Reign of terror in UP as Yogi govt brutally crushes anti-CAA protests: Fact-finding team

New Delhi, Dec 26: There is a "reign of terror" in Uttar Pradesh where the Yogi Adityanath-led BJP government is trying to crush the protests against Citizenship Amendment Act (CAA) by "brazenly" targeting minorities, agitators and activists to suppress all kinds of dissent, a fact-finding team said on Thursday.

The report by the 'Ham Bharat ke Log: National Action Against CAA', which is an umbrella body of around 70 organisations, said there was "little doubt" that all this is happening under Adityanath's "personal direction, sanction and supervision".

"He (Adityanath) publicly announced a doctrine of revenge against the protesters. In a shocking audio tape in wide circulation, a senior police official can be heard saying that he has the Chief Minister's instructions and full immunity to beat the violent protesters to pulp so as to teach everyone a lesson. Sadly, none other than the Prime Minister (Narendra Modi) has openly supported this wanton cruelty and breakdown of law and order," it said.

The fact-finding team, which consisted of activists Yogendra Yadav, Kavita Krishnan, Harsh Mander and Nadeem Khan, demanded that the state government must stop the "state-sponsored attack" on protesters, release innocent detainees and quash FIRs with large number of anonymous accused. It also demanded among others a probe by Supreme Court-monitored Special Investigation Team (SIT) to unravel the "truth about protests, violence, police action and killings".

Releasing the report along with other members, Swaraj India's Yadav said, "there is a reign of terror in UP and the instructions come directly from the Chief Minister himself. It was the Chief Minister himself spoke about revenge. Not a single law in the country allows police to seek revenge. But this is the message given to police."

Activist Mander said the BJP-RSS is wedded to a different idea of India, a divisive India, which is against the spirit of what Mahatma Gandhi propagated. Speaking about those killed in police firing in Meerut, AIPWA's Krishnan said false cases were being foisted upon the victims and their families.

"One of the young victims was an e-rickshaw driver. He was staying in Delhi in his teenage and had identification papers from Delhi. He stayed with his parents in Meerut for so many years but after he was shot dead, police now accuse him of being a mastermind who brought outsiders from Delhi. Everyone in the neighbourhood told us that he was very well in Meerut working and that he was not involved," she said.

Khan of the United Against Hate said that there is a competition among police officers about who is filing more FIRs against protesters.

"The situation in UP is that many people have left their homes. Kanpur alone has an FIR against 22,500 unknown. People there says there has never been such a huge protest in Kanpur," he said adding families of victims of police firing are unable to get post mortem reports. He also claimed that FIRs were also filed against family members of victims so that they keep silence.

The report said, "media persons, human rights activists and even lawyers have been detained for trying to find out about the detainees. Opposition leaders have been prevented from visiting the places affected by police attrocities. Therefore, we still do not quite know the extent of police repression."

Mangaluru, June 6: Four persons were arrested by the Mulki police today in connection with the murder of Abdul Lateef, a 38-year-old businessman.

The arrested are: Mohammed Hasim (27), Nissar alias Riyaz (33), and Mohammed Razim (24), all residents of Mulki, and Aboobakar Siddique (27), a resident of Udupi.

The weapons and vehicles used for murder have been confiscated. Investigation is in progress to find out the motive behind the murder and the arrest of remaining accused.

Abdul Lateef, his father-in-law Muneer, latter’s son Ijaz and relative Imran were returning from Vijaya Bank at Mulki when a gang of nine miscreants waylaid their car and attacked with sharp weapons.

The gang comprised of Hakeem, Wafa, Asim, Siddique, Nissar, Bava, Farhan, Razeem and Siddiq.  While four of them are arrested, police continued hunt to nab other accused.

Abdul Lateef breathed his last while being taken to hospital. Others are undergoing treatment at a private hospital in Mangaluru.

Bengaluru, Mar 4: The Karnataka High Court has issued a notice to the state government in connection with the denial of retirement benefits to a retired deputy commissioner of commercial taxes who had fought against the illegal iron ore lobby.

Justice G Narendra also directed the state to respond to the notice before March 9, stating the reasons for withholding the officer’s retirement benefits.

Advocate Ramananda, appearing for the retired officer Josephat Andrews, explained that the single-judge bench also warned the government of stringent action.

Petitioner Josephat Andrews said his retirement benefits amounting to Rs 25.88 lakh were being withheld since 2014.

In 2009, Andrews detected a huge scam involving Vijaya Leasing, a company associated with former minister Gali Janardhan Reddy. Immediately he wrote to his higher officials explaining to them how the department was owed Rs 1,400 crore in taxes by the company. Immediately after that, Andrews was transferred to Bengaluru.

The media exposed the scam in 2012. Thereafter, to harass the officer, Andrews was served notice for allegedly not conducting an inspection of M/s Vijaya Leasing, which was controlled by the family of then tourism minister Gali Janardhana Reddy, on July 11, 2012.  He was discharged by a full departmental enquiry.

The petitioner was issued a second show cause notice on Jan 29, 2014 on the same charges. Before his retirement, he was docked two increments, denied promotional benefits and his pension was reduced without following due process.

He was served yet another notice with charges that he did not inspect goods vehicles, and an order was passed on April 30, 2019 reducing his pension by 5 per cent, an unprecedented punitive action.

This order was quashed by the Karnataka Administrative Tribunal (KAT), which also ordered payment of retirement benefits to Andrews within five months. However, the benefits were not released to him.  

“Rule 214 of the Karnataka Civil Services Rules (KCSR) make it clear that no enquiry can be held four years after an officer’s retirement.  Belying all statutory rules and precedents of the Supreme Court, Josephat Andrews’ retirement benefits were withheld for five years. Andrews therefore approached the High Court,” advocate Ramananda explained.

Josephat Andrews recalled to Deccan Chronicle that although mining activity was in full swing in 2008, the commercial tax department maintained that it had nothing to do with mining. “I travelled to Gujarat, Maharashtra and Bellary to investigate. I found tax evasion of thousands of crores. When I visited M/s the Vijaya Leasing facility – it was operating from an old oil mill premises–within 20 minutes I got calls from Ali, a person claiming to be the personal assistant of Gali Janardhan Reddy. He told me to get out of the premises as it belonged to his boss. Then calls came from minister Sreeramulu and MLA Nagendra. 

Within minutes 200-300 rowdies gathered around the building and my superior asked me to come back. Instead of filing a police complaint and forming a special team to deal with the situation, the department transferred me to Bengaluru,” he explained.

Talking about the High Court directive, Josephat Andrews said, “I have suffered a lot. Instead of getting a reward for increasing revenues by Rs 2,000 crore, I was punished.”

Bengaluru, Apr 11: Seven more people have tested positive for coronavirus taking the tally to 214 in the state.

"Coronavirus cases rise to 214 in Karnataka, with seven more people testing positive between 5 PM Friday and 12 PM Saturday," said the Karnataka health department.

According to the health department, all these seven people have a history of contact with COVID-19 patients. Five of them are workers of a pharmaceutical company in Mysuru.

"Out of the total cases in the state, six people have died while 37 others were cured or discharged," added the state health department.
