SC asks EC to decide by May 6 Congress complaints alleging MCC violations by Modi, Amit Shah

New Delhi, May 2: The Supreme Court on Thursday directed the Election Commission to decide by May 6 nine complaints of the Congress party alleging MCC violations by Prime Minister Narendra Modi and BJP chief Amit Shah.

The poll panel told a bench headed by Chief Justice Ranjan Gogoi that it has already decided on two out of the 11 complaints which were filed by the Congress party against Modi and Shah for alleged violation of the Model Code of Conduct.

Senior advocate, Abhishek Manu Singhvi, appearing for Congress Lok Sabha MP Sushmita Dev, who has filed a petition in the apex court on the issue, said that they have given 11 representations to EC against the duo but it has taken decision on only two.

"The remaining representations of the petitioners shall be decided by the Election Commission before we hear the matter again on Monday (May 6)," said the bench also comprising Justices Deepak Gupta and Sanjiv Khanna.

The poll panel has given clean chit to PM Modi for two of his speeches -- one in Latur last month urging first time voters to dedicate their votes in the name of Balakot air strike heroes and soldiers killed in the Pulwama attack, and the other in Wardha on April 1, slamming Congress chief Rahul Gandhi where he had also indicated that the Kerala constituency had more voters from the minority community.

In her plea, Dev has alleged that "inaction" by EC on complaints against top BJP leaders was "a sign of invidious discrimination" as also "arbitrary, capricious and impermissible" as it was destructive of the integrity of electoral process.

It has been alleged that BJP leaders have been violating MCC during last four weeks and the EC has not taken any decisions on as many as 40 complaints of Congress party.

"Since March 10, that is the date on which General Elections, were notified, the Prime Minister, Narendra Modi and BJP President Amit Shah, specifically in sensitive areas and states, have ex-facie violated the provisions of the Representation of People's Act and the Conduct of Election Rules and the process, thereof.

"It is in public domain that they have indulged in hate speeches, repeatedly used the armed forces for political propaganda, despite a clear prohibition on the same by the EC," Dev alleged.

The Silchar MP said she has been constrained to move to the apex court to seek direction to the EC "to expeditiously take action on multiple representations/ complaints pending before the ECI" against Modi and Shah.

Alleging inaction on the part of EC, the plea said it has not been taking actions "despite cogent evidence" and exhortations to the EC demonstrated "abdication and indecision and a complete absence of justice, in ensuring a level playing field in ensuing general elections".

"The inactions, omissions and commissions by the EC are in complete and direct violation of Articles 14 and 21 of the Constitution and which are impeding free, fair and unbiased General Elections," the plea has said.

It also referred to the EC's circulars prohibiting parties and candidates from using pictures of armed forces for their political propaganda and using religions.

"The purpose of all these rules and regulations is to ensure a level playing field for all candidates regardless of position, influence or ideology and also to ensure that the sanctity and integrity of the electoral process is not undermined by unscrupulous individuals," it said.

The plea said that under the Constitution, the poll panel is the "watchdog of free and fair elections and is duty-bound to circumvent the pressure and ascertain that ensuing elections are free from any impediments in order to uphold the democratic sanctity and fundamental rights of the voter".

Kolkata, May 21: Around 300 nurses have left Kolkata for Manipur after resigning from their jobs, said JS Joyrita, Deputy Residence Commissioner, Manipur Bhavan, Kolkata on Wednesday.

"Around 60 more nurses will be leaving tomorrow. We are getting many calls from people who want to go back to Manipur," she said.

Earlier, it was reported that 185 nurses have quit their job from hospitals in Kolkata and returned to Imphal. Cristella, a nurse said: "We are not happy that we left our duties. But we faced discrimination, racism and people sometimes spit on us. Lack of PPE kits, and people used to question us everywhere we went."

According to the latest information available on the website of the Ministry of Health and Family Welfare, 2961 cases of the virus have been reported from West Bengal 1074 cured/migrated/discharged and 250 deaths.

