Suspension of IAS officer Mohammed Mohsin who checked PM's chopper put on hold by CAT

Bengaluru, Apr 25: The Central Administrative Tribunal (CAT) bench here Thursday stayed the Election Commission order suspending IAS officer Mohammed Mohsin for checking prime minister Narendra Modi's helicopter in Odisha.

The officer from Karnataka cadre, deployed in Odisha as a general observer, was suspended on April 17 for checking Modi's helicopter in Odisha's Sambalpur in "violation" of norms for dealing with SPG protectees and sent back to the state.

The CAT maintained that during an election process while reasonable assurances of protection and security must be made available to SPG protectees, it cannot be said: "they are eligible for anything and everything."

The bench also ordered an issue of notice to the EC and "four others" and posted the matter for further hearing on June 6.

Mohsin had tried to check some luggage in the convoy of the Prime Minister during his campaign visit and the EC had said he had acted in violation of its existing instructions.

In its order, CAT member (Judicial) Dr K B Suresh noted there was a circular regarding the SPG protectees that they are exempted from certain examinations on certain grounds.

"We will not go into the SPG protectees guidelines as per the bluebook right now, but the rule of law must prevail," he said.

The CAT also took note of the plea of the applicant's counsel who said there were news about heavy packages unloaded from prime minister's cavalcade being taken away in other vehicle.

Questions were raised but apparently no action followed, it said.

Noting that under the Constitutional process of federal structure, even though the EC has the supervisory power over the employees under its control at that moment of time, the CAT said once they are out of it, the commission's powers would cease.

The tribunal said: "Therefore the suspension order issued by the election commission cannot, on the face of it, lie. It is hereby stayed."

However, the CAT said it would look into this matter afresh once it received the response from the EC.

The tribunal said the applicant will be eligible to rejoin his former position under the Karnataka government "without any further ado about it".

Following the suspension, an EC source had said: "It has been laid down that SPG protectees are exempted from checking. He (the officer) should have known the instruction being an observer. The reason for the suspension is a dereliction of duty."

Mangaluru, Jan 3: Mangaluru police arrested another person on charge of spreading communal hatred through messages. The accused have been identified as Abubakkar Siddique (48).

"One Abubakkar Siddique has been arrested in connection with a case for spreading communal hatred through inciting messages," said Dr PS Harsha, commissioner of police, Mangaluru.

On December 31, Police have arrested one person, Moideen Hameez, on charge of spreading communal hatred through social media.

The Mangaluru city police on Monday served notices to a few persons for posting inflammatory messages on social media.

The Cyber Crime police have summoned the accused persons to appear before it on January 2.

"Action against miscreants spreading communal hatred on social media underway in a major way. A dedicated team of cyber experts is keeping a hawk's eye on anyone fomenting communal disharmony anywhere on the internet," Harsha said in another tweet.

Mangaluru, Apr 25: Heavy rain lashed Mangaluru and surrounding areas on Saturday, providing the people respite from the sweltering heat, which they have been experiencing for the last few weeks. 

The rain, which started around 10.30 pm on Friday, lashed heavily after 2 am. Later, there was drizzle for sometime before it stopped raining around 8 am. 

People were seen walking towards the market to purchase essential commodities holding an umbrella and wearing a raincoat.

Shivamogga, May 21: An FIR has been registered against Congress interim President Sonia Gandhi in Sagar taluk of Shivamogga district of Karnataka over tweets on May 11 by the party's official handle about PM-CARES fund.

The FIR, registered under Sections 153 (wantonly giving provocation with intent to cause riot) and 505 (statements conducing to public mischief) of the Indian Penal Code (IPC), identifies Gandhi as the handler of the social media account.

The complaint by advocate Praveen KV alleged that the Congress party, through the tweets, has made rumourous statements against the Government of India and Prime Minister Narendra Modi and was trying to provoke the people against the government.

According to the FIR, the Congress party had on May 11, 2020, made false and baseless allegations, claimed misappropriation of PM-CARES Fund and cast aspersions on the Government of India through the tweets.

"A Twitter account handled by All India Congress Committee headed by Sonia Gandhi had on May 11, 2020, published tweets terming PM CARES Fund as PM CARES Fraud. They had claimed that the PM CARES fund is not being used for the public," Praveen KV told ANI on Thursday.

He said that he has collected all the details related to the tweets and account from the handle and filed a complaint in the matter, following which a preliminary enquiry was conducted and an FIR was registered in the matter.

"They had also said that the Prime Minister was enjoying and going to foreign trips with this fund. This is clearly rumourous news against the Government of India in this COVID-19 pandemic situation. In this regard, I had filed a complaint. After a primary enquiry, the Sagar Police has filed an FIR against Sonia Gandhi, who heads the INC Twitter account," Praveen KV said.
