‘Ram Janmabhoomi Nyas’ was created with a malicious intent: Muslim parties tell SC

New Delhi, Sept 17: The Ram Janmabhoomi Nyas was created in 1985, with a malicious intent, in order to damage the title of the Nirmohi Akhara, the Muslim parties argued in the Supreme Court on Monday, trying to draw a wedge between the Akhara and other Hindu parties associated with the Ayodhya title dispute

Senior advocate Rajeev Dhavan, appearing for Muslim parties, sharpened his attack on the suit filed by Devki Nandan Agarwal as the next friend of Ram Lalla.

"The outer portion of the disputed site was illegally acquired by Vishwa Hindu Parishad which was backed by then BJP government," he contended. The Uttar Pradesh Sunni Central Waqf Board does not accept the Ram Janmabhoomi as a juridical person, having legal rights.

Terming Agarwal's suit malicious, Dhavan also levelled the charge that Rs 25 crore was donated to usurp the temple. "Nirmohi Akhara is the Shebait, a devotee taking care of the deity, and they have full right to repair the temple, whereas Agarwal has no locus standi in this dispute," Dhavan told the court.

At one stage in the argument, Dhavan posed a query, asking the court as to who will get the title of the disputed land if it were not to be handed over to either the Akhara or the Waqf Board. "Lord Ram is not the litigant. He cannot be," he argued, asking how can a birthplace be converted into a juridical personality.

At this, Justice S.A. Bobde, one of the judges on the bench, asked Dhavan: "What is the deity, and are you suggesting form is necessary?"

As Dhavan replied that there has to be a manifestation, the judge noted: "God has to be formless". Dhavan then affirmed that form is not necessary, otherwise people will be claiming all over the place.

Dhavan then argued on the legal consequences of the deity's recognition as a juridical person, as the entire disputed land will be held by the deity.

"Lord Ram was installed in the Ram Janmabhoomi temple....and the Nyas maliciously encroached on the rights of Nirmohi Akhara," he insisted.

Dhavan also sought to nullify one of the Hindu parties' arguments, pinning down the birthplace of Lord Ram by relying on various religious historical texts, arguing that the idea of birthplace has been held on two strands - a belief and the other recognization of that area as deity to establish its distinctness.

"The consequences of this will be the area will become impregnable," he said, stating that if this situation were to arrive, then there can be no more claim for title and ownership. "Next friend is only Shebait by default," he argued.

A total of 14 appeals have been filed in the apex court against the 2010 Allahabad High Court judgment, which was delivered on four civil suits. The High Court judgement partitioned the 2.77-acre land in Ayodhya equally among the three parties -- the Sunni Waqf Board, the Nirmohi Akhara and Ram Lalla. A Constitution bench comprising of five judges and headed by Chief Justice Ranjan Gogoi is conducting the daily hearing on the matter.

New Delhi, Feb 11: AAP chief and Delhi Chief Minister Arvind Kejriwal has won from New Delhi assembly seat. He polled 46,758 votes, which is 61.1 per cent of total votes polled in the high profile constituency.

Kejriwal defeated Sunil Kumar Yadav of the Bharatiya Janata Party (BJP), who polled 25,061 votes, which is 32.75 per cent of total votes polled. Congress candidate Romesh Sabhawarl could get only 3,220 votes.

So far, the AAP has won 55 seats and is leading on seven seats. The BJP has won seven seats and is leading on two. The Congress is nowhere in the reckoning.

As per the details on the website of Election Commission of India at 8.27 pm on Tuesday, the AAP has secured 53.60 per cent votes, BJP 38.49 per cent, BSP 0.71 per cent, CPI 0.02 per cent, CPI-M 0.01 per cent, Congress 4.27 per cent, JDU 0.90 per cent, LJP 0.35 per cent, NCP 0.02 per cent, and NOTA 0.46 per cent.

