Sexuality Is Not Free Speech, Says Arun Jaitley On Section 377 Verdict

New Delhi, Oct 7: Finance Minister Arun Jaitley on Saturday said he did not agree with the portion of the historic Supreme Court judgment decriminalising consensual gay sex that called sexuality a part of free speech, as he felt it raises questions on restraining any form of homosexual or bisexual activity in a school hostel, prison or army frontier.

He also differed on a portion of the top court ruling on adultery, saying it may end up converting the Indian family system into a Western family system.

On the Supreme Court allowing women's entry into the Sabarimala shrine, he said such a ruling cannot happen on select practices as it may have many social consequences.

Speaking at the HT Leadership Summit, Mr Jaitley said the judgment decriminalising gay sex was fine but "the problem comes when writing these historical judgements, you get carried away and want to be part of history and therefore you go a step further".

He said he fairly agreed with the reasoning given by the court in the judgement that sexual activity is part of Article 21 of the Constitution that guarantees right of life and that no discrimination on the basis of sex should be there, but added that he completely disagrees with the reasoning that sexual activity is part of free speech.

"Because I think that's little excessive and consequences of that may not be on decriminalisation. Free speech is entirely a different gambit, it can be restrained on the reasons of sovereignty, security, public order and so on and mind you there is tendency of creating new fundamental rights everyday.

"So when you convert this into a fundamental right and say its free speech then how do you restrain any form of sexual activity, homosexual or bisexual in a school hostel, prison, army frontier," he said.

Stating that this requires further debate, Mr Jaitley said this reasoning was not necessary for deciding the case of Section 377 which decriminalised gay sex.

On the Supreme Court ruling on adultery, he said some of the judges said these are matrimonial offences and personal wrongs and not public wrongs.

"So therefore it is outside the purview of criminal law. Would that cover bigamy or polygamy also which are personal wrong? Would that cover cruelty? Would that cover dowry offences? Now this logic covering them, then it would be a wholly anti-women judgement," he said.

He said he was not in dispute that the "very badly worded section" on adultery needed to be quashed but "the later view may find a reference in some western journals very favourably but it may end up converting Indian family system into Western family system where the fragility of marriage as an institution itself will increase.

"Therefore you probably require to debate the second part of the observation which again was not necessary for deciding this case."

On the Sabarimala ruling, Mr Jaitley said if you want to take a progressive step, then Articles 14 and 21 will apply against all religions.

"It can't happen that you select a practice and apply it because that will have many many social consequences in pluralist society like India. If you start stepping into the religious practices and customs and say (Article) 14 must be tested on... personal law and (Article) 14 must be tested in Article 21, then will it apply to polygamy? Will it apply to oral divorces? Will it apply to other religions where ladies are not allowed to enter religious places?

"If you have a selective practice and then you use an argument to say well we will decide this issue in some other case every time it arises. If you are being progressive and bold then it must be uniformly so and that does not seem to be happening....if you are willing to proclaim you must be willing to strike," he said.

New Delhi, Feb 19: The UIDAI on Tuesday said its Hyderabad office has sent notices to 127 people for allegedly obtaining Aadhaar numbers on "false pretences" but asserted these have nothing to do with citizenship.

The notices were issued after reports from the police, the Unique Identification Authority of India (UIDAI) said.

"Aadhaar is not a document of citizenship and UIDAI has been mandated under the Aadhaar Act to ascertain residency of a person in India for 182 days prior to applying for Aadhaar," the nodal body, which issues the 12-digit biometric ID, said in a statement.

The Supreme Court, in its landmark decision, has directed the UIDAI not to issue Aadhaar to illegal immigrants, it said.

"It may be noted that the regional office Hyderabad received reports from the state police that 127 people have obtained Aadhaar on false pretences, as in their preliminary enquiry they were found illegal immigrants who were not qualified to obtain an Aadhaar number," the UIDAI said.

As per the Aadhaar Act, such Aadhaar numbers are liable to be cancelled.

"Therefore, the regional office Hyderabad has sent notices to them to appear in person and to substantiate their claims for getting an Aadhaar number," it said.

