SC to study if graft cases can be stayed on writ pleas

New Delhi, Aug 9: The Supreme Court on Tuesday put for final consideration before a three-judge bench a question of the law raised by Energy Minister D K Shivakumar and others. The issue is if high courts can stay proceedings initiated under the Prevention of Corruption Act despite a statutory bar.

A three-judge bench presided over by Chief Justice J S Khehar gave time to senior advocate Mukul Rohatgi and K V Vishwanathan and others for preparing the arguments. The court has scheduled the hearing for August 29.

Around 40 separate petitions, including by Shivakumar, have been pending since 2013. These petitions have sought interpretation of Section 19(3)(c) of the Prevention of Corruption Act.

The provision states that no court shall stay the proceedings under this Act on any ground nor should exercise the power of revision in relation to any interlocutory order passed in any inquiry, trial, appeal or other proceedings. Solicitor General Ranjit Kumar sought early hearing in view of several matters pending for consideration.

Issues for consideration

Among the issues for consideration is if the high court can entertain petitions under Article 226 (writ jurisdiction) of the Constitution and under Section 482 (inherent power) of the Criminal Procedure Code and stay the proceedings in corruption cases.

The question for adjudication is whether framing of charges is an interlocutory order or not, and if it is open to revision by the high court. The matter against Shivakumar pertains to his purchase of four acres and 20 guntas of land in Bengaluru for Rs 1.62 crore in 2003.

Change in land use

A complaint was filed in March 2012, alleging that the land use was changed from industrial to residential in 2004 and the land was denotified from acquisition in 2010 allegedly in violation of laws.

The Lokayukta court took cognisance of the offence in July 2012. The High Court of Karnataka initially stayed the proceedings but vacated the interim order in April 2013. On a special leave petition filed by Shivakumar, the apex court stayed the proceedings in view of pendency of the larger question of the law.

Bengaluru, Jul 30: Karnataka reported 83 deaths and 6,128 new cases in the state on Thursday. With this, the total number of cases in the state stood at 1,18,632, the state health ministry said.

Currently, there are 69,700 active cases, while a total of 2,230 people have lost their lives due to the pandemic till now.

There are 15,83,792 confirmed cases across the country. Of them, 5,28,242 cases remain active. While 10,20,582 have recovered, 34,968 patients have lost their lives due to the pandemic.

Dubai, May 3: Over 150,000 Indians in the UAE, who wish to return home amid the coronavirus lockdown, have applied through the online registration process to the Indian missions here, according to media reports.

The Indian missions in the country last week opened online registration for the expatriates who wish to fly back home after getting stuck in the country amidst the lockdown due to the coronavirus pandemic.

As of 6 pm on Saturday, we received more than 150,000 registrations, Consul General of India in Dubai Vipul told the Gulf News on Saturday.

A quarter of them want to return to their homeland after losing their jobs, he said.

According to a report in the Khaleej Times on Sunday, about 40 per cent of the applicants who have registered are blue-collared workers and 20 per cent are working professionals.

"Roughly 20 per cent have suffered job losses and about 55 per cent of the total applicants are from Kerala," Neeraj Aggarwal, Consul, Press, Information, Culture was quoted as saying in the report.

Aggarwal said that the figures would change as they are expecting registrations from workers from other states, including Telangana, Uttar Pradesh, and Bihar.

About 10 per cent of the applicants are visit and tourist visa holders who got stranded here due to the ongoing lockdown in India.

India extended the ongoing lockdown by two weeks from May 4 to contain the spread of the coronavirus that has affected nearly 40,000 people in the country.

Aggarwal said that a small number of the applications constitute those from pregnant women and other medical cases.

Since the online registration process was launched, the Consulate's website crashed several times due to the heavy rush of applicants wishing to register to fly back home.

The site has been working fine now though it took a lot of time for it to stabilise in the initial phase due to the heavy traffic, the counsel general said.

He said that the missions here have not yet received any information from the Indian government about the mode of transport of the stranded citizens, the prices of the tickets or how the COVID-19 test results of applicants would be assessed for their journey.

There are high-level discussions going on regarding these things, he said in the report.

Meanwhile, Norka (The Non Resident Keralites Affairs) said it has received a total of 398,000 applications from Keralites across the globe who wish to return home.

"Of which, the highest numbers are from the UAE. At least 175,423 applicants have signed up from the UAE," Norka said in an official statement on Saturday.

It also received 54,305 registrations from Saudi Arabia, 2,437 from the UK, 2,255 from the US, and 1,958 from Ukraine from those who wish to return to India, the Khaleej Times reported.

The coronavirus has infected 13,599 people and claimed 119 lives in the UAE, the Ministry of Health and Prevention said on Saturday.

Mangaluru, July 31: Coronavirus related deaths in Dakshina Kannada continued to surge, with the district administration recording five more fatalities in a day, thus taking the tally to 155.

The district has recorded multiple deaths every day from July 1 to 31. A majority of the deaths are due to comorbid conditions.

Among the five deaths reported today, a 47-year-old man from Mangaluru, was admitted to private hospital on July 30, and breathed his last on the same day. He was suffering from ARDS, Type 1 respiratory failure, COPD, Type II DM, HTN and died due to cardiac arrest.

Another patient was a 75-year-old man from Bantwal, who was admitted to a private hospital on July 23, and passed away on July 30. He was suffering from acute coronary syndrome, pneumonia (ARDS), metabolic encephalopathy, acute kidney injury, systemic hypertension, and type 2 diabetes mellitus.

The third patient was a 63-year-old man from Mangaluru, who was admitted to a private hospital on July 18, and passed away on July 30. He was suffering from ARDS, septic shock, renal failure, and secondary bacterial infection.

The fourth patient was an 88-year-old woman from Davanagere, who was admitted to a private hospital on July 9, and passed away on July 30. She was suffering from septic shock, and secondary bacterial infection.

The fifth patient was a 75-year-old man from Mangaluru. He was admitted to Wenlock hospital on July 15, and passed away on July 30. He was suffering from refractory ARDS, septic shock, renal failure, acute coronary event, arrhythmias, pulmonary thromboembolism, and hemoperitoneum.

The district administration said that though the above patients contracted coronavirus, the exact cause of their deaths is being investigated by a team of experts and their report is awaited.

On the other hand, Dakshina Kannada district recorded a total of 204 fresh cases, taking the tally to 5,713. Among the 204 new cases are 75 primary contacts, 63 with influenza-like illness (ILI), and 14 with severe acute respiratory illness (SARI). As many as 52 cases are under investigation. As many as 70 patients were discharged on Friday from Wenlock as well as private hospitals.

As per the district health bulletin, a total of 40,706 samples have been tested so far and 34,993 out of them have tested negative. Among the 5,713 positive cases reported in the district, only 2,929 are currently active. As many as 2,631 persons have recovered and been discharged.
