SC issues non-bailable warrant against Subrata Roy

Subrata_RoyNew Delhi, Feb 26: The Supreme Court on Wednesday issued a non bailable arrest warrant against Sahara chief Subrata Roy for his failure to appear before it in connection with the case in which his two companies have been directed to refund Rs 20,000 crore to investors.

"We had already declined yesterday Roy's plea seeking exemption from personal appearance. He has not appeared even today and we are issuing non bailable warrant returnable for March 4," a bench comprising justices K S Radhakrishnan and J S Khehar said.

At the outset when senior advocate Ram Jethmalani, appearing for Roy, informed the court that Subrata Roy has been unable to appear because of the ill health of his 95-year-old mother, the bench shot back "the arms of this court are very long. Yesterday only we had refused your plea for exemption from personal appearance. We will issue the non bailable warrant. This is the Supreme Court of the land."

"Yesterday we told you that we are not inclined to exempt him from personal appearance. If other directors can appear, why can't you?," the bench said.

The court had on February 20 come down heavily on the Sahara group for not refunding Rs 20,000 crore of investors money despite its order and summoned Roy, Ravi Shankar Dubey, Ashok Roy Choudhary and Vandana Bhargava, directors of its firms--Sahara India Real Estate Corp Ltd (SIREC) and Sahara India Housing Investment Corp Ltd (SHIC) to be personally present before it on Wednesday.

Jethmalani sought to explain Roy's non-appearance by saying that he was sitting on the bedside of his ailing mother and holding her hand.

He also placed before the bench the medical certificate on Roy's mother's ill health and said on all earlier occasions, the Sahara chief had complied with the apex court's order.

However, the bench said, "for last two years we have been seeing what's happening in the matter".

The apex court had on Tuesday rejected Roy's plea seeking exemption from personal appearance and had asked him to be present before it today.

The bench had made it clear that "rule of law" has to be maintained and Roy has to comply with its February 20 order in which he along with three directors of his companies have been summoned to appear.

During the hearing earlier, the bench had observed that Sebi could go ahead with the sale of properties of the group whose sale deeds were handed over to the market regulator to recover Rs 20,000 crore.

"Those properties you can sell. We allow you to sell them and recover the money. If they are encumbered properties then you can file criminal case against the company. The case must be brought to a logical conclusion," the bench had said.

The bench had raised question on the way the group has been defying its order for the last one-and-a-half years.

The bench had said Sebi can put those properties on auction and get the money after the market regulator had said that let the company itself sell the properties and deposit the money.

The apex court in its judgment of August 31, 2012 had directed SEBI to attach properties and recover the money.

Sending a clear message that the court is not "helpless" in taking action for flouting its directions, the apex court had on November 21 last year barred Roy from leaving the country and also restrained the group from selling any of its properties.

New Delhi, Jul 21: Prime Minister Narendra Modi and President Ram Nath Kovind on Tuesday condoled the demise of Madhya Pradesh Governor Lalji Tandon.

Tandon, 85, passed away at 5:35 am on Tuesday after a prolonged illness.

Taking to Twitter, Prime Minister Modi posted a picture with Madhya Pradesh Governor and wrote, "Shri Lalji Tandon will be remembered for his untiring efforts to serve society. He played a key role in strengthening the BJP in Uttar Pradesh. He made a mark as an effective administrator, always giving importance of public welfare. Anguished by his passing away."
"Shri Lalji Tandon was well-versed with constitutional matters. He enjoyed a long and close association with beloved Atal Ji. In this hour of grief, my condolences to the family and well-wishers of Shri Tandon. Om Shanti," he added.

President Kovind expressed condolences saying that we have lost a legendary leader today.

"In the passing away of Madhya Pradesh Governor Shri Lal Ji Tandon, we have lost a legendary leader who combined cultural sophistication of Lucknow and acumen of a national stalwart. I deeply mourn his death. My heartfelt condolences to his family and friends," he tweeted.

His last rites will be performed at Gulala Ghat in Lucknow at 4:30 pm today.

Tandon was admitted to a hospital after complaining of breathing problems, difficulty in urination and fever. He has been undergoing treatment since June 11.

New Delhi, Jan 27: Remember the story of two friends coming face-to-face with a bear in a forest? One of the two friends climbs the tree to save his life and the other, not knowing how to, lays on the ground, breathless, pretending to be dead.

Well, that lesson turned out to be useful for this man who pretended to be dead when a tiger had both his paws on the man's chest.

Yes, that is right. IFS officer Parveen Kaswan recently shared a video of a man lying under a tiger, with their faces extremely close to each other with the caption, "You want to see how does a narrow escape looks like in case of an encounter with a #tiger. #Tiger was cornered by the crowd. But fortunately, the end was fine for both man and tiger. Sent by a senior."

Another Twitter user shared the full 30-second video in the comments. He also said that the incident occured in Tumsar in Bhandara district, Maharashtra. The spine-chilling clip shows a tiger running freely in the fields trying to avoid people who have surrounded him and are trying to shoo him away.

In his quest to run away, the scared tiger grabs a human. When he sees that people are still approaching him and trying to scare him away, he gets up and runs away for his life. All this while, the man who was captured by the animal lays still on the ground and does not make an attempt to get free.

This is what stuck with Twitter and they are praising the man for his presence of mind.

May 14: Customs officials on Wednesday intercepted China-bound consignments of raw material for masks, misdeclared as packing materials for pouches, in large quantities, a senior official said.

It has also seized multiple shipments containing 5.08 lakh masks, 57 litres of sanitiser and 952 PPE kits bound for the US, the UK and the UAE, the official said.

The export of such goods is prohibited by the government in the wake of the COVID-19 pandemic.

"On the basis of specific intelligence, 2,480 kg of raw material for masks was intercepted by air cargo export, Delhi Customs. The goods were misdeclared as packing materials for pouches and were being illegally attempted to be smuggled/ exported to China," he said. 

These goods are prohibited for export as per the latest guidelines issued by the Directorate General of Foreign trade (DGFT), he said, adding that investigation into the case is under progress.

In another catch, the air cargo officers intercepted multiple shipments containing 5.08 lakh masks, 57 litres of sanitiser in 950 bottles and 952 PPE kits at the courier terminal in New Delhi. These were attempted to be smuggled or exported out of the country, the official said.

"These goods are also prohibited for export," he added. 

These items were being illegally exported to the United States, United Kingdom and the United Arab Emirates. "No arrests have been made so far," the official said.
