Prosecution in Salman Khan's case to appeal against fresh trial

Salman_Khan_copyMumbai, Dec 24: The Prosecution in the 2002 hit-and-run case involving Bollywood actor Salman Khan has sought permission from the Maharashtra Government to file an appeal in the Bombay High Court challenging a sessions court judgement, which ordered fresh trial in this case.

The prosecution has written a letter to the Law and Judiciary Department seeking permission to file an appeal, sessions court sources said today.

Meanwhile, the case was today adjourned till January 7 as the investigating officer did not attend the proceedings.

The prosecution, in the letter to the state government, said this was a fit case to file an appeal as the judge had erred in holding a de novo (fresh) trial. It said that there was no provision in law to hold a fresh trial and the evidence adduced in a court could not be discarded.

The prosecution argued that it would be difficult for them to trace all the witnesses and re-examine them. In the eyes of law, the evidence recorded earlier in this case by a Magistrate cannot be discarded and may be used in the trial.

On December 5, the court had ordered a fresh trial on the ground that the witnesses had not been examined in the context of aggravated charge of culpable homicide, which was invoked against the actor midway through the proceedings.

The charge of culpable homicide not amounting to murder attracts a 10-year sentence. The superstar had earlier been tried by a Magistrate for a lesser offence of causing death by negligence, which entailed an imprisonment of two years.

The case, dragging on for over a decade, had taken a twist earlier this year when the Magistrate, after examining 17 witnesses, held that the charge of culpable homicide was made out against Salman and referred the matter to a sessions court as cases under this offence are triable by a higher court.

On September 28, 2002, a Toyota Land Cruiser allegedly driven by Salman, had crushed a group of people sleeping on a pavement outside a bakery in suburban Bandra, killing one and injuring four.

Ernakulam, Feb 29: A court here on Friday issued a bailable arrest warrant against Malayalam actor Kunchacko Boban for failing to appear before it for witness examination in an assault case filed by an actress.

Ernakulam Additional Sessions Judge Honey M Varghese issued the arrest warrant.

As per the court's direction, Boban can take bail from police station and appear before court on March 4.

Mumbai, Apr 2: Ramayan, the over three-decade-old TV series based on Hindu mythology, garnered 170 million viewers in four shows over the last weekend in its new avatar, the BARC said on Thursday.

This catapulted the Ramanand Sagar production as the highest watched serial in the Hindi general entertainment space ever, the Broadcast Audience Research Council said.

The show was relaunched last Saturday amid the gloomy times of lockdown due to the COVID-19 pandemic, and a lot of thrust laid by the government machinery to popularise the series.

BARC's chief executive Sunil Lulla said the numbers notched up by the series was a bit surprising and called the move as a brilliant one by the Prasar Bharti.

He said eventually, we will also see advertisers flock the series which will be running for a few more days.

The inaugural show of the series on Saturday morning had 34 million viewers glued to their TV sets watching and enjoyed a rating of 3.4 per cent, while a telecast the same evening had 45 million viewers and a rating of 5.2 per cent.

The show bettered its performance on Sunday, with 40 million and 51 million people watching it in the morning and evening telecasts, respectively.

Chennai, Mar 3: Makkal Needhi Maiyam president and actor Kamal Hassan on Tuesday appeared before Chennai Police on Tuesday in connection the deaths last month of three people on the set of the movie, 'Indian 2'.

Hassan appeared before Chennai Police Commissioner in Egmore to record his statement.

Three people died while around 10 suffered injuries when a crane collapsed while shooting of the film was underway in Chennai at EVP Studios on February 19.

Madhu, personal assistant to director Shankar, Krishna, assistant director, and a staffer Chandran, lost their lives in the incident.

In an open letter, "Indian 2" Director S Shankar announced Rs 1 crore as financial assistance to the kin of the deceased.

'Indian 2' stars Kamal Haasan, Kajal Agarwal, Rakul Preet, Siddharth, Priya Bhavani Shankar, Delhi Ganesh and Nedumudi Venu in prominent roles.
