Teesta moves Supreme Court seeking ban on use ofHindutva' in polls

New Delhi, Oct 21: Social activistTeesta Setalvad has moved theSupreme Court to intervene in the ongoing debate over nexus between candidates and religious leaders and sought a ban on the use of "Hindutva" interchangeably with Hinduism in elections.

TeestaSetalvad along with retired professor and theatre activist Shamsul Islam and journalist Dilip C Mandal moved a joint intervention application before a 7-judge Constitution bench headed by Chief Justice T S Thakur requesting reconsideration of a December 1995 SC judgement that had ruled that `Hindutva' was a way of life and could not be equated with any religion.

The current petition would affect BJP directly as the party has held up the SC ruling in support of its claim that it is not seeking votes on religious lines and is rather advocating a cultural identity and nationalism.

The court had ruled that the use of Hindutva during elections could not be held to be a corrupt practice to invite disqualification of a candidate: a determination which was celebrated by the BJP which swears by Hindutva, calling it a cultural concept derived from the civlisational ethos of the country . The pending petition related to disqualification of a candidate for using speeches of Bal Thackeray and Pramod Mahajan seeking votes in the name of Hindutva and Hindu Rashtra in the 1990 Maharashtra assembly elections. The HC had disqualified the candidate for falling foul of Section 123(3) of Representation of the People Act, which bans use of religion, caste, community and language as a tool to garner votes.

Disputing the SC's 1995 ruling that `Hindutva' is a way of life, the applicants requested the court to decide -"Whether a candidate who contests on the ticket of a political party which in its manifesto appeals to `Hindutva' as being the political agenda of the party , is not thereby guilty of corrupt practice within the meaning of Section 123 in as much as he has consented to and subscribed to the manifesto of that party?" Setalvad and her co-applicants said that the ruling "had the effect of encouraging political parties to use religious appeals for garnering votes under the colour of the proposition that Hindutva is not a religion but a way of life".

"This has had devastating consequences leading to demands of homogenisation and assimilation of minority communities and SCST in the `Hindutva' way of life.Hindutva has become a mark of nationalism and citizenship. Such an interpretation has curtailed the faith in secularism, which is a basic feature of the Constitution," the petition said.

Setalvad, a known opponent of RSS and BJP who has accused PM Narendra Modi of complicity in 2002 Gujarat riots, and two others severely criticised the NDA government's governance, alleging that since coming to power, it has made free thinkers and those upholding Constitutional values feel insecure and put "India at crossroads".

"For the past two years, articulation of a narrow, supremacist variety has engendered a deep feeling of insecurity for minorities, free thinkers, atheists and all those who uphold the Constitutional ideal of an India meant for all, irrespective of caste, creed, gender, politics or faith. The applicants, who are public intellectuals committed to peace, social harmony and social justice, seek to put certain key perspective before the Supreme Court," it said.

"India is at crossroads today , at the educational and cultural level, and in terms of interpretation of the law, too, narrow and supremacist interpretation of history , culture, social studies and the law threaten how the fundamentals of Indian nationhood are, in future conceived and built," the petition said.

"Tendencies to approach these rich and vast areas of the social sciences through narrow interpretations of `faith' and `mythology' threaten to stifle academic pursuit and scientific temper essential to a modern nation in the 21st century . Disturbing portents in Indian public life -seeking to justify customs and practices on the ground of their being from the `Shashtras' or `Sharia' -are equally worrisome and condemnable," it said.

They also requested the SC to decide two other important questions -"Whether subscribing to the manifesto of a political party which calls for formation of a `Hindutva State' is not deemed consent on the ground of religion of the candidate?" and "Whether an appeal by a candidate for a `Hindutva State' is not an appeal for a theocratic state and therefore, ultra vires the basic feature of the Constitution?"

Bengaluru, Feb 2: The monthlong budget session beginning on Monday, which will mark BS Yediyurappa’s maiden budget in his fourth term as chief minister, is expected to be a fiery one.

The opposition JD(S) and Congress have already threatened to stall proceeding until BJP legislator Basangouda Patil Yatnal apologises for his controversial remarks against freedom fighter and centenarian HS Doreswamy. Yatnal had called him a fake and a Pakistani agent.

Disruptions are also likely to pose a threat to speaker Vishweshwar Hegde Kageri’s novel idea of having a two-day discussion on the Constitution of India to commemorate 70 years of the country’s Independence.

Both opposition parties have scheduled legislature party meetings early on Monday and they could coordinate on issues on the floor of the house to put the BJP — especially Yediyurappa — on the backfoot.

Yatnal is not known as a “hardliner”, but his attack on Doreswamy has garnered support from several ministers including CT Ravi, KS Eshwarappa and V Somanna. Yediyurappa may have a hard time defending his party’s line.

The BJP is yet to schedule its legislature party meeting, but MLAs suggest the party will allow the issue to be raised and debated in the legislature. “Both have expressed their point of view. Let there be a discussion on the matter, but not allowing the house to function will only be a waste of the state’s time and money,” said deputy chief minister CN Ashwath Narayan.

Besides the Doreswamy issue, Yediyurappa will also deliver his reply — postponed from February 20 — to the debate on the governor’s address. The issue of student Amulya Leona Narona’s arrest on a charge of sedition, the Bidar sedition case involving a parent of a school student, pro-Pakistan writings on walls in places in north Karnataka, introduction of NPR and the anti-CAA stir is also likely to feature during the lengthy session.

