Petition to re-probe Mahatma Gandhi murder: SC appoints amicus curiae

New Delhi, Oct 6: The Supreme Court today asked some searching questions on a plea seeking reopening of the investigation into the assassination of Mahatma Gandhi.

After a brief hearing, a bench comprising Justices S A Bobde and L Nageswara Rao appointed senior advocate and former additional solicitor general Amrender Sharan as amicus curiae to assist the court in the matter.

During the hearing that lasted about 15 minutes, the apex court was initially of the view that "nothing can be done in law" in the case which has been decided long ago.

However, it later told Sharan that its observation was not binding on him to make an assessment of the matter and posted it for further hearing on October 30.

The petition filed by Mumbai-based Dr Pankaj Phadnis, a researcher and a trustee of Abhinav Bharat, has sought reopening of the probe on several grounds, claiming it was one of the biggest cover-ups in history.

Gandhi was shot dead at point blank range in New Delhi on January 30, 1948 by Nathuram Vinayak Godse, a right-wing advocate of Hindu nationalism.

At the outset, Phadnis sought some time to file certain additional documents to buttress his plea that reopening of investigation in the assassination case was required.

"What can we do now at this stage," the bench asked the petitioner, who said that after he filed the plea, he has received certain crucial documents relating to the case.

"Why should we reopen this now? We will give you as much time you want but you tell us why should we reopen a finding that has been affirmed," the bench asked the petitioner.

When the court asked the petitioner about the law of limitation, Phadnis said he was aware of it.

He said that appeals filed by the convicts in the assassination case were dismissed in 1949 by the East Punjab High Court, following which the Privy Council had sent the matter back on the ground that the Supreme Court of India will come into existence in January 1950.

"The Supreme Court never adjudicated this matter," Phadnis said.

When he said that another person might be involved in firing shots at Mahatma Gandhi, the bench said "we want to go by the law and not by political passion".

"You say that there was someone else, a third person who killed him (Gandhi). Is that person alive today to face the trial," the bench asked.

Responding to the query, Phadnis said that assassination of Mahatma could have been carried out by an organised body.

However, the bench sought to know about the identity of the person and said "we cannot convict an organisation. Do you know whether that person is alive?"

Phadnis, however, said he did not know if that person is alive but investigation should be ordered to ascertain the truth.

At the fag end of the hearing, the bench told the petitioner that it needed legal assistance in the case and asked Sharan, who was present in the court room, to assist it in the matter.

Sharan said he would assist the court and sought some time to go through the documents filed by the petitioner.

Phadnis has challenged the decision of the Bombay High Court which on June 6, 2016 had dismissed his PIL on two grounds -- firstly, that the findings of fact have been recorded by the competent court and confirmed right up to the apex court, and secondly, the Kapur Commission has submitted its report and made the observations in 1969, while the present petition has been filed 46 years later.

In the petition, Phadnis has also questioned the 'three bullet theory' relied upon by various courts of law to hold the conviction of accused -- Nathuram Godse and Narayan Apte, who were hanged to death on November 15, 1949, and Vinayak Damodar Savarkar who was given the benefit of doubt due to lack of evidence.

He has claimed that the Justice J L Kapur Commission of Inquiry set up in 1966 was not able to unearth the entire conspiracy that had led to the killing of Gandhi.

New Delhi, Jun 24: In a stinging attack on the Gandhi family of the Congress, BJP president J P Nadda on Wednesday said a dynasty and its courtiers have "grand delusions" of the opposition being about itself and stated that a "rejected and ejected" family is not equal to the entire opposition.

In his tweets, Nadda said it was the time for unity and solidarity, and the "relaunch of the scion for the nth time can wait", an apparent dig at Rahul Gandhi, who has been aggressive in his attacks on Prime Minister Narendra Modi for his handling of the border row with China.