The UIDAI emphasised that these notices have "nothing to do with citizenship and cancellation of Aadhaar number is in no way related to the nationality of any resident".

In case it is found and proved that any of them obtained Aadhaar by submitting false documents or through false pretences, their Aadhaar is liable to be cancelled or suspended depending on the severity of the transgression, UIDAI said.

"Severe errors like forged documents, etc., will lead to appropriate actions, including suspending /cancelling the Aadhaar," it cautioned.

"Sometimes it becomes necessary to cancel the Aadhaar number when it is found that a resident has obtained it by submitting false biometrics or documents. It is a routine quality improvement process that the UIDAI takes up regularly," the authority said.

The 127 people have been asked to appear before the UIDAI deputy director in Hyderabad for a personal hearing on February 20.

Additional time has been given to allow them to collect the requisite documents, "Since it may take them some more time to collect the original documents that they had submitted for obtaining Aadhaar, as informed by the state police, the UIDAI has postponed the personal hearing to May 2020," it added.

Srinagar, May 21: Two Border Security Force (BSF) personnel were killed and their weapons snatched by militants in the Pandach area on the outskirts of Srinagar yesterday.

According to IGP Kashmir Vijay Kumar, the two BSF jawans, who were on road surveillance deployment, were fired upon by two of the three terrorists on a motorcycle around 5:15 pm on the 90-Ft Road at Pandach, near Soura. 

They were critically injured and later succumbed to injuries. The terrorists escaped after taking away one AK rifle and one INSAS. Efforts were underway to trace the terrorists.

He said that two jawans, Constable Rana Mandol and Constable Ziaul Haque of ‘C’ company of 37th battalion, were injured and they later succumbed.

“The terrorists managed to take away the weapons of the martyrs. Area has been cordoned off and the search for the terrorists is on”, he said.

Residents around the spot said that the two soldiers were buying chicken for Iftar from a mutton dealer, around 300 meters away from their deployment location when three militants on a motorcycle stopped and opened fire on them.

Medical Superintendent SKIMS Dr Farooq Jan said that both the jawans were brought dead to the tertiary care hospital.

Senior Police officials said it was a “clear case of security lapse” as the two jawans had left their spot of deployment on Srinagar-Kargil-Leh road and gone to a shop 500 metres away on a different road.

They said that possibility of terror attacks and subsequently claims by the new outfit TRF had been flashed to all forces earlier this week.

The terror strike in the capital city has occurred a day after an encounter in downtown Srinagar, where two Hizbul Mujahideen militants, including the top wanted Junaid Sehrai, had been killed on Tuesday.

In the last one month, five Army and Police personnel and two militants had got killed in an encounter in Handwara area of Kupwara, a day before three CRPF men were killed in another attack.

New Delhi, Apr 11: With 40 deaths and 1,035 new COVID-19 cases in the last 24 hours, India on Saturday witnessed a sharpest ever increase in coronavirus cases, taking the tally of the infected people in the country to 7,447, as per the Ministry of Health and Family Welfare on Saturday.

According to the official data, among 7447 COVID-19 positive cases, 6,565 are active cases and 643 are cured, discharged and migrated and 239 patients who have succumbed to the virus.

Maharashtra has reported the highest number of cases in the country which stands at 1,574, including 188 cured and discharged and 110 deaths, followed by Tamil Nadu with 911 corona positive cases.

On the other hand, the national capital has reported 903 cases, which include 25 recovered cases and 13 deaths.

While 553 have detected positive for the infection in Rajasthan, Telangana has 473 corona cases and Chhattisgarh and Chandigarh have reported 18 cases each.

Uttar Pradesh and Haryana, that borders the national capital, has 431 and 177 cases, respectively.
Kerala, which reported India's first coronavirus case, has 364 confirmed cases.

The newly carved union territories -- Ladakh and Jammu and Kashmir--- have 15 and 207 cases, respectively.

The least number of COVID-19 cases have reported from the northeast region of the country. While Arunachal Pradesh, Mizoram, and Tripura have only 1 corona positive case, Assam has 29 people infected with the virus, which is the highest in the region.
