Sunanda Pushkar death: Tharoor moves court for anticipatory bail

New Delhi, Jul 3: Congress leader Shashi Tharoor today moved a Delhi court seeking anticipatory bail in the case related to the death of his wife Sunanda Pushkar. 

Tharoor has already been summoned as an accused in the case. 

The politician's plea was filed before Special Judge Arvind Kumar who sought Delhi Police's response and kept it for hearing tomorrow.

Tharoor was earlier summoned as an accused by a magisterial court for the alleged offences of abetment of suicide and committing cruelty towards Pushkar.

In his plea filed through advocate Vikas Pahwa, Tharoor said the charge sheet has been filed without arrest and the SIT (special investigation team) has categorically stated that investigation has been concluded and no custodial interrogation is required. 

"The law is very clear that if the charge sheet is filed without arrest the bail is inevitable. We have only requested for protection so that we appear in the court on July 7," Pahwa said.

The matter will be heard tomorrow at 10 am as the prosecutor was not present in court today, he said. 

On June 5, a court summoned Tharoor as accused, asking him to appear before it on July 7 and saying there were sufficient grounds to proceed against him. 

Pushkar was found dead in a luxury hotel room on the night of January 17, 2014.

Tharoor has been charged under Sections 498 A (husband or his relative subjecting a woman to cruelty) and 306 (abetment of suicide) of the Indian Penal Code. 

After a magisterial court had taken cognisance of the offences against Tharoor, his counsel had termed the prosecution's case "absurd and preposterous".

On May 14, Delhi Police accused Tharoor, Lok Sabha MP from Thiruvananthapuram, of abetting Pushkar's suicide and told a city court that he should be summoned as an accused in the four-and-half year-old case, claiming there was sufficient evidence against him.

In a nearly 3,000-page charge sheet, police named Tharoor as the only accused while also alleging that he had subjected his wife to cruelty. 

The couple's domestic servant, Narayan Singh, has been named one of the key witnesses in the case.

Under Section 498A, the maximum punishment is up to three years of imprisonment, while jail term up to 10 years is prescribed under Section 306.

An FIR was registered by Delhi Police on January 1, 2015 against unknown persons under IPC section 302 (murder).

According to prosecution sources, the charge sheet mentions that Pushkar was allegedly subjected to mental as well as physical cruelty. 

Tharoor has not been arrested in the case.

On July 7, the court is also likely to hear BJP leader Subramanian Swamy's application seeking its nod to allow him to assist the prosecution in the case and a direction to the police to produce the report of a vigilance inquiry conducted earlier in the matter.

Mumbai, May 27: The Maharashtra government on Tuesday ordered re investigation by the CID into the suicide of a 53-year-old interior designer and his mother, allegedly over non-payment of dues by TV journalist Arnab Goswami and two others.

State Home Minister Anil Deshmukh said he ordered re investigation after Adnya Naik, daughter of interior designer Anvay Naik, claimed that Alibag Police in neighbouring Raigad district did not probe the non-payment of dues which had driven her father and grandmother to suicide.

"Adnya Naik had complained to me that #AlibaugPolice had not investigated non-payment of dues from #ArnabGoswami's @republic which drove her entrepreneur father & grandmom to suicide in May 2018," Deshmukh tweeted.

"I've ordered a CID re-investigation of the case," the minister, an NCP leader, added.

He also used the hashtag "Maharashtra government cares" while sharing the tweet. Earlier this month, the police registered an abetment of suicide case against Republic TV editor-in-chief Goswami and two others.

The suicide note purportedly written by Anvay Naik, managing director of Concorde Designs Private Limited, said he was forced to take his life as he was not paid dues of Rs 5.40 crore by the three accused.

Republic TV denied the allegation and said that certain vested interest groups were running "a false and malicious campaign and making false statements and innuendos against the company by exploiting the tragic event".

Mumbai Police are also conducting a probe against Goswami over his statements about the Palghar lynching case of April this year.

New Delhi, Feb 26: Calling the recent violence in Delhi as 'planned conspiracy', Sonia Gandhi on Wednesday demanded Union Home Minister Amit Shah's resignation over the clashes that left 20 people dead in two days.

"CWC (Congress Working Committee) believes Home Minister and Centre is responsible. The Home Minister should tender his resignation with immediate effect," the Congress party's interim chief told reporters here.

Violent clashes erupted between pro and anti-CAA groups in parts of northeast Delhi on Monday, leading to widespread vandalism and arson for over two days.

While many blamed police for inaction to control the mobs, Union Home Minister Amit Shah met the top brass of Delhi Police, Chief Minister Arvind Kejriwal, LG Anil Baijal and directed the officials to control the situation.

Gandhi blamed both the Central and the Delhi governments, saying the administration did not take adequate steps on time to curb violence in the national capital.

"Chief Minister Arvind Kejriwal and Center is equally responsible for not activating the administration to reach out to the people to maintain peace and harmony," Sonia added.

The death toll in the violence rose to 20 on Wednesday, according to GTB hospital authorities.

Government sources told ANI that the National Security Advisor (NSA) Ajit Doval has been given the charge of bringing normalcy in the capital.

Sources also said that Doval will brief Prime Minister Narendra Modi and the Cabinet about the prevailing situation.

The NSA last night visited Jaffrabad, Seelampur and other parts of northeast Delhi where he held talks with leaders of different communities.

Without naming any leader, the Congress interim president also targeted the leaders of the Bharatiya Janata Party for making inflammatory statements saying that "there is a conspiracy behind the violence, country also saw this during Delhi elections. Many BJP leaders made inciting comments creating an atmosphere of fear and hatred."

Perambalur, Jan 2: Veteran Tamil writer Nellai Kannan was arrested in Perambalur for criticizing Prime Minister Narendra Modi and Home Minister Amit Shah during a protest against Citizenship (Amendment) Act.

The Tirunelveli Police had registered the FIR against the writer for the speech delivered at a meeting, which was called by the Social Democratic Party of India on December 29 last year.

The police have booked him on the basis of multiple complaints filed by BJP leaders.

Kannan has been booked under Sections 504, 505(1) and 505(2) of the Indian Penal Code.