Nadda said India lost thousands of square kilometres of land due to the "misadventures of one dynasty" and claimed that the Siachen glacier, where the Indian Army has a strong presence, was almost gone. No wonder India has rejected them, he said.'

The BJP president posted a news report to back his assertions about Siachen.

"One 'royal' dynasty and their 'loyal' courtiers have grand delusions of the Opposition being about one dynasty. A dynast throws tantrums and his courtiers peddle that fake narrative. The latest one relates to the Opposition asking questions to the Government," Nadda said.

Though he did not directly name the Gandhi family or any of its members, the reference was clear.

He said it was the opposition's right to ask questions and added that the all-party meeting called by Prime Minister Narendra Modi saw healthy deliberations, with several opposition leaders giving their valuable inputs.

They also fully supported the Centre in determining the way ahead, Nadda said.

"One family was an exception. Any guesses who," he asked.

Targeting the Gandhis, the BJP president said, "One rejected and ejected dynasty is NOT equal to the entire Opposition. One dynasty's interests are not India's interests. Today, the nation is united and supportive of our armed forces. This is the time for unity and solidarity. Relaunch of 'the scion' for the nth time can wait."

Perambalur, Jan 2: Veteran Tamil writer Nellai Kannan was arrested in Perambalur for criticizing Prime Minister Narendra Modi and Home Minister Amit Shah during a protest against Citizenship (Amendment) Act.

The Tirunelveli Police had registered the FIR against the writer for the speech delivered at a meeting, which was called by the Social Democratic Party of India on December 29 last year.

The police have booked him on the basis of multiple complaints filed by BJP leaders.

Kannan has been booked under Sections 504, 505(1) and 505(2) of the Indian Penal Code.

New Delhi, Feb 3: Union minister Prakash Javadekar on Monday said Delhi Chief Minister Arvind Kejriwal had called himself an "anarchist" and there is not much of a "difference between an anarchist and a terrorist".

His remarks come a few days after the Election Commission issued a show cause notice to BJP MP Parvesh Verma for allegedly calling Kejriwal a "terrorist".

Addressing a press conference here, Javadekar raked up the issue of Kejriwal "staying a night at the Moga residence of Khalistan Commando Force chief Gurinder Singh during the Punjab Assembly polls".

"You knew it was a militant's house. Still, you stayed there. How much more evidence do you need?" he said.

"Kejriwal is now asking with a sad face, 'am I a terrorist?' You are a terrorist and there is a lot of evidence to prove that. You yourself had said you are an anarchist. There is not much of a difference between an anarchist and a terrorist," the senior BJP leader said.

Flanked by Delhi BJP chief Manoj Tiwari and Union minister Anurag Thakur, Javadekar said the Aam Aadmi Party (AAP) was supporting Shaheen Bagh, where slogans of "Assam ko azadi", "Jinnah wali azadi" were being raised. "Supporting such slogans is also terrorism".

He alleged that Kejriwal stood with Jawaharlal Nehru University (JNU), where "anti-India slogans were raised, and did not grant sanction to prosecute (those who raised the slogans)".

"On January 26, you threatened that you would stop their prosecution. How much more proof do you need? The people of Delhi now know that you are the chief of liars, you are an anarchist and sympathise with terrorists.

"You are supporting Shaheen Bagh, JNU, the slogans being raised there and all such anarchists...then you are definitely a terrorist. This is your identity, no matter how innocent face you make," he said.

On Thursday, the Election Commission had issued a show cause notice to Verma, the BJP MP from West Delhi, for allegedly calling Kejriwal a "terrorist".

He was earlier barred from campaigning for 96 hours (four days) for making controversial remarks at a poll meet recently.

An emotional Kejriwal had later said it was for the people of Delhi to decide whether they consider him their son, brother, or a terrorist.

"How have I become a terrorist? I've arranged for medicines...did so much for the needy. I've never thought of myself or my family... am ready to give my life for the nation," he had said at a press conference.
