SC refuses urgent hearing on plea over restrictions in J&K

New Delhi, Aug 8: The Supreme Court on Thursday refused to grant an immediate hearing on a plea for directions to the Centre to withdraw restrictions on people's movement, unblocking of internet service, the release of political leaders and appointment of a judicial commission to assess the ground situation in Jammu and Kashmir.

A bench of Justices N V Ramana and Ajay Rastogi said the PIL filed by activist Tehseen Poonawalla would be placed before the Chief Justice of India for appropriate orders.

An advocate, appearing for Poonawalla, mentioned the matter for urgent hearing. He said at least there should be a direction to allow the people over there and outside to develop contacts through telephones.

Separately, advocate M L Sharma, who challenged the validity of August 5, 2019, Presidential Order, also mentioned his PIL for urgent hearing. The bench said the matter will come up for hearing in the regular course if there were no technical defects.

Sharma, who filed the PIL in his own name, insisted by contending that they were saying to take the matter to the UN.

"Even if they go to the UN, can it stop Parliament from passing Constitutional amendment," the bench asked.

Sharma said the Presidential order of August 5 had superseded the 1954 order and took away the special status granted to Jammu and Kashmir. He contended that the amendment could have been passed by Parliament.

In his PIL, Poonawalla said it was unfortunate that the entire state of J&K, was under a virtual cordon. There has been no news of any kind of protest; be it organized or otherwise in reference to the constitutional amendments or for any other reason.

"Arrest of separatist leaders is totally justifiable but meeting out the same treatment and arresting mainstream political leaders who have fought for the integration of J&K into the Union of India is highly questionable," he said.

He said the local inhabitants are facing difficulties in accessing basic day to day necessities particularly patients, children, women and infants who have literally been arrested in their own houses for no rhyme or reason.

He also contended that the political leaders of J&K including former Chief Ministers, former Union Ministers, former Legislators and political activists were arbitrarily under arrest and were being denied of their basic fundamental rights.

The Jamaat-e-Islami Hind (JIH) has urged Muslims to take precautions during Eid ul-Adha (Bakrid), to be celebrated in the last week of July, and has issued guidelines on offering prayers and sacrifices.

"The namaz should be offered by adhering to the social distancing norms at eidgahs and mosques. Muslims should offer the Eid prayer at home in the same manner as they had done during Eid ul-Fitr in areas where restrictions have been imposed due to COVID-19," it said.

For the sacrifice of animals, a part of the festival, the JIH said "precautionary" measures should be taken due to the pandemic.

"Don't offer qurbani on roads, footpaths and pathways. Ensure the highest level of cleanliness and hygiene. Ensure that you bury the blood and entrails of the animal after qurbani or deliver it at the designated spot of garbage collection," the JIH said in a statement.

The JIH said it would be appropriate to form a committee few days before the Eid ul-Adha, which would keep an eye on the situation, remain in touch with the local administration and offer cooperation towards maintaining the law and order in the area.

Stockholm, Jan 4: “I’m not the kind of person who celebrates birthdays,” Greta Thunberg said as she turned 17 on Friday, marking the occasion in inimitable style - with a seven-hour hour protest outside the Swedish parliament.

The climate activist braved winter conditions in her native Stockholm to continue the weekly Friday School Strike for the Climate campaign that helped catapult her to international fame.

“I stand here striking from 8am until 3pm as usual ... then I’ll go home,” Thunberg, Time magazine’s Person of the Year for 2019, told Reuters.

“I won’t have a birthday cake but we’ll have a dinner.”

It’s been a busy 12 months for Thunberg, who crisscrossed the globe by car, train and boat - but not plane - to demand action on climate change.

“It has been a strange and busy year, but also a great one because I have found something I want to do with my life and what I am doing is having an impact,” she said.

When she was 15, Thunberg began skipping school on Fridays to demonstrate outside the Swedish parliament to push her government to curb carbon emissions. Her campaign gave rise to a grassroots movement that has gone global, inspiring millions of people to take action.

Mar 11: Thirteen of the 22 rebel MLAs in Madhya Pradesh have given an assurance that "they are not leaving the Congress", senior party leader Digvijaya Singh said on Thursday while expressing confidence that the Kamal Nath-led government in the state will win a floor test.

"We are not keeping quiet. We are not sleeping," Singh told PTI, a day after Congress leader from the state Jyotiraditya Scindia quit the Congress and 22 MLAs submitted their resignations from the assembly in Madhya Pradesh.

Scindia was offered the post of Madhya Pradesh deputy chief minister but wanted his nominee, Singh said. However, Kamal Nath refused to accept a "chela", he said.

Scindia, he said, could have been a Congress nominee to the Rajya Sabha but "only Modi-Shah" can give a Cabinet post to the "over-ambitious" leader.
