Rajiv assassins' death sentence commuted to life imprisonment

Rajiv_assassins New Delhi, Feb 18: Supreme Court Tuesday commuted the death sentence to the three assassins of former prime minister Rajiv Gandhi to life imprisonment, holding that the 11-year long delay in deciding their mercy petition had a dehumanising effect on them.

The apex court bench headed by Chief Justice P. Sathasivam said that the delay was not only inordinate but also unreasonable and unexplained.

The court said that life imprisonment would mean life in jail till end.

Gandhi was killed in 1991. His assassins were convicted by a TADA court in January 1998 and were awarded death sentence, which was confirmed by the apex court May 11, 1999.

The three assassins - V. Sriharan alias Murugan, A.G. Perarivlan alias Arivu and T. Suthendraraja alias Santhan - sought the commutation of their death sentence to life imprisonment on account of the inordinate delay of nearly 11-years in deciding their mercy petitions.

The court while commuting the death sentence rejected the contentions advanced by Attorney General G.E. Vahanvati on behalf of the central government.

The court said that though there is no time limit given in deciding the mercy petition by the president, but it was incumbent upon the government to decide the same at the earliest.

The court said this should be included as an additional criteria amongst the several government has already issued.

While rejecting the government's contention that it was incumbent upon the death row convicts to prove that they have suffered torture and dehumanisation during the pendency of the mercy petition, the court said there is nothing in Indian law and international law that puts the burden of proving torture and dehumanising condition on the death row convicts.

EPFO cuts interest rate on deposits to 8.5% for 2019-20

New Delhi, Mar 5: Retirement fund body EPFO on Thursday lowered interest rate on provident fund deposits to 8.5 per cent for the current financial year, said Labour Minister Santosh Gangwar on Thursday.

The EPFO had provided 8.65 per cent rate of interest on EPF for 2018-19 to its around six crore subscribers. The decision was taken at a meeting of the the Employees' Provident Fund Organisation's (EPFO) apex decision making body -- the Central Board of Trustee.

"The EPFO has decided to provide 8.5 per cent interest rate on EPF deposits for 2019-20 in the Central Board of Trustees (CBT) meeting today," Gangwar told reporters after the meeting here.

Now, the labour ministry requires the finance ministry's concurrence on the matter. Since the Government of India is the guarantor, the finance ministry has to vet the proposal for EPF interest rate to avoid any liability on account of shortfall in the EPFO income for a fiscal.

The finance ministry has been nudging the labour ministry for aligning the EPF interest rate with other small saving schemes run by the government like the public provident fund and post office saving schemes.

The EPFO had provided 8.65 per cent rate of interest to its subscribers for 2016-17 and 8.55 per cent in 2017-18. The rate of interest was slightly higher at 8.8 per cent in 2015-16.

It had given 8.75 per cent rate of interest in 2013-14 as well as 2014-15, higher than 8.5 per cent for 2012-13.

Women's college issues dress code, prohibits burqa

Patna, Jan 25: JD Women's College in Patna has issued a direction to the students to follow the prescribed dress code on the campus while stating that wearing a 'burqa' in college is prohibited.

"All students have to come to college in the prescribed dress code, every day except on Saturday. Students are prohibited from wearing 'burqa' in college", reads a notice signed by the Principal and Proctor of the college.

The college administration has also imposed a fine of Rs. 250 for violation of the norm.

I think this college management will allow girl students to wear tight jeans + t-shair and miniskirts but is not allowing a girl to cover her body. Are we in ancient days where humans had no dress to cover themselves or in the time of Nair kings in kerala who restricted ladies of low caste from covering their chest.

Kerala High Court grants bail to under-trial prisoners till April 30

Kochi, Mar 30: Kerala High Court on Monday granted interim bail to the under-trial prisoners and remanded accused in the state till April 30 in view of the lockdown imposed to prevent the spread of coronavirus.

The court said that the accused should report to the local police station immediately after getting bail. Those released on bail must strictly follow the lockdown instructions, the High Court said.

"Those who have been convicted of imprisonment for less than seven years will get bail. Prison Superintendents will release the prisoners who are eligible. But regular offenders are not entitled to get bail," the court said.

After the bail period, the accused should appear in the respective trial courts, where a decision will be taken on their bail by the respective trial courts.

The Supreme Court had last week asked all state governments to release undertrial prisoners, who are facing charges attracting less than seven years imprisonment, to reduce overcrowding of jails amid the ongoing coronavirus scare.

So far, 194 confirmed cases of coronavirus have been reported in the state.

The country is under a 21-day lockdown to prevent the spread of coronavirus, which according to the Ministry of Health and Family Welfare has claimed the lives of 29 people and infected a total of 1071 people as on Monday morning.
