Sachin Tendulkar sues Australian cricket bat maker over 2 million dollars in royalties

Sydney, Jun 14: Indian cricket great Sachin Tendulkar has filed a civil lawsuit against an Australian bat manufacturer, accusing it of using his name and image to promote products and then failing to pay him $2 million in royalties.

In Federal Court papers filed this month and reviewed by Reuters, Tendulkar said Sydney-based Spartan Sports International agreed in 2016 to pay him at least $1 million a year to use his image, logo and promotional services to sell "Sachin by Spartan" sporting goods and clothing.

The retired star batsman soon went to work promoting the products, and appeared at a range of promotional events in places such as London and the Indian financial hub of Mumbai, the documents showed.

However, by September 2018, Spartan had failed to make a single payment owed, Tendulkar said, and he made a formal request for payment. When none came, he ended the agreement, asking the company to stop using his name and likeness.

Yet Spartan continued to do so, according to the documents.

Spartan, whose legal representative was not listed on the Federal Court website, did not respond to an email request from Reuters for comment.

Les Galbraith, listed by the court documents as its chief operating officer, did not respond to a private message sent.

The law firm listed as representing Tendulkar, Gilbert + Tobin, declined comment.

Tendulkar's civil claim accused the Australian company of misleading or deceptive conduct, "passing off", or suggesting an official endorsement when none existed, and breach of contract. It did not say what damages were sought.

Tendulkar became the world's leading run-scorer in tests and one-day internationals, with more than 34,000 runs and 100 centuries, in a 24-year career that ended in 2013.

In 2012, he was made an honorary member of the Order of Australia, one of the country's highest civil awards.

The court website showed the lawsuit was filed on June 5, with the first court date in Sydney on June 26.

New Delhi, Aug 2: BCCI president Sourav Ganguly on Sunday said the Women's IPL or the Challenger series, as it is better known, is "very much on", ending speculation about the parent body not having a plan for Harmanpreet Kaur and her team.

The men's IPL will be held between September 19 and November 8 or 10 (final date yet to be locked in) in the UAE due to the surge in Covid-19 cases in India. The women's IPL will also be fit in to the schedule, according to the BCCI chief.

"I can confirm to you that the women's IPL is very much on and we do have a plan in place for the national team also," Ganguly told PTI ahead of the IPL Governing Council meeting later on Sunday.

The BCCI president, who is awaiting a Supreme Court verdict on waiver of the cooling-off period to continue in the position, did not divulge details but another senior official privy to the development said that women's Challenger will be held during the last phase of IPL like last year.

"The women's Challenger series is likely to be held between November 1-10 and there could be a camp before that," the source said.

The former India captain also said that the centrally contracted women players will have a camp which has been delayed due to the prevailing situation in the country.

"We couldn't have exposed any of our cricketers -- be it male or female to health risk. It would have been dangerous," Ganguly said.

"The NCA also remained shut because of Covid-19. But we have a plan in place and we will have a camp for women, I can tell you that," he added.

The BCCI's cricket operations team is chalking up a schedule where Indian women are likely to have two full-fledged white-ball series against South Africa and the West Indies before playing the ODI World Cup in New Zealand.

New Delhi, Mar 1: Former Indian cricketer Mohammad Kaif on Sunday heaped praise on Ravindra Jadeja after the all-rounder took a spectacular catch on the second day of the Christchurch Test against New Zealand.

Jadeja grabbed a one-handed stunner at deep square leg in the 72nd over to dismiss Neil Wagner, who had to depart after scoring 21 runs.

"Sir Jadeja for a reason! Jadeja Airlines, flying high! Terrific stuff," Kaif tweeted.

In the match, Jadeja also impressed with the ball. The left-handed bowler took two wickets while giving away 22 runs.

On day two, India bundled out New Zealand on 235 runs in the second Test. However, in their second innings, Indian batsmen again struggled to tackle the New Zealand pacers and lost six wickets with a lead of just 97 runs.

India went to stumps at 90/6, with Trent Boult doing the majority of the damage with three wickets.

New Delhi, Jun 7: Former Pakistan spinner Danish Kaneria on Sunday said that Sourav Ganguly would be fit to lead the International Cricket Council (ICC), and added there is no reason for respective cricket boards to not support Ganguly if he wants to hold the post.

In an interaction with media, the former spinner said Ganguly has all the qualities of leading the ICC as he has been a reputed cricketer and knows what a player goes through in his life.

"I also think that it would be really helpful if Sourav Ganguly goes on to lead ICC, it will help cricket and the players as a reputed cricketer will hold such a big post, he has played professional cricket, he has led the Indian side and he has also held an administrative post in the Cricket Association of Bengal," Kaneria told media.

"It depends on all of the boards whether they want to support Ganguly or not, if other boards support Ganguly and PCB doesn't, then also Ganguly would have the maximum number of votes, as a cricketer Ganguly is fit to lead the ICC, he had led the Indian side so well and he has earned a name for himself, so I don't see any reason for boards not supporting Ganguly," he added.

Ganguly had become the president of the Board of Control for Cricket in India (BCCI) last year, but speculation continued to rise over the former skipper heading the ICC.

"He is currently the president of the BCCI, he knows in and out of everything, he knows what players have to deal with and he is aware of what cricket needs, he knows what support needs to be given to associate nations, players would be able to put forward their point in front of Ganguly," Kaneria said.

In May this year, Cricket South Africa's (CSA) director of cricket Graeme Smith had backed Ganguly to lead the ICC looking at the current scenario.

"Now it is even more important to have someone in a role who can provide leadership who understands and can navigate the challenges in the game today. I think post-COVID with the things that are going to come our way, to have strong leadership is important. I feel that someone like Sourav Ganguly is best positioned for that at the moment," sport24.co.za had quoted Smith as saying.

"I know him well, I played against him a number of times and worked with him as an administrator and in television. I feel that he has got the credibility, the leadership skills, and is someone that can really take the game forward and I think that, more than anything, that is needed right now at an ICC level," he added.

ICC's elections are slated to be held in July this year and current chairperson Shashank Manohar has already clarified that he is not seeking a tenure extension.

Ganguly was exceptional in making India play its first day-night Test last year.

India had played its inaugural day-night Test against Bangladesh at the Eden Gardens last year.
