RBI says linking bank accounts with Aadhaar mandatory

New Delhi, Oct 21: At a time when customers are rushing to link all their bank accounts with Aadhaar, the Reserve Bank of India (RBI) on Saturday clarified that it never issued any such directions and it was the decision of the Indian government.

The apex bank further clarified that in applicable cases, linkage of Aadhaar number to a bank account is mandatory under the Prevention of Money-laundering (Maintenance of Records) Second Amendment Rules, 2017.

In a response to a Right to Information (RTI) Act application filed by Moneylife India and carried by it on October 18, the RBI said: "The Government has issued a Gazette Notification GSR 538(E) dated 1 June 2017 regarding Prevention of Money laundering (Maintenance of Records) Second Amendment Rules, 2017, inter-alia, making furnishing of Aadhaar (for those individuals who are eligible to be enrolled for Aadhaar) and permanent number (PAN) mandatory for opening a bank account. It may be noted that Reserve Bank has not yet issued the instruction in this regard".

Clarifying its position, RBI in a statement on Saturday said: "...in applicable cases, linkage of Aadhaar number to a bank account is mandatory under the Prevention of Money-laundering (Maintenance of Records) Second Amendment Rules, 2017 published in the Official Gazette on June 1, 2017. These Rules have statutory force and, as such, banks have to implement them without awaiting further instructions."

The RBI also said that anti-money laundering rules announced in June 2017 have "statutory force" and banks have to implement them without awaiting further instructions.

The government has made it mandatory to link bank accounts with the 12-digit biometric identification number. The deadline to do it is December 31, 2017.

This linking of Aadhaar to bank accounts is a process over and above the Know Your Customer (KYC) norms already followed by the banks.

Finance Minister Arun Jaitley in August had said that 524 million Aadhaar numbers had been linked to 736.2 million bank accounts in India.

Banks accounts in India are already linked to the tax-related Permanent Account Number (PAN), which is mandatory.

The Finance Minister had outlined a "one billion-one billion-one billion vision" for the country.

"That is one billion unique Aadhaar numbers linked to one billion bank accounts and one billion mobile phones. Once that is done, all of India can become part of the financial and digital mainstream," Jaitley had said.

The RTI query further asked whether RBI had Supreme Court's permission to mandatorily link Aadhaar with bank accounts. In its reply, RBI said it had not filed any such petition before the Supreme Court.

The Aadhar programme, which is the world's largest biometric identity card programme, has triggered some claims that it is an infringement of privacy of citizens.

India's top court in August had said that privacy is a fundamental right and the verdict was expected to complicate efforts of Prime Minister Narendra Modi's government to make linking of the ID card numbers with bank accounts and telephone numbers.

New Delhi, Jan 22: Defence Minister Rajnath Singh on Wednesday said Indian values consider all religions equal, and that is why the country is secular and never became a theocratic state like Pakistan.

Speaking at the NCC Republic Day Camp in Delhi, Singh said: "We (India) said we would not discriminate among religions. Why did we do that? Our neighbouring country has declared that their state has a religion. They have declared themselves a theocratic state. We didn't declare so."

"Even America is a theocratic country. India is not a theocratic country. Why? Because our saints and seers did not just consider the people living within our borders as part of the family, but called everyone living in the world as one family," the minister said.

Singh underlined that India had never declared its religion would be Hindu, Sikh or Buddhist and people of all religions could live here.

"They gave the slogan of 'Vasudev Kutumbakam' -- the whole world is one family. This message has gone to the whole world from here only," he added.

Bikaner, Jan 5: A government-run hospital in Bikaner saw the death of at least 162 children, higher than the number of deaths in Kota's JK Lon Hospital in December.

"In December, we received 2,219 children from different hospitals out of which 162 children died in the Intensive Care Unit here. None of them was born at the hospital," said Dr HS Kumar, Principal, Sardar Patel Medical College, PBM Hospital.

He, however, denied any negligence on the part of the hospital and said that all efforts were made to save every single life.

The official said that all the deceased children had taken birth at the Primary Healthcare Centres (PHC) and the Community Health Centres (CHC) and were referred to the PBM Hospital in a critical condition.

"Their condition was critical and they breathed their last during treatment," he said.

At least 110 children have lost their lives at JK Lon government hospital in Kota, Rajasthan.

New Delhi, Feb 11: Celebrations broke out at the AAP headquarters here as early vote-counting trends for the Delhi Assembly polls on Tuesday showed a comfortable victory for the Chief Minister Arvind Kejriwal-led party.

The headquarters were decorated with blue and white balloons and big cut-outs of Kejriwal were placed in different parts of the party office.

"We knew it. We have changed the politics of this country. Now it is Delhi, next is India," said Sanjeev Singh, a party volunteer from Hari Nagar.

Another volunteer Fareen Khan said, "We hope we get such a clear majority that a message goes out that doing Hindu-Muslim politics will not work anymore."

The Aam Aadmi Party (AAP) is leading in 26 seats while the BJP is leading in 14 seats, according to early trends by the Election Commission.

According to the EC's website, AAP convenor Kejriwal is leading in his New Delhi constituency.

Kejriwal reached the party office as the counting of votes got underway.

Counting centres are spread across 21 locations, spanning 70 constituencies.

Polling for the 70-member Delhi Assembly was held on Saturday.
