Supreme Court dismisses plea filed by wife of former IPS officer Sanjiv Bhatt

New Delhi, Oct 4: The Supreme Court Thursday dismissed a petition filed by the wife of arrested former IPS officer Sanjiv Bhatt challenging his arrest in a 22-year-old case of alleged planting of drugs to arrest an advocate.

A bench of Chief Justice Ranjan Gogoi and Justices SK Kaul and KM Joseph said the petition can be moved before the Gujarat High Court. The petition had also alleged that Bhatt was not being allowed to sign any document in custody to enable him approach the apex court. 

Bhatt and seven others, including some former policemen attached with the Banaskantha Police, were initially detained for questioning in the case. Bhatt was the Banaskantha district superintendent of police in 1996. As per the police, the Banaskantha Police under Bhatt had arrested one Sumersingh Rajpurohit, an advocate, in 1996 on charges of possessing around one kg of drugs. At that time, the Banaskantha Police had claimed that drugs were found in a hotel room occupied by Rajpurohit in the district's Palanpur town.

However, a probe by the Rajasthan Police had concluded that Rajpurohit was allegedly falsely implicated by the Banaskantha Police to compel him to transfer a disputed property at Pali in Rajasthan. It had also claimed to have found that Rajpurohit was allegedly abducted by the Banaskantha Police from his residence at Pali in Rajasthan. Following the Rajasthan Police's investigation, former police inspector of Banaskantha IB Vyas had moved the Gujarat High Court in 1999 demanding a thorough inquiry into the matter.

In June this year, the high court had handed over the probe in the case to the CID while hearing the petition and asked it to complete the probe in three months. Bhatt, a Gujarat cadre IPS officer, was suspended in 2011 on charges of remaining absent from duty without permission and misuse of official vehicles and later sacked in August, 2015. Bhatt's wife Shweta has unsuccessfully contested the assembly election as a Congress party candidate against Prime Minister Narendra Modi from Maninagar constituency in Ahmedabad in 2012.

New Delhi, Jul 30: Even as COVID-19 cases continue to surge in various parts of India, more than 1 million people have recovered and discharged till now, informed Rajesh Bhushan, Secretary, Ministry of Health, here on Thursday.

"More than 1 million people have recovered from COVID-19 in the country. This landmark recovery has been achieved because of the selfless work and dedication of our doctors, nurses and frontline workers," Bhushan said at a press conference.

Giving the number of cured persons, Bhushan said, "More than 1,020,000 patients have recovered. They have been discharged. It is a great achievement."

He said, "The recovery rate has shown positive trends. It was 7.85 per cent in April and today it is 64.4 per cent, which is another heartening news which tells us that whatever battle is put by the Union government in collaboration with state governments is showing results."

"Sixteen states of the country have a recovery rate that is more than the national average. Of these, Delhi has a recovery rate of 88 per cent, Ladakh 80 per cent, Haryana 78 per cent, Assam 76 per cent, Telangana 74 per cent, Tamil Nadu & Gujarat 73 per cent, Rajasthan 70 per cent, Madhya Pradesh 69 per cent and Goa 68 per cent," Bhushan said.

He said effective clinical management lead to a decrease in case fatality rate. In June it was 3.33 per cent and now 2.21 per cent.

Bhushan said the case fatality rate in India today is 2.21 per cent and it's among the lowest in the world. Twenty-four states and Union Territories have lesser fatality rate than that of the country.

Herd immunity in a country of the size and population of India can not be a strategic option. It can only be achieved through immunisation.

"Over 18,190,000 tests have been conducted in the country including RT-PCR and rapid antigen tests. There has been a week-on-week increase in average tests per day. India is conducting 324 test per 10 lakhs population per day," Bhushan said.

He added, three vaccine candidates, are in phase 3 clinical trial. These three are in the US, UK and China. In India, two indigenously developed vaccine candidates are in phase I and II of clinical trials. 

