Setback for Modi govt, SC restores Cong Govt in Arunachal

CongArunachal Pradesh, Jul 13: The Supreme Court on Wednesday said the Arunachal Pradesh Governor’s decision advancing Assembly session by a month was violative of the Constitution and liable to be quashed and directed status quo ante in the State as it prevailed on December 15, 2015.

The Court said the Governor’s direction on conducting Assembly proceedings was violative of the Constitution.

The court said all steps and decision taken by the Legislative Assembly pursuant to Governor’s December 9, 2015 order are unsustainable and liable to be set aside.

All the five judges of the constitution bench headed by Justice J.S. Khehar were unanimous in setting aside the orders of Governor Jyoti Prasad Rajkhowa.

A bech had reserved its judgement on February 22, 2016.

The apex court had said the verdict in this case will not only have its effect on Arunachal Pradesh, but affect every State.

On February 20, rebel Congress leader Kalikho Pul was sworn in as the ninth Chief Minister of Arunachal Pradesh with the support of 18 dissident Congress MLAs and two independents and 11 BJP MLAs who gave outside support.

On the day the verdict was reserved, the bench had refused to pass an interim order on a fervent plea of Congress against the “illegal” swearing-in of the Pul-led government and had said that it can “set the clock back” if the Governor’s actions are found unconstitutional.

The Congress, which had 47 MLAs seats in the 60-member Assembly, suffered a jolt when 21 of its lawmakers rebelled.

Eleven BJP MLAs backed the rebels in the bid to upstage the government. Later, 14 rebel Congress MLAs were disqualified.

Hours after the Union Cabinet had decided to recommend revocation of President’s Rule in Arunachal Pradesh, the apex court had on February 17, 2016 ordered maintenance of status quo in the State till it examined judicial and Assembly records on disqualification of the 14 rebel Congress MLAs by former Speaker Nabam Rebia.

On February 16, the court had also refused to pass an interim order on a plea of Congress leaders that the Arunchal Pradesh Governor be restrained from swearing in a new government.

New Delhi, Mar 2: The Supreme Court on Monday dismissed a curative petition filed by convict Pawan Kumar Gupta who was sentenced to death in the 2012 Nirbhaya gang rape and murder case.

A five-judge bench headed by Justice N V Ramana said that no case is made out for re-examining the conviction and the punishment of the convict.

Other members of the bench were justices Arun Mishra, R F Nariman, R Banumathi and Ashok Bhushan.

New Delhi, Feb 11: With Election Commission">Election Commission's trends indicating a landslide victory for the Aam Aadmi Party (AAP), party chief Arvind Kejriwal expressed his gratitude towards the people of the national capital and said that this is the victory of the people who consider him as their son.

Making his first public appearance after the day's results, Kejriwal made a brief address to supporters in which, AAP chief thanked supporters, outlined his personal connection with citizens and party workers as well as credited his family for their continued support.

"I thank people of Delhi for reposing their faith in AAP for the third time. This is not my personal victory, this is the victory of Delhiites. This the victory of the people who consider me as their son and voted for us," Kejriwal said at party office here.

He also referred to the trends of the assembly polls, as the beginning of a new kind of politics.

"This is the beginning of a new kind of politics. This is a new sign. Only the party will get vote who will built mohalla clinics and good schools... This is the victory of mother India and India. Today is Tuesday, Hanuman-ji's day. Hanumanji ji blessed Delhi today, I thank him. We pray that Hanuman Ji keeps showing the right path to us so that we continue to serve people for the next five years," he said.

According to Election Commission", AAP won 5 seats while the party is leading on 58 seats in 70-member Delhi Assembly.

New Delhi, Apr 9: Kerala opposition coalition United Democratic Front on Thursday submitted a roadmap to Prime Minister Narendra Modi for staggered lifting of ongoing lockdown due to COVID-19 pandemic.

The coalition led by leader of opposition Ramesh Chennithala has given a set of recommendations to Modi in this regard, which include those made by an expert committee headed by deputy leader of opposition M K Muneer.

The committee was set up to suggest measures to be taken by the government for smooth transition from lockdown to normalcy.

It listed an eight-point exit strategy for removing lockdown in a staggered approach at a district level, with emphasis on hotspots to avoid further spread of virus and ensure smooth restart of economy.

This approach is tuned to the unique needs of each district and all the districts should also be categorised as per their risk levels, the report said.

The report has also been submitted to chief ministers of all states, former prime minister Manmohan Singh, Congress president Sonia Gandhi, senior Congress leader Rahul Gandhi among others.

The committee recommended that COVID-19 rapid testing must be enhanced across the country and the testing target be widened to 500 tests per one lakh population.

"A step-by-step approach is necessary for each sector along with conditions that need to be considered for each sector," the report said.

"There is a need for a comprehensive economic stimulus package in addition to the ones already announced after considering all the industries," it added.
