Romanian government seeks loophole on corruption

Bucharest, Feb 7: Romania's government is on a high-risk mission: devise a legal and politically acceptable way to remove penalties for some types of official corruption.

First, the government tried to effect the change by imposing an emergency decree without public debate. The move backfired badly, sparking massive demonstrations in the capital of Bucharest and other major cities that caused the government to reverse course.

The standing of the left-leaning government that assumed power two months ago has fallen so quickly that leaders found it necessary Monday to assert they would not resign even as the protests continued. The prime minister says a new proposal will be put before Parliament instead.

Is there a legal and political path for the government to accomplish its goal of easing corruption rules for public officials? Experts say Parliament can indeed pass such a law, and it could take effect if the president signs it, but the political task of winning support is trickier.

Laura Stefan, a Romanian anti-corruption specialist with the Expert Forum public policy think tank in Bucharest, said the government made a strategic blunder with the emergency decree. It would have tolerated abuse of power by officials, ranging from a mayor in a small village to a top government minister, if the amount of graft involved totaled less than about $48,500.

"It's simply un-defendable," Stefan said. "How can you explain to the people of this country, who maybe don't make $50,000 in their lifetime, that it is okay for public officials to misuse their office in order to obtain less than $50,000 from the state budget."

Public officials have not offered a specific explanation for why the law is needed, although one minister said it would bring the country in line with other European nations. The decree also would have applied retroactively to officials already convicted of corruption offenses involving less than $48,500.

The threshold figure would not have applied to case in which money was stolen, which would still be prosecuted as theft, but could apply to mismanagement of public funds, kickbacks on purchases or contracts, or other types of official misconduct. It would apply to officials who have hidden interests in companies that they set up and then make purchases from while in office.

One possible beneficiary would be Social Democratic Party leader Social Democratic Party leader Liviu Dragnea, whose path to becoming prime minister has been effectively blocked by corruption charges. His party enjoys broad support in Parliament, giving backers hope the redrafted measure will pass despite vocal opposition in the streets.

The provocative proposal could be difficult to enact even if it passes in Parliament, however, because it would still require the approval of President Klaus Iohannis, who has expressed opposition to the measure in its current form.

Transparency International, which lobbies for greater openness in government, has opposed both the way in which the emergency measure was imposed without public scrutiny and the proposal now set to be debated in Parliament.

Adam Foldes, one of the group's international lawyers at its Berlin headquarters, said the proposal does not meet international conventions set out by the United Nations and the Organization for Economic Cooperation and Development that call for corruption penalties to be "proportionate, effective, and a deterrent."

"It doesn't look good from an international perspective or a domestic legal perspective," Foldes said, adding that the original proposal cost the relatively new government a substantial amount of public support and should have been put before elected representatives all along.

Many protesters say they plan to continue nightly demonstrations until the government steps down even though the emergency ordinance was withdrawn on Sunday.

Lawyer Nicholas Hammond, who practices in Romania, said the procedure for approving emergency decrees was put in place after the country's 1989 anti-communist revolution to deal with critical situations that developed when Parliament was not in session.

However, it soon was abused by officials seeking to act without input from legislators, he said.

"They realized they could do it even when Parliament was in session," Hammond said. "This wasn't even on the agenda and it was done at 10 at night."

There were signs Monday that the government, facing nightly protests, is wavering in its commitment to press for quick adoption of the proposal in Parliament.

Justice Minister Florin Iordache said in a statement Monday that he is "not preoccupied" with drawing up a draft law and will await clarification from the Constitutional Court.

Seoul, Jun 16: North Korea blew up an inter-Korean liaison office on its side of the border on Tuesday, the South's Unification Ministry said, after days of increasingly virulent rhetoric from Pyongyang.

"North Korea blows up Kaesong Liaison Office at 14:49," the ministry, which handles inter-Korean relations, said in a one-line alert sent to reporters.

The statement came minutes after an explosion was heard and smoke seen rising from the long-shuttered joint industrial zone in Kaesong where the liaison office was located, Yonhap news agency reported citing unspecified sources.

Its destruction came after Kim Yo Jong, the powerful sister of North Korean leader Kim Jong Un, said at the weekend: "Before long, a tragic scene of the useless north-south joint liaison office completely collapsed would be seen."

Since early June, North Korea has issued a series of vitriolic condemnations of the South over activists sending anti-Pyongyang leaflets over the border -- something defectors do on a regular basis.

Last week it announced it was severing all official communication links with South Korea.

The leaflets -- usually attached to hot air balloons or floated in bottles -- criticise North Korean leader Kim Jong Un for human rights abuses and his nuclear ambitions.

Analysts say Pyongyang may be seeking to manufacture a crisis to increase pressure on Seoul while nuclear negotiations with Washington are at a standstill.

Earlier Tuesday, North Korea's army said it was "fully ready" to take action against the South, included re-entering areas that had been demilitarised under an inter-Korean agreement.

"North Korea is frustrated that the South has failed to offer an alternative plan to revive the US-North talks, let alone create a right atmosphere for the revival," said Cheong Seong-chang, a director of the Sejong Institute's Center for North Korean Studies.

"It has concluded the South has failed as a mediator in the process."

