President formally turns BJP’s controversial Triple Talaq Bill into Law

New Delhi, Aug 1: President Ram Nath Kovind has given assent to the controversial Triple Talaq Bill passed by Parliament, turning it into a law which makes the practice of instant divorce among Muslims a punishable offence, a government notification said.

The gazette notification, published on Wednesday, says the president has given assent to the bill passed by Parliament.

The Act will replace an ordinance promulgated on February 21 this year to the same effect.

The new law — The Muslim Women (Protection of Rights on Marriage) Act, 2019 — makes talaq-e-biddat or any other similar form of talaq having the effect of instantaneous and irrevocable divorce pronounced by a Muslim husband void and illegal.

It makes it illegal to pronounce talaq three times in spoken, written or through SMS or WhatsApp or any other electronic chat in one sitting.

"Any pronouncement of talaq by a Muslim husband upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal," the law says.

Any Muslim husband who pronounces the illegal form of talaq upon his wife shall be punished with imprisonment for a term which may extend to three years, and shall also be liable to fine, it says.

The bill was passed by Rajya Sabha with 99 votes in favour and 84 against, as the ruling NDA, which lacks majority in the upper house, was helped by the absence of some members of the opposition Congress, SP and BSP as well as six members of Telangana Rashtra Samithi and two MPs of YSR-Congress.

The Triple Talaq Bill could not make it through the upper house earlier this year during the first term of Prime Minister Narendra Modi's government, although it was passed by Lok Sabha.

The bill was again passed by Lok Sabha last week amid a walkout by several opposition parties including the Congress and the Trinamool Congress.

The opposition parties had said in its current form, the proposed law could be misused to harass Muslims and wanted it to be reviewed by a parliamentary committee.

Criminalising the offence, the bill gives a police officer powers to arrest the offender without requiring a warrant, they had said.

To check misuse of cognisable nature of the offence, the bill makes declaration of talaq-e-biddat only if the complaint is filed by the aggrieved woman or any of her relation by blood or marriage, the Act says.

A magistrate can grant bail only after hearing the aggrieved woman, it says.

The aggrieved woman is entitled to demand a maintenance for her and her dependent children under the Act.

Opposing the bill, Leader of Opposition in Rajya Sabha Ghulam Nabi Azad had said a law should not be made to "finish one particular religion" and claimed that the "cat has come out of the bag".

He said the government should not target one section by framing an "unconstitutional" law but instead provide 33 per cent reservation to women in legislatures for their empowerment, the way Congress government had brought in reservation for women in panchayats, corporations and local bodies.

New Delhi, Jun 17: Petrol and diesel prices were increased in metros on Wednesday, marking the eleventh straight day of increase since state-owned oil companies returned to the normal practice of daily reviews following a 12-week pause. With effect from 6 am, the price of petrol was increased by 55 paise per litre, and diesel by 69 paise per litre in Delhi, compared to the previous day. While the price of petrol was revised to Rs 77.28 per litre in the national capital from Rs 76.73 per litre the previous day, the diesel rate was increased to Rs 75.79 per litre from Rs 75.19 per litre, according to notifications from state-run Indian Oil Corporation, the country's largest fuel retailer. In the 11-day period, the price of petrol has been increased by a cumulative Rs 6.02 per litre, and diesel by Rs 6.49 per litre.

International crude oil prices retreated on Wednesday, weighed down by an increase in US crude inventories and worries about a potential second wave of the coronavirus pandemic. Brent crude futures - the global benchmark for crude oil - were last seen trading 1.0 per cent lower at $40.56 per barrel.

State-run oil marketing companies revise the prices of petrol and diesel from time to time, besides aviation turbine fuel (ATF) - or jet fuel - and liquefied petroleum gas (LPG). However, since March 16, the oil companies had kept petrol and diesel prices on hold, possibly due to the volatility in global oil markets.

Fuel retailing in the country is dominated by state refiners - Indian Oil Corporation, Bharat Petroleum Corporation and Hindustan Petroleum Corporation. The three own about 90 per cent of the retail fuel outlets in the country.

New Delhi, Jun 12: India's COVID-19 tally on Friday witnessed its highest-ever spike of 10,956 cases, according to the Union Ministry of Health and Family Welfare (MoHFW).

396 deaths have been reported due to the infection during the last 24 hours.

The total number of coronavirus cases in the country now stands at 2,97,535 including 1,41,842 active cases, 1,47,195 cured/discharged/migrated and 8,498 deaths.

COVID-19 cases in Maharashtra continue to soar with the number reaching 97,648. Tamil Nadu's coronavirus count stands at 38,716 while cases in Delhi reached 34,687.

Jan 7: A Delhi Court today issued death warrant against four convicts in the 2012 Nirbhaya gang-rape and murder case. The hanging will take place on January 22 at 7 am.

During the hearing, the prosecution said there was no application pending before any court or the President right now by any of the convicts and the review petition of all the convicts was dismissed by the Supreme Court.

On Monday, the court had reserved order on issuing of death warrants against four death row convicts.

Today's order comes days after mother of the victim in the 2012 Delhi gang-rape and murder case moved the Supreme Court on opposing the plea filed by one of the four death-row convicts seeking review of its 2017 judgement awarding him death penalty.

The apex court had on July 9 last year dismissed the review pleas filed by the other three convicts — Mukesh (30), Pawan Gupta (23) and Vinay Sharma (24) — in the case, saying no grounds have been made out by them for review of the 2017 verdict.

The 23-year-old girl was gangraped and murdered by six men on a moving bus on 16 December 2012. The main accused, Ram Singh, allegedly committed suicide in Tihar Jail during the trial. Another accused was a minor at the time of the commission of the crime and was sent to a reform facility and released after three years.