Trial of the first vaccine involves 1,150 subjects at eight sites, second on 1,000 subjects at five sites.

Jan 27: Bidders for Air India Ltd. will need to absorb $3.26 billion of its debt, as Prime Minister Narendra Modi’s administration tries once again to sell the national carrier.

The entire company will be sold but effective control needs to stay with Indian nationals, according to preliminary terms published Monday. Bids are invited by March 17 with Ernst & Young LLP India as transaction adviser.

Air India, which started in 1932 as a mail carrier before winning commercial popularity, saw its fortunes fade with the emergence of cutthroat low-cost competition. The state-run airline has been unprofitable for over a decade and is saddled with more than $8 billion in debt.

Indian regulations allow a foreign airline to buy as much as 49% of a local carrier, while overseas investors other than airlines can buy an entire carrier. The government didn’t find a single bidder when it tried to sell Air India in 2018.

New Delhi, Jun 23: In an unexpected development, the pump price of diesel is all set to surpass the petrol price in the capital, making it the most expensive transport fuel for the first time in a long time.

Globally, diesel is priced slightly above petrol prices due to the very nature of the product that has a higher cost of production. But in India, due to the lopsided taxation structure, diesel attracts lesser of the tax between the two auto fuels keeping its prices lower than petrol for last several years.

Diesel is currently priced at Rs 79.40 a litre in the Capital, just 36 paise short of petrol price that is being retailed at Rs 79.76 a litre. Going by the trend of price movement in the two products for the last few days where diesel prices have consistently increased by 50-60 paise per litre while the daily increase in petrol prices have fallen to just 20 paise on Tuesday, it is set to surpass petrol prices in next few days.

"Diesel price movement is sharper in international market and if oil companies follow the global price trend, diesel prices will surpass that of petrol later this week. It will be after many years that this would happen and is expected to sustain for some time unless government changes the tax structure of the petroleum products again," said an oil sector expert from one of the big four audit and advisory firms asking not to be named.

Interestingly, even in India the base price of diesel is expensive than petrol. According to the Indian Oil Corporation (IOC), while the base price of petrol in Delhi currently comes to Rs 22.11 per litre, the same for diesel is higher at Rs 22.93 per litre (effective from June 16, 2020). This has been the case for a long time, but retail price of petrol can be higher than diesel due to central and state taxes.

What has now brought diesel prices to a whisker of petrol prices in the capital is the Delhi government's decision early May to increase the Value Added Tax on diesel from 16.75 per cent to 30 per cent and on petrol from 27 per cent to 30 per cent. This increased the retail price of diesel and petrol in Delhi by Rs 7.10 and Rs 1.67 a litre respectively. With Central taxes on the two products already reaching identical levels, the Delhi governments move hastened price parity between petrol and diesel.

Currently, the Central excise on petrol is Rs 32.98 a litre while that on diesel it is Rs 31.83 a litre. The VAT on petrol in Delhi is Rs 17.71 a litre and that on diesel is Rs 17.60 a litre.

While the movement of retail pricing is being seen with a sigh of relief by vehicle owners whose cars run on petrol, those buying the relatively expensive diesel cars are now repenting on their decision. The development is also being seen with caution by automobile companies who have spent millions to ramp up their facilities for diesel run vehicles. The expectation is that demand for such cars will now fall, causing more damage to companies where sales are already impacted due to persistent economic slowdown and now the spread of COVID-19 pandemic.

"The pricing development would push automobile companies to strategies being followed by companies in the western markets where diesel run cars are not sold on fuel pricing differential, but on overall make and quality that puts them ahead of petrol run cars," the expert quoted earlier.

Yes, but for commercial vehicle sector the rising price of diesel had not been welcomed. In fact, the commercial transport sector had time an again threatened strike against the move to raise fuel prices.

With petrol and diesel retail prices closing, the case for adultering fuel has also gone down much to the relief of vehicle owners.