Jan 31: Twenty-three children aged between six months and 15 years, who had been taken hostage by a murder accused after inviting them to his daughter's birthday party, were rescued late on Thursday night after police killed their captor in a village here.

The hostage drama began at Kasaria village in the afternoon and continued for about eight hours.

"The accused was killed and there were about 23 children who were rescued safely," Additional Chief Secretary (Home) Awanish Awasthi told reporters at a hurriedly called press conference at 1.20 am.

"The accused had invited the children for the birthday party of his daughter and held them hostage. It started about 5.45 pm on January 30 and continued for about eight hours," Director General of Police (DGP) O P Singh said, adding that in the entire operation they had tried to "engage" the accused and were successful.

He said the accused, identified as Subhash Batham, had initially released a six-month-old girl by handing her over to his neighbour from a balcony.

Eyewitnesses said a restive crowd gathered outside the house where the children were kept with some women wailing and praying for their safe release.

The crowd broke open the door of the house to rescue the children, they said.

As the accused opened fire, the police retaliated killing him on the spot.

In the exchange of fire, the captor's wife was injured, but none of the children suffered any injury.

A man and two policemen also suffered bullet injuries.

The motive of the accused was not known immediately.

Chief Minister Yogi Adityanath monitored the situation in Farrukhabad, which is nearly 200 km from state capital Lucknow.

"The CM as soon as he got to know about the incident called a meeting of the crisis management group and personally monitored the situation and ensured children are rescued safely," Awasthi said.

Earlier, a team of NSG (National Security Guard) commandos had taken a special aircraft to reach Farukhabad, a senior security official in Delhi said.

Police said Batham, a murder accused, seemed to be mentally unstable.

Inspector-General of Police, Kanpur Range, Mohit Agarwal, said, "The man called the children for a birthday party and held them hostage in the basement of the house. He fired six shots from inside the building."

Batham initially wanted to talk to the local MLA, but refused to speak to the leader when he arrived, Agarwal said.

London, May 11: Fugitive diamond merchant Nirav Modi's five-day extradition trial over the nearly USD2 billion Punjab National Bank (PNB) fraud and money laundering case is set to begin in London's Westminster Magistrates' Court today.

The London High Court rejected Nirav Modi's bail plea in Punjab National Bank (PNB) bank fraud case for the fifth time in early March.

Modi, the prime accused in the PNB fraud case, is currently lodged at Wandsworth prison in south-west London and is wanted for his alleged role in the Rs 13,570 crore loss caused to the Punjab National Bank (PNB) along with his uncle, Mehul Choksi.

Modi, 48, was arrested in March last year by Scotland Yard in connection with the case.

Modi was remanded in custody till February 27, 2020, after he appeared before a UK court on Thursday via video link from his London prison.

The latest bail hearing followed further assurances by Modi, including an increase in the amount of security he had offered as a guarantee as well as stricter bail conditions.

On his last bail application, Modi offered USD 4 million as a security guarantee in return for bail, an offer that was rejected by judges who ruled that there was a real risk that Modi would flee the UK to a country which has no extradition treaty with India.

At the same hearing, the judge ruled that there was "strong evidence" that Modi had engaged in "witness intimidation" and destroying evidence.

Given the seriousness of such allegations, it was all but certain that the latest bail application would be rejected.

Modi's lawyers had contended that their client was being held in difficult conditions at Wandsworth prison and had also claimed that his mental health was deteriorating as a result of his incarceration.

However, ruling at the High Court today, Justice Ian Dove said there was a "clear need for this application to be refused in the present circumstances."

It comes just days after the second sale of assets belonging to Modi valued at millions of dollars.

The items include a luxury Rolls Royce car, a Patek Philippe watch and a painting by the renowned Indian artist Amrita Sher-Gil valued at USD 2.5 million but expected to fetch considerably more.

Meanwhile, Nirav's brother Neeshal Modi, who is also one of the co-conspirators in the PNB scam, has written to Enforcement Directorate, distancing himself from his brother's actions and said that he had no knowledge of it.
