RTIs, PILs a 'big problem', say MPs in RS

New Delhi, Apr 28: Members in Rajya Sabha today termed RTIs and PILs as a "big problem" for the country, with Samajwadi Party member Naresh Agrawal alleging that the Right to Information (RTI) Act was passed "under US pressure".rti

As some other members also joined in expressing concern during the Question Hour over the misuse of RTI, Government expressed readiness to look into the issue of "misuse" of RTI.

Calling it a law "passed in a hurry", Praful Patel (NCP) said that there is no locus of people seeking answers under RTI. "Some 'panwadi' (betel leaf seller) or 'chaiwala' (tea vendor) can also ask who made a missile programme or anything on international relations," he said.

Seated in the treasury benches, Prime Minister Narendra Modi, who has frequently referred to his modest origins as a tea seller, began laughing at Patel's reference to tea vendors. Leader of the House Arun Jaitley, who was seated next to Modi, also smiled.

Patel soon sought to make amends by saying he did not make this remark keeping Modi's origin in mind. "There is no disrespect to the Prime Minister. Rather it is an honour," he said.

Under this law, anybody can pay Rs 10 and seek information about missiles, he said and asked "is the government willing to consider amendments in this Act."

Patel said government officials were afraid of taking decisions because of the fear of the RTI. "They wonder what will come out in the RTI. Objectivity is finished. We all have concerns about this," Patel said.

Alleging that RTI law was enacted "under US pressure", SP's Naresh Agarwal wanted to know whether such laws existed in neighbouring countries like Pakistan, Sri Lanka or Bangladesh.

When he said something which was not audible in the din, former Union Minister Jairam Ramesh, who is believed to have played an active role in enactment of the RTI during the UPA government, was enraged.

"This is totally wrong," he said evoking a strong response from Agrawal, who reminded that Ramesh is no longer a minister and people "uprooted" Congress due to such "misconceptions".

The SP member went on saying "RTI and PIL are a big problem for the country. So many departments have requested in writing to be kept out of the ambit of RTI."

Rajiv Shukla (Cong) said the RTI was being "misused". "People have got visiting cards printed with RTI activist embossed on them as if it was some designation. What steps are being taken to check such misuse."

Responding to concerns about the misuse, Minister for State Personnel, Public Grievances and Pensions Jitendra Singh said "cognizance of the issue has been taken. Some measures have already been put in place. Perhaps there is scope to bring in some more provisions."

He said that as far as the concern that the law may deter officers from taking initiatives, the "government is equally conerned."

The minister was replying to a question regarding a study by Commonwealth Human Rights Initiative, which said ministries and departments were reluctant and unwilling to share even basic data under the RTI Act.

Singh also claimed that the response to queries under the Act has gone up substantially under the NDA rule and for the first time, all vacant posts of RTI officers have been filled up.

"As per the annual report of the Chief Information Commissioner (CIC), 75.27 percent of the Public Authorities have filed their annual returns to the CIC for 2014-15, which is higher than the figure of 72.54 percent for 2013-14, indicating an improved compliance over the previous year," the minister said.

Shimla, Apr 19: A man, who had recovered from the novel coronavirus, was again found suffering from the infection in Himachal Pradesh, officials said.

The man, a Tablighi Jamaat member, tested positive for the infection on Saturday within a week of his two reports coming out negative, they said.

Residents of different places in Mandi district, the man along with two other Jamaatis had been staying in a mosque of Nakroh village in Una'a Amb tehsil and all tested positive on April 2.

They were admitted to Tanda's Dr. Rajendra Prasad Government Medical College (RPGMC) in Kangra district on April 3.

As per the available information, they had tested negative for the first time on April 10 and they were declared as cured as per protocol after they tested negative for the second time on April 12.

Subsequently they had been discharged from the RPGMC and were kept in institutional quarantine.

However, with the man again testing positive, the total number of active cases in the hill state has increased to 23 out of the total 40 positive cases.

Four persons have been shifted to a private hospital outside the state. Eleven have recovered while two others have died.

A total of 16 confirmed cases were found in Una and health department statistics now shows 14 active cases and two cured.

Officials said 11 patients — three each from Chamba, Kangra, and Solan districts and two from Una district — have recovered.

New Delhi, May 25: Mahindra Group Chairman Anand Mahindra on Monday said lockdown extensions are not just economically disastrous but also create another medical crisis.

While acknowledging that choices are not easy for policymakers, he said a lockdown extension will not help.

"Lockdown extensions aren't just economically disastrous, as I had tweeted earlier, but also create another medical crisis," Mahindra said in a tweet.

