Rape accused gets bail, Court says physical relation consensual

New Delhi, Jan 23: A man accused of raping a 26-year -old woman on the pretext of marriage has been granted bail by a Delhi court, which said the complainant had consented for physicalrelationsand knewtheconsequences of her act.

lawAdditional Sessions Judge R K Tripathi released the accused on bail noting that the complaint was lodged as the accused, a Delhi resident, was neither agreeing to marry the woman nor was he attending her calls.

"The complainant is reported to be 26-year-old and a graduate. Accused is alleged to have made physical relations with her on the pretext of marriage. The complainant consented for physical relationship with him before solemnisation of marriage. She knew the consequences of her act that accused may or may not marry her," the judge said.

The judge further noted that as per the complainant, the accused was "neither agreeing for marriage nor he is attending her calls. On the aforesaid allegations of complainant, FIR under section 376 (rape) of the IPC was registered."

The court, while granting him bail, said, "Accused is not required for his custodial interrogation. No incriminating material is to be recovered at the instance of accused. He is permanent resident of Delhi.There is nopossibility of his absconding or fleeing from justice."

The court also directed that the accused shall not contact the complainant and will not threaten or intimidate her.

"He shall also not try to influence the prosecution witnesses. Accused shall not leave the country without prior permission of the court," it said.

An FIR was lodged this month on the basis of written complaint given by complainant, alleging that the accused, whom she met on April 2, 2014 at Nizamuddin Dargah in south east Delhi here, lured her into a physical relations on the pretext of marriage.

It alleged that he sexually assaulted her on two occasions and then stopped taking her calls and refused to marry her.

Nagpur, Apr 5: A 23-year-old man allegedly committed suicide in Imambada area in Nagpur on Saturday due to financial distress, police said.

Nikhil Gavhane, who worked in a grocery shop, hanged himself as he had taken money from a person and was stressed over repayment, an official said.

"He was depressed since a week," the Imambada police station official said.

Mandya, Jun 14: In a tragic incident, a woman and her two children were drowned in a pond at Beeranahalli village in Nagamangala taluk of this district on Sunday.

Police said that the deceased have been identified as Geeta (40), and her two children Savita(19) and Soumya(14).

Savaitha is a degree student while Soumya was studying in 9th standard. The trio drowned in a pond where they had gone to wash their cows. The locals rushed to the spot and tried to rescue them but could not save.

Bijnor, May 24: A man died after he was attacked by his cousins, allegedly for not getting tested for the Coronavirus after his return from Delhi.

The incident took place in Malakpur village in Bijnor district.

Manjeet Singh (23) died on Friday during treatment in Meerut.

A FIR has now been registered against Manjeet's cousins, Kapil and Manoj, their mother Puniya and Manoj's wife Dolly at the Nahtaur police station on a complaint filed by the father of the deceased Kalyan Singh on Sunday.
SHO, Nahtaur police station, Satya Prakash Singh said that no arrests have been made yet.

According to reports, Manjeet died due to head injuries.
His sample was not collected for a Coronavirus test by doctors during treatment.
Additional SP, Bijnor, Sanjay Kumar said, he underwent thermal screening when he reached Bijnor on May 19 from Delhi. The report was negative so his sample was not collected.

SHO Satya Prakash Singh said, "Since his return, Kapil and Manoj were regularly asking Manjeet to get his test done. On Thursday, the cousins again asked Manjeet to get his test done after which an argument ensued between them."

"The accused brought sticks and started hitting Manjeet. He suffered injuries on the head and shoulder. When Manjeet fell unconscious, he was rushed to government hospital by his parents where he succumbed to injuries a day later," said Singh.

Chief Medical Officer, Bijnor, Dr Vijay Yadav said he has "no information" about the matter.