India's COVID-19 tally reached 1,06,750 on Wednesday, according to the Union Ministry of Health and Family Welfare. As many as 140 deaths have been reported in the last 24 hours, taking the total number of deaths to 3,303. Out of the total cases, 61,149 are actives cases and 42,298 patients have been cured/discharged/migrated.

New Delhi, Feb 13: Arvind Kejriwal wrote to Delhi Lieutenant Governor Anil Baijal on Wednesday, staking claim to form the government in the national capital, sources said, while hinting that the AAP might not invite senior leaders and chief ministers of other parties for the oath-taking ceremony.

The sources said it was the formal process by the AAP chief, who was elected as the legislature party leader earlier in the day, to stake claim for forming the new government.

Kejriwal, who returned to power in Delhi with a stunning poll victory on Tuesday, will take oath as chief minister for the third consecutive time on February 16.

While the oath-taking ceremony will be open to the public, the Aam Aadmi Party (AAP) was considering not inviting leaders and chief ministers of other parties as it did not wish to be seen as a "confrontationist" against the BJP-led Centre, the sources said.

They, however, added that the party was yet to take a decision on it.

The AAP has planned mobilisation of people for the mega event and all the newly-elected MLAs of the party have been asked to ensure huge participation from their constituencies.

"I request the people of Delhi to attend the oath-taking ceremony of the chief minister at the Ramlila Maidan in large numbers," senior AAP leader Manish Sisodia told reporters, adding that the ceremony will start at 10 am.

The AAP won 62 seats in the 70-member Delhi Assembly, while the Bharatiya Janata Party (BJP) bagged the remaining eight seats. The Congress drew a blank for the second consecutive time in the Delhi polls.

New Delhi, Mar 12: TMC MP Saugata Roy said Home Minister Amit Shah should resign for "failing" to control the riots in Delhi and demanded a judicial inquiry by a sitting Supreme Court judge.

Participating in a discussion on the violence in Delhi in Lok Sabha, Roy said the Delhi riots happened 72 years after Mahatma Gandhi was killed by a Hindu fanatic.

"Gandhiji has been murdered again in Delhi by, you know who," Roy said while addressing the Chair.

Taking on BJP MP Meenakshi Lekhi for defending BJP leaders for their controversial remarks, which he claimed instigated the violence, Roy said he has seldom heard such a communal speech ever.

Dubbing the BJP MP as "Devil's Advocate", Roy said, "She spent five minutes defending the most hated man. May I quote (William) Shakespeare and call her the Devil's Advocate?...She is the best Devil's Advocate possible. She has also been an advocate for the Delhi Police which has shown total inaction and ineptness in this whole riot in Delhi."

Thereafter Roy trained his gun at Shah, who was present in the house while the TMC MP was speaking.

He said that when the riots started on February 24, Home Minister Shah was sitting in the front row at Motera Stadium (in Gujarat) welcoming US President Donald Trump.

"When Mr. Shah should have been in Delhi Police control room, he was welcoming Mr. Trump at Motera. There was no order to the police. Then on 25th, things went out of control. Armed mobs fought with each other on the streets of Delhi," Roy said.

Demanding resignation of Shah, Roy raised questions on NSA Ajit Doval's visit to the riots-affected areas on February 26 and asked what was the Home Minister doing.

"Is it NSA's business to control ordinary law and order situation? Why was the Home Minister absent in action? There is no explanation for the same," he said.

The TMC leader said he feels bad standing face-to-face with Shah.

"He is still young, he has a good future. He should acknowledge responsibility for his failure to control or stop Delhi riots and bring peace in three days. In the name of God, go and do not stay in the Home Minister's position," Roy said, adding he is the man who could not prevent riots in Delhi, at a place 10 kilometres away from the Home Ministry.

Roy demanded a judicial inquiry into the riots by a sitting Supreme Court judge and complete rehabilitation for all the riot victims.
