SC orders CBI probe into Vyapam, as more skeletons tumble out

SCNew Delhi/Bhopal, Jul 9: The Supreme Court today ordered a CBI probe into the massive admission and recruitment scam in Madhya Pradesh as more skeletons tumbled out of the Vyapam cupboard with the death of yet another witness coming to light.

The Supreme Court, while directing CBI to probe all cases of the Vyapam scam and alleged deaths of persons related to it, also and issued notices to the Centre and the state on a plea seeking Governor Ramnaresh Yadav's removal for his alleged involvement in the scandal. The court also issued a notice to the Governor.

Congress had yesterday claimed 49 people associated with the scam had died so far.

The apex court's order transferring all Vyapam-related cases to the CBI came after the state government gave its consent to shifting investigation from the Special Investiation Team (SIT) and the Special Task Force (STF).

A bench headed by Chief Justice H L Dattu said all cases will stand transferred to the CBI from Monday and the agency will file its report before it on July 24.

Before handing over the probe to the CBI, the apex court took on record the submission of Attorney General Mukul Rohatgi, who on behalf of the MP government, said the state has no objection to transferring the investigation in Vyapam and deaths of people allegedly related to it for a free and fair probe.

"The Attorney General (AG) on instruction states that MP govt has no objection whatsoever for transferring the investigation of criminal cases relating to Vyapam scam to the CBI and the cases related to deaths of those allegedly connected with the scam for free and fair probe.

"We appreciate the stand of the AG. In view of the above we transfer investigation of all criminal cases relating to Vyapam scam and death of people allegedly related to it, to CBI," the bench, also comprising Justices Arun Mishra and Amitava Roy, said.

The apex court was hearing a batch of petitions including one filed by senior Congress leader Digvijay Singh seeking CBI probe into all cases arising out of the Vyapam scam.

As the Supreme Court ordered an inquiry by the central agency, reports came from Bhopal of a special court being informed about the death of yet another witness in the scam.

The Special Task Force of MP police, which hitherto investigated the scam, told the court that Sanjay Singh Yadav, aged around 35, died from illness at a private hospital in Bhopal on February 8. According to his family, he was suffering from Hepatitis-B.

The Supreme Court, while issuing notices relating to the Governor that are returnable after four weeks, refrained from making any remarks on him when Kapil Sibal, appearing on behalf of petitioners demanded that Yadav demit office to maintain its dignity.

"We are not going to say anything on it," it said.

The STF had registered a case against Yadav, a former Congressman appointed to the post by the previous UPA government, for favouring some candidates appearing for tests conducted by MP Professional Examination Board (MPPEB), also known as Vyapam. The high court, however, quashed it citing immunity from prosecution he enjoys while in office.

Yadav's son Shailesh, an accused in the case who was alleged to have accepted bribe for rigging Vyapam examination to favour some candidates, was the most high-profile person linked to the scandal to have died in mysterious circumstances. His body was found at his father's lucknow residence in March this year.

As soon as Sibal, appearing for Singh, submitted that it is a matter in which who's who of MP is involved, Attorney General Mukul Rohatgi said the state has already moved the high court for a CBI probe and the matter has been deferred to July 20.

Rohatgi's submission on MP government's stand evoked a quick response from the bench which said, "The High Court wants to wash off its hand."

"On CBI enquiry, instead of doing that, they are now saying that ball is in the Supreme Court," the bench observed.

A beleagured Chouhan, whose credibility has been severely eroded following the scam, hailed the apex court's order, saying,"I welcome it wholeheartedly. There was a burden on my heart."

Speaking to journalists in Bhopal, Chouhan said he would request the CBI to begin investigation at the earliest "so the truth comes before the country, the people, and justice is done".

He rejected Congress' demand for his resignation. "They ask for it (his resignation) 5-6 times a day. To discredit Shivraj Chouhan, they have discredited the whole state. Probity in public life is my capital," he said.

Referring to the probe conducted by the STF and SIT so far, Chouhan said,"It was my test by fire. Had I not wanted, investigation would not have happened. I wanted to set the system right."

Not only Chouhan, political parties of all hues welcomed the decision.

Congress and AAP, while hailing the decision, also demanded that Chouhan step down to facilitate a fair probe.

"The victims have to be given justice. It is very important for the Chief Minister to step down for proper investigation to take place. It would be proper that the Chief Minister resigns as the control of police is with him as of today. If he gets a clean chit, then he can come back," Congress spokesperson Tom Vadakkan said.

"We welcome the Supreme Court decision. We wanted the Supreme Court to monitor the case and we hope it monitors it," he said.

AAP Spokesperson Ashish Khetan said by transferring the investigation to CBI, Supreme Court has expressed "dissatisfaction" with the probe conducted by state agencies.

"Now the Chief Minister is left with no moral authority to continue In his post," he said.

Congress general secretary Digvijay Singh, one of the petitioners in the case, welcomed the apex court's order.

"With this decision, the faith of the country in judiciary has increased. We are thankful to the Supreme Court," he told reporters in Delhi soon after the verdict.

The BJP, however, patted Chouhan on the back for the apex court order.

"BJP wanted a CBI probe, BJP approached the court and the court has accepted it. We welcome it," party spokesman Nalin Kohli said.

Kohli was quick to remind the Congress that an earlier petition filed by Digvijay Singh for a CBI probe had been rejected by the Supreme Court.

New Delhi, Apr 26: The total count of coronavirus cases in the country surged to 26,917 on Sunday.

The total COVID-19 cases in the country are inclusive of 5,913 cured and discharged patients, one migrated, and 826 deaths. At present, there are 20,177 active COVID-19 cases in the country.