Washington, Jan 15: The historic impeachment trial of US President Donald Trump will begin on Tuesday next week, Mitch McConnell, the leader of the Senate's Republican majority, has announced.

Earlier on Tuesday (January 14), Speaker Nancy Pelosi ended the standoff between the Senate and the Democratic-controlled House of Representatives saying that it would vote on next Tuesday to send the impeachment documents to the upper house so it can hold the trial on charges that Trump obstructed Congress and abused presidential powers.

This will be only the third time in the nation's history that a US president is tried after impeachment and Trump can expect to be acquitted like his two predecessors - Bill Clinton in 1998 and Andrew Johnson in 1868 - because there won't be a two-thirds majority to convict and remove him from office.

McConnel told reporters on Tuesday that preparations like swearing in the Senators as jurors for the trial could begin this week ahead of the formal start on next Tuesday.

"This Impeachment Hoax is an outrage," Trump tweeted, repeating his longstanding complaint about it, when the move to hold the trial finally appeared to gain traction.

"The American people deserve the truth and the Constitution demands a trial," Pelosi said.

She had held on to the Articles of Impeachment - the chargesheet against Trump - that the House voted on December 18 in a bid to pressure McConnell to accept her terms for holding the trial and in an attempt to get some Republican senators to break ranks on procedural matters.

But she has agreed to let the process move forward, without an agreement on the main Democratic demand to call in their witnesses at the trial and to introduce new evidence.

The House Intelligence Committee, which conducted the investigation against the president, on Tuesday released what it said was new evidence from Lev Parnas, a former associate of Trump's personal lawyer Rudy Giuliani. Parnas is facing criminal charges.

Pelosi said that starting the trial without witnesses or documents "a pure political cover-up."

The impeachment process is only an investigation by the House and the framing of the chargesheet for the Senate trial that will be presided over by Chief Justice John Roberts with the Senators as jurors and nominees of the House as prosecutors.

While there is no chance for removal of Trump from office, Democrats see the Senate trial as a propaganda mechanism ahead of the elections in November by giving the charges against Trump another public airing and turning voter opinion against Republican senators facing re-election.

Trump called for an outright dismissal of the impeachment by the Senate, but McConnell said, "There is little or no sentiment in the Republican conference for a motion to dismiss."

He added, "Our members feel that we have an obligation to listen to the arguments."

Trump tweeted that by not dismissing the impeachment out of hand, the Senate trial was giving "credence to a trial based on the no evidence, no crime" and "the partisan Democrat Witch Hunt credibility."

Pelosi had hoped to make some Republican senators break ranks with the leaders on the procedures for the trial and has partially succeeded in this as at least four of them appear open to witnesses being called.

While Trump's conviction and ouster from office is virtually impossible because of the two-thirds vote requirement in the 100-member Senate, only a simple majority is required on procedural matters. The Republicans have 53 members and four of them shifting positions could make a difference here.

McConnell appeared confident that he would have a hold on his party senators to set the rules for the trial.

Whether witnesses would be called to testify is still open as the Republicans have said that it would be decided when the trial starts.

The main sticking point is the Democrats demand to call their witnesses to testify at the trial.

The Democrats did not allow the Republicans to call their own witnesses to testify during the impeachment proceeding in the House and Republicans did not seem inclined to oblige them in the Senate.

Trump tweeted, "'We demand fairness' shouts Pelosi and the Do Nothing Democrats, yet the Dems in the House wouldn't let us have 1 witness, no lawyers or even ask questions."

The charges against Trump stem from a July phone call he had with Ukraine's President Volodymyr Zelensky in which he asked him as a "favour" to investigate former Vice President Joe Biden and his son Hunter.

Democrats say that this was an abuse power and amounted to inviting foreign interference in US elections as Biden is the leading candidate for the Democratic nomination to run against Trump in this year's election.

They also say that he withheld crucial military aid to Ukraine, a US ally against Russia, to pressure Zelensky and this endangered US national security. Trump said he delayed the aid to make sure the new government stomped out corruption.

Hunter Biden, who was made to leave the Navy because of alleged drug use and had no experience in the energy industry or in Ukrainian businesses was appointed a director of a gas company there and received monthly payments of $83,000, according to Republicans.

The former vice president, who was looking after Ukrainians affairs, had a prosecutor looking into gas company removed.

He and the Democrats say that it was because the prosecutor was corrupt, while Republicans see it as a conflict of interest.

The obstruction of Congress resulted from Trump's refusal to provide documents that the House demanded and allow some administration officials to testify at the House hearings.

British lawmaker Debbie Abrahams' e-Business visa was revoked as she was involved in anti-India activities and the cancellation was conveyed to her on February 14, government sources said on Tuesday.

Asserting that the grant, rejection or revocation of a visa or electronic travel authorisation is the sovereign right of a country, the sources said Abrahams was issued an e-Business visa on October 7 last year which was valid till October 5, 2020 for attending business meetings.

"Her e-Business visa was revoked on February 14, 2020 on account of her indulging in activities which went against India's national interest. The rejection of the e-Business visa was intimated to her on February 14," a source said.

Abrahams, who chairs a British parliamentary group on Kashmir, was denied entry into India upon her arrival at the New Delhi airport on Monday.

Government officials had said on Monday also that she was informed in advance that her e-visa had been cancelled.