He was referring to an article that highlighted "the dangerous psychological effects of lockdowns & the huge risk of neglecting non-COVID patients".

Mahindra, who had earlier proposed a comprehensive lifting after 49 days of lockdown, further said, "The choices aren't easy for policy makers but a lockdown extension won't help".

He said, "The numbers (coronavirus cases) will continue to rise & the focus must be on rapid expansion of field hospital beds with oxygen lines".

He further said, "The army has enormous expertise in this".

On March 22, before the government announced nationwide lockdown, Mahindra had proposed such a move expressing concerns over reports that India was likely to have already reached stage 3 of coronavirus transmission.

New Delhi, May 25: Realtors' apex body CREDAI has written a letter to Prime Minister Narendra Modi, seeking immediate relief measures to tide over the crisis caused by the COVID-19 pandemic.

The association, which has around 15,000 developer members, has sought one-time debt restructuring, lower interest rate on home loans and tax sops to boost liquidity and demand in the sector.

In an open letter to the prime minister, the Confederation of Real Estate Developers' Associations of India (CREDAI) said, "In this distressful situation arising out of the COVID-19 calamity, we in the real estate sector seek immediate relief for our survival."

Stating that the sector contributes substantially to the country's GDP and has backward and forward linkages with almost 250 industries, CREDAI said, "Our survival, therefore, is not just desirable, it is rather crucial for the economy."

Liquidity crunch, stagnant demand and cartelization of raw materials are major impediments for the industry to kickstart, it added.

CREDAI made seven recommendations to revive the sector and sought immediate intervention from the prime minister.

Pointing out that the situation is "much worse" than global financial crisis in 2008, CREDAI said "a one-time restructuring scheme as was permitted by RBI in 2008 may be quickly instituted by all lending institutions."

Since real estate was already reeling under a cyclical downturn before COVID-19, debt restructuring needs to be allowed for all accounts which were standard as on December 31, 2019, it added.

CREDAI demanded that all banks, non-banking financial companies (NBFCs) and housing finance companies (HFCs) should be directed to provide additional credit equal to 20 per cent of the existing real estate project related advances with no additional security and without the classification of project as NPA.

The penal interest charged by banks and financial institutions should be suspended for a period of one year or until such time as it takes for the pandemic to abate.

To revive housing demand, CREDAI suggested that "government should reduce the maximum rate of interest on new home loans to 5 per cent by subsidizing the interest component of EMIs for next five years."

The limit of principal deduction on housing loan under Section 80C should be increased to 2.5 lakh.

Interest deduction under Section 24 on housing loan for homebuyers may be increased to Rs 10 lakh, it said.

There should be no capital gains for residential properties held for a period longer than one year.

CREDAI also demanded that the subvention scheme be allowed again by National Housing Bank (NHB) and the Reserve Bank.

Under the scheme, builders used to pay EMIs on behalf of homebuyers during construction of projects.

"The economic uncertainty and job insecurity at the moment would not allow purchase of residential property at this time. A scheme whereby a homebuyer would need to pay only margin money with no EMI for 24 months will address this insecurity," the letter said.

The association pointed out that prices of cement and steel have been increased during the lockdown period, and asked for crackdown on cartelisation by manufacturers.

On the GST front, CREDAI said that the current regime of GST provides a rate of 1 per cent  for affordable housing.

"The limit of Rs 45 lakh serves as a criterion of affordability for the purpose of GST. On all other housing, GST is applied at the rate of 5 per cent without input tax credit. It has been felt that the criterion of Rs 45 lakh is too low an index of affordability anywhere across the country, and especially so in the metros," the letter said.

It will serve as an inducement to buyers in the metros if the benefit of GST at the rate of 1 per cent is extended to units costing up to Rs 75 lakh, the association said.

CREDAI pointed out that the flat rate of 5 per cent GST for under construction residential housing is causing cost build up and is acting as a deterrent for sale of under construction projects since there is no GST on completed units.

It suggested that GST rate of 1 per cent and 5 per cent, without input tax credit, should continue.

"However, an option of GST @12 per cent for normal housing/ 8 per cent for affordable housing (with 1/3rd deduction for land i.e. effective GST rate of 8 per cent for normal housing and effective GST rate of 5 per cent for affordable housing) with input tax credit (ITC) benefits in line with the scheme applicable for the works contracts for government may be revived and made applicable to the real estate," the letter said.

Lastly, CREDAI demanded that a Rs 25,000 crore stress fund for completing stalled housing projects should be deployed at the earliest.

"We shall be grateful for your much-needed intervention for the above mentioned measures required to revive the real estate sector," CREDAI said in the letter to the PM.