The Federation of Resident Doctors' Association (FORDA) wrote to the Union Health Minister, Dr Harsh Vardhan, seeking assistance regarding accommodation facilities for resident doctors advised for home quarantine.

In a letter to the Health Minister, the association stated that recently there have been reports of resident doctors from various hospitals who tested positive for COVID-19. As a consequence, their primary contacts who are mostly their colleagues and resident doctors, have been advised to be on home quarantine, the association added.

On the other hand, Maharashtra continues to have the largest number of COVID-19 positive cases at 7,628 . 1,076 persons have been cured in the state while 323 persons have died.

Fresh cases have been reported several states including West Bengal, Maharashtra, Rajasthan and Uttar Pradesh.

The total number of cases in Indore has risen to 1,176, including 57 deaths.

While 133 deaths have been reported from Gujarat where the total number of cases spiked up to 3,071.

Kerala has seen a recovery rate of around 74 per cent as 338 out of the total 457 COVID-19 positive patients recovered in the state with only 4 fatalities.

Delhi has seen 2,625 COVID-19 positive cases and 54 deaths due to the pandemic.

1. A five-member Central team visited Telangana Director General of Police (DGP) office here on Sunday, to review the law and order situation in the state and oversee how the state police are ensuring the implementation of the lockdown.

2. Post Graduate Institute of Medical Education and Research (PGIMER) Chandigarh and AIIMS Delhi and Bhopal will study the effectiveness of Mycobacterium w in critical COVID-19 patients.

3. Chandigarh-based Post- Graduate Institute of Medical Education and Research (PGIMER) said that it has assessed the safety of mycobacterial w (Mw), an immunomodulator for leprosy, in four hospitalised patients of COVID-19, and has found no short-term adverse effect.

4. As many as 2,189 cases were lodged and 10,062 people have been arrested so far, for the breach of lockdown norms in Uttarakhand.

5. The Delhi High Court has directed that COVID-19 related tests should be made available to the general public at the lowest cost possible as the country is going through an unprecedented medical crisis affecting public order.

6. Bihar government has ordered two automatic RNA extraction machines, said the Principal Secretary of Health, Sanjay Kumar today.

7. Medical services at Babu Jagjivan Ram Hospital in the Jahangirpuri area have been closed and the hospital is being sanitised after 44 staff members including doctors were tested positive for COVID-19, Delhi Health Department said.

8. In order to support the frontline workers in the fight against COVID-19, Samsung and Google will be offering free phone repairs to health care workers and first responders.

9. Bhopal Division of Indian Railways has converted 74 railways coaches into isolation wards, said Sunil Dhingra, Senior Section Engineer of Bhopal Division.

10. Indian High Commission here on Sunday said two Air India and one Blue Dart flights will send about 78 tonnes of cargo to India as part of the 1 million PPE kits being sourced from Singapore-based company.

New Delhi, May 6: Around 39 crore people have received financial assistance of Rs 34,800 crore amid the COVID-19 lockdown under the Pradhan Mantri Garib Kalyan Package (PMGKP) as on May 5, the government said in a statement.

These people received the assistance, which was announced by Union Finance Minister Nirmala Sitharaman on March 26 to protect them from the impact of the lockdown due to COVID 19, via digital payment infrastructure.

The swift implementation of the free food grain and cash payment package under PMGKP is being continuously monitored by Central and state governments. Also, Fintech and digital technology have been employed for swift and efficient transfer to the beneficiary.

As per the data provided by the government, Rs 16,394 crore front-loaded towards payment of the first installment of PM-KISAN was provided to 8.19 crore beneficiaries.

Rs 10,025 crore credited to 20.05 crore (98.33 per cent) women Jan Dhan account holders as first installment and Rs 2,785 crore credited to 5.57 crore women in the second installment.

Further, Rs 1,405 crore was disbursed to about 2.82 crore old age persons, widows and disabled persons and Rs 3,492.57 crore financial support was given to 2.20 crore building and construction workers.

Moreover, foodgrain has been distributed, covering 60.33 crore beneficiaries in all 36 Union Territories and states till April and 12.39 crore beneficiaries by 22 states/UTs for May. Pulses have been distributed so far to 5.21 crore household beneficiaries out of 19.4 crore such beneficiaries.

Over 5 crore cylinders have been booked under the Pradhan Mantri Ujjwala Yojana (PMUY) and 4.82 crore free cylinders already delivered to beneficiaries.

While 9.6 lakh members of Employees' Provident Fund Organisation (EPFO) has taken benefit of online withdrawal of non-refundable advance from EPFO account amounting to Rs 2,985 crore, 24 per cent EPF contribution transferred to 44.97 lakh employees account amounting to Rs 698 crore.

In the current financial year, 5.97 crore person's man-days of work generated under MNREGA scheme and Rs 21,032 crore were released to states to liquidate pending dues of both wage and material.

Insurance scheme for health workers in government hospitals and health care centres has been operationalised by New India Assurance covering 22.12 lakh health workers.

Srinagar, Apr 4: Two militants were reportedly killed in an encounter with security forces in Kulgam district of Jammu and Kashmir on Saturday, police said.

The security forces launched a cordon and search operation based on intelligence inputs about the presence of militants in Hardmand Guri village in Kulgam, a police spokesperson said.

"This operation based on a credible police input was launched this morning. Two terrorists have been reportedly killed so far," the spokesperson said, adding that the exchange of fire was going on.

Earlier, the police tweeted on its official handle that three militants had been trapped in the cordon. "Same group of #terrorists trapped who killed 3 civilians recently," the police said.
