Served non-veg to Jain man, airlines asked to pay Rs 20K compensation

August 24, 2016

New Delhi, Aug 24: The apex consumer commission directed Swiss International Airlines to pay a compensation of Rs 20,000 to a flyer and upgrade his economy class ticket to business class for his future travels, as a penalty for serving him non-vegetarian food instead of a Jain meal he had opted for.

swissThe National Consumer Disputes Redressal Commission (NCDRC) upheld the district forum's order also directing Swiss International Airlines, to pay Rs 10,000 towards litigation cost and dismissed the revision petition filed by Mumbai resident Amit Jay Kumar Jain to enhance the compensation.

“The opposite party (airlines) shall be bound by its commitment to upgrade economy class to business class in one flight booked by the complainant from India to Europe or Europe to India with a rider that the complainant must undertake that flight within one year,” the bench presided by Justice Ajit Bharihoke said.

The bench, which also comprised member S M Kantikar, noted that the complainant was alerted by a co-passenger before he could eat the non-vegetarian food served to him.

“It cannot be said with certainty that the complainant consumed a morsel of non-vegetarian food. Thus, under the circumstances, the compensation awarded to the complainant seem to be reasonable and there is no cause for interfering with it,” the bench added.

According to the complaint, on May 6, 2011, while flying from Zurich to Mumbai, Jain was served with a non-vegetarian meal whereas he had opted for a special vegetarian Jain meal.

When he approached the district forum in Mumbai, the airline said the mistake was human error and offered that in future any one economy class ticket booked by the complainant from India to Europe or from Europe to India would be upgraded to business class and an apology was also tendered in writing.

The forum had also granted a compensation of Rs 20,000 and Rs 10,000 as cost towards the litigation to Jain.

Jain's appeal for enhancing the compensation was rejected by the state commission after which he approached NCDRC.

Bengaluru, Mar 6: The Karnataka Congress on Thursday termed the budget for fiscal 2020-21 presented by the B.S. Yediyurappa government as the "weakest ever state budget".

"This is the weakest budget ever that our state has had. There is no clear cut provision in the budget for industrial growth or to generate jobs. No clarity on department wise allocation," tweeted Congress.

Congress leader Dinesh Gundu Rao said he did not expect such a bad budget which has discriminated on agriculture and education sectors.

"The state budget does not mention major irrigation projects like Kaveri valley and Krishna. No farmers loan waiver," noted Rao.

The opposition party has criticised the ruling Bharatiya Janata Party (BJP) that the potential of Karnataka was not realized to generate revenue through this budget.

Assailing the additional tax on petrol and diesel, Congress said the development will lead to price rise and is a huge disappointment.

"People are reeling under high inflation and reduction in income. BJP has rubbed salt into injury by further increasing prices and providing no relief to common man," said the party.

Bhalki MLA and Karnataka Pradesh Congress Committee working president Eshwar Bhimanna Khandre pointed out that the Centre gave the state only Rs 1,869 crore, despite a loss of Rs 35,160 crore in 2019.

Calling stamp duty reduction for housing within Rs 20 lakhs as an insult to people, Congress questioned the Chief Minister and BJP to first show where in Bengaluru does one get housing within Rs 20 lakh.

"This is mockery of people. No mention or allotment to universal housing programme that Congress government had delivered," claimed Congress.

Focusing on Karnataka capital Bengaluru, Congress slammed the BJP saying no proper revenue policy has been mooted.

"Last mile connectivity issue not addressed. Drinking water issue is not mentioned. No mention of peripheral ring road. No mention of Akrama-Sakrama and no thought process has gone in while planning Bengaluru," tweeted the party.

The party said Yediyurappa has admitted that there is a financial crisis in his budget speech.

"He admits Rs 8,883 crore aid has been cut, around Rs 11,000 crore state share from Centre has been cut. No additional allocation for flood relief. What is stopping him and 25 members of Parliament to question the centre," observed Congress.

Former chief minister Siddaramaiah mocked Yediyurappa that though he calls himself a farmer''s son, he delivered an anti-farmer budget.

"No one will benefit from this budget. A complete failure to boost the economy, to realize inclusive development and to improve standard of living," he tweeted.

Bengaluru, Mar 19: Karnataka High Court on Wednesday rejected the plea by Congress leader Digvijay Singh seeking directions to the police to allow him to meet rebel Madhya Pradesh Congress MLAs who are lodged in Bengaluru.

Earlier in the day, Singh said at a press conference, "I have filed a plea in the Karnataka High Court, seeking permission to meet Madhya Pradesh Congress MLAs who are putting up at Bengaluru. I have decided to be on fast and shall take a call on that after the decision of the Supreme Court and the High Court," Singh said at a press conference here earlier.

Singh said, "The BJP is busy in toppling duly-elected governments. We had successfully thwarted their plans to destabilise the MP government but we were let down by Jyotiraditya Scindia who had a very successful career in Congress."

"We never expected that he would ditch us and join hands with the BJP," he added.

The Congress leader also said that the BJP government had become insecure since the Kamal Nath-led government started tightening the laws on mining.

"Chief Minister Kamal Nath drafted a new mining policy for the sand under which the mines were allotted through auction. All this was unpalatable to the BJP and from Day 1 they started offering money to our Congress legislators," he said.

"In BJP, the Atal Bihari Vajpayee's kind of leadership no longer exists. The leadership which controls the BJP now includes people who have joined hands to do all kinds of unscrupulous things which has led to a stage in India where the banks are collapsing, non-performing assets and unemployment are growing," he added.

Earlier today, he was put under preventive arrest after he sat on a dharna near Ramada Hotel here allegedly for not being allowed to meet the 21 rebel Congress MLAs lodged in the hotel.
