SC dismisses pleas seeking probe in special judge B H Loya's death case

New Delhi, Apr 19: The Supreme Court today dismissed a batch of pleas seeking an independent probe into the alleged mysterious death of special CBI judge B H Loya, who was hearing the high-profile Sohrabuddin Sheikh fake encounter case.

Loya had allegedly died of cardiac arrest in Nagpur on December 1, 2014 when he had gone to attend the wedding of a colleague's daughter.

A bench comprising Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud said attempts were made to scandalise the judiciary by levelling serious allegations against judicial officers and judges of the Bombay High Court.

There is no reason to doubt statements of four judges on circumstances leading to the death of Loya and the documents placed on record and their scrutiny establishes that Loya's death was due to natural cause, the bench said.

The top court said that with these petitions it becomes clear that a real attempt and a frontal attack was made on the independence of the judiciary.

The apex court said frivolous and motivated litigation has been filed to settle political rivalry.

The issue of Loya's death had come under the spotlight in November last year after media reports quoting his sister had fuelled suspicion about circumstances surrounding it and its link to the Sohrabuddin case. But Loya's son had on January 14 said in Mumbai that his father had died of natural causes.

In the Sohrabuddin Sheikh fake encounter case, BJP President Amit Shah along with Rajasthan Home Minister Gulabchand Kataria, Rajasthan-based businessman Vimal Patni, former Gujarat police chief P C Pande, Additional Director General of Police Geeta Johri and Gujarat police officers Abhay Chudasama and N K Amin have already been discharged.

Several accused, including police personnel, are currently facing trial for their involvement in the alleged fake encounter of Sohrabuddin Shaikh, his wife Kausar Bi and their associate Tulsiram Prajapati in Gujarat in November 2005. The case was later transferred to the CBI and the trial shifted to Mumbai.

A batch of pleas, including those filed by Congress leader Tehseen Poonawala and Maharashtra-based B S Lone, was filed in the top court seeking an independent probe into Loya's death in 2014.

Four senior-most apex court judges -- Justices J Chelameswar, Ranjan Gogoi, M B Lokur and Kurian Joseph -- at their January 12 press conference had questioned the manner in which sensitive cases were being allocated and Loya's case was one of them.

New Delhi, May 21: As many as 5,609 new COVID-19 cases were reported in India in the last 24 hours, taking the total number of cases in the country to 1,12,359 according to the Union Ministry of Health and Family Welfare.

Out of the total cases, 63,624 are active cases, 45,300 patients have been cured/discharged or have migrated and 3,435 deaths have been reported.

With 39,297 cases in total, Maharashtra remains the worst affected state in the country, followed by Tamil Nadu (13,191 cases), Gujarat (12,537 cases), and Delhi (11,088 cases).

The nationwide lockdown imposed as a precautionary measure to contain the spread of coronavirus has been extended till May 31.

Lucknow, Feb 2: In an early morning firing at Lucknow's Hazratganj, the city centre, Vishva Hindu Mahasabha state president Ranjit Bachchan was killed while he was out on a morning walk on Sunday.

Ranjit Bachchan was taking a stroll in Hazratganj in the morning when bike-borne assailants opened fire on him and killed him on the spot. The Mahasabha leader was shot in the head multiple times.

The incident took place near the CDRI building in Lucknow's Hazratganj.

In the firing, Ranjit Bachchan's brother also suffered bullet injuries. He has been rushed to the trauma centre. Ranjit Bachchan was a resident of Gorakhpur.

The early morning shootout in the Uttar Pradesh capital's central area has caused tension in the area.

Dinesh Singh, DCP Central Lucknow, said, "The body has been identified as of Ranjit Bachchan, who had gone out on morning walk when some unknown assailant shot him. A police team has been formed and further investigation is being carried out."

Before being associated with the Mahasabha, Ranjit Bachchan was a Samajwadi Party member and was often spotted with former UP chief minister Akhilesh Yadav.

The Samajwadi Party has hit out at the Yogi Adityanath government over the law and order situation in the state and demanded immediate resignation of the government.

Tezpur (Assam), Mar 2: Seven boys, who had appeared for their class 10 board examinations, were apprehended on Sunday for allegedly raping and killing a 12-year-old girl in Assam's Biswanath district, police said.

The girl was hanged from a tree after the crime.

The incident happened on Friday in Chakla village under the jurisdiction of Gohpur police station, they said.

A senior police officer told PTI that the culprits, all of them High School Leaving Certificate (HSLC) examinees, were on the run, but were nabbed by a police team.

The accused after the examination had called the victim to a house on the pretext of organising a party and raped her, the officer said.

It is suspected that the girl was raped on Friday night and then hanged from a tree in a forest near the house, the senior police officer said.

The body was found on Saturday.
