growth largely behind, we expect congestion at the top four airports of New Delhi, Mumbai, Bengaluru and Hyderabad, which handle more than half of the load, to continue till about FY23,” says the report.

Already these airports are operating at over 130 percent of installed capacity, and the ongoing healthy traffic growth this operating rate is expected to rise further in the next 12 months.

“Operationalising of capacities in the following two fiscals will bring down utilisation levels albeit still high at over 90 per cent by fiscal 2023 and that is despite an unprecedented Rs 38,000 crore capex being undertaken by the operators of these airports over five fiscals 2020-24,” says the report.

Despite this unprecedented capex that is debt-funded, ratings are likely to be stable given the strong cash flows expected due to healthy traffic growth, low project risks associated with the capex and improving regulatory environment, notes the report.

“Capacity at these four airports will increase a cumulative 65 per cent to 228 million annually (from 138 million now) by fiscal 2023. However, traffic is expected to grow strong at up to 10 per cent per annum over the same period. Since additional capacities will become operational in phases only by fiscal 2023, high passenger growth will add to congestion till then,” warn the report.

High utilisation will ride on pent-up demand (accumulated in 2019 as traffic was impacted with the grounding of Jet Airways) and one-off issues with new aircraft of certain airlines.

Further impetus will also come from improving connectivity to lower-tier cities and reducing fare difference between air and rail. Increasing footfalls at airports provide a leg-up to non-aero streams such as advertising, rentals, food and beverage and parking, which comprise around half of the revenue of airports already.

These are expected to grow strongly at over 10-12 per cent, also supported by higher monetisation avenue coming along with current capex. The other half of revenue (aero revenue) is an entitlement approved by the regulator, providing a pre-determined, fixed return over the asset base and a pass-through of costs.

Aero revenue is also expected to get a bump up during fiscals 2022-24, when a new tariff order for airports is likely. Overall aggregate cash flows are likely to double by fiscal 2024 and provide a healthy cushion against servicing of debt contracted for capex, the report concludes.