Udupi, Feb 5: A school boy died after being bitten by a venomous snake while he was returning home from a playground at Perdoor village in Udupi district.

The victim has been identified as Abhinav (9), son of Raju Shetty and Gita Shetty couple from the same village. 

Abhinav had returned from school yesterday evening as usually. He then went out to play. At around 7 p.m. while he was walking towards home, a snake bit him sources said. 

He was immediately taken to KMC Hospital in Manipal, where doctors pronounced him brought dead. 

A case of unnatural death has been registered in the jurisdictional police station.

Words Jihad and Jihadi have been in abundant use for the negative purposes from last two decades in particular. They have been closleyl linked to the word terrorism and violence, done by section of Muslims here and there. This global use of word is particularly a post 9/11 phenomenon. Just to recapitulate after the WTC was hit by two aeroplanes; the building sunk leading the death of nearly three thousand innocent people. The victims belonged to most countries and religions. In the aftermath; Osama bin Laden called it Jihad. American media coined the word Islamic terrorism since then. Most of the acts indulged in by Muslim terror groups have been labelled under this title. This; irrespective of the fact that many an Islamic Scholars, many a Muslim clerics like Maulanas of Deoband and Barelvi, stating that Islam does not approve of violence against innocent people. The words have stuck.

This has also beoame one more weapon in the hands of communal sectarian elements. Apart from the mainstream media social media has been delving this with gay abandon using these words in a derogatory way. The lap media also called Godi media, which is an important part of the opinion making against Muslims has been using it day in and day out.

Recently (March 11, 2020), Mr. Sudhir Chaudhary, the Editor-in-Chief of Zee channel in a show went on to the limits of this misrepresentation by showing a chart and classifying Jihad into various categories, Love, Jihad, Land Jihad and latest in series being Corona Jihad in the wake of Tablighi Jamaat event. Mr Chowdhary concluded that all these types of Jihad are being done to weaken India. Surely, these types of programs have been increasing and intensifying Hate against Muslims and Jihad.

Unlike most of the times, this time around a complaint was filed against the said editor, a FIR was filed and lo and behold the editor’s tune changed.  In the next program he talked respectfully about the word Jihad! The tone and tenor changed. Was it a late realization or the fear of facing criminal action which made him change the tune, he alone should know, but that’s another chapter to the story?

As such jihad is by and large used as synonym for violence, terrorism. This is very much contrary to the its use in Koran.. Islamic scholar Asghar Ali Engineer argues that its use in Koran is multilayered. It stands for ‘utmost striving’ and has nothing to do with violence against innocents. As per him the concept of Jihad is far above violence. Those indulging in power games have used it as a cover for expanding power and called it as Holy War. This is very similar to the use of word Crusade by Christian Kings and Dharm Yudh by Hindu kings.

A deeper and more rational study of Koran and Hadith bring forth the real meaning of the term. Sufi’s who were away from the power struggle and focussed on spiritual aspects of religion like Bhakti Saints or liberation theologians, unfolded the deeper meaning of the term. Engineer points out that “it is for this reason that they describe war as jihad-e-Asghar and jihad to control one’s greed and selfish desires as jihad-e-Akbar (Great jihad)” (On Multi Layered Concept of Jihad, in A Modern Approach to Islam, Dharmaram , Page 26, 2003, Bangalore)

The reference to Jihad comes in Koran over 40 times, mostly referring to Jihad-e-Akbar, striving to overcome personal greed and selfishness. The real transformation of the word Jihad in popular perceptions and Chaudhary is the extreme example of that, takes place during the training of Mujahideen in the few specially set up Madarssas in Pakistan. This was initiated and coordinated by America in the decade of 1980s, when the Russian Army occupied Afghanistan. That was the time American forces were totally demoralised due to their humiliating defeat in Vietnam, at the hands of Vietnamese people.

To confront the Russian army, US planned to join the anti Russian forces. For this with the help of extremist Salafi version of Islam, they promoted the radical tendencies within a section of Muslims. The brain washing of the Asian Muslim youth as Mujahedeen to Taliban took place in few Pakistani Madrassas, totally funded by America. For this funding opium trade was also put into operation. The brainwashing module designed in Washington incorporated many components which also distorted the concept of Kafir, and created Hate against communists. Communists were labelled as Kafirs (Non believers) and so killing them was presented as Jihad. Getting killed while doing such an act was to be rewarded with entry pass to Jannat with 72 virgins waiting for those embracing this path.

America further went on to promote Taliban and Al Qaeda, which joined anti Russian forces, leading to defeat of Russian forces. Mahmood Mamdani in his book ‘Good Muslim Bad Muslim’ makes an inference based on CIA documents that America invested 8 thousand million dollars and also supplied seven tonnes of armaments, including the most sophisticate missiles to these forces. One also recalls the Al Qaeda leaders’ visit to US, White house. In the Press meet the then US President Ronald Regan, introduced them as being the equivalents of founding fathers of United States as they are fighting against the evil of communism.

Now of course the situation has taken its own turn and nearly three decades after their inception the same elements, later followed by ISIS and IS acted like Frankenstein’s monsters, killing Muslims in large numbers. It is estimated that over 70000 Pakistanis have been killed due to the action of these groups, who were propped up and nurtured by US to enhance its control over the oil wells of West Asia.

The likes Sudhir Choudhary can merrily propagate the Hate using the term Jihad. That such elements can also be partly controlled through the process of law is a part of great learning after the FIR filed against him. One hopes that such hate filled programs will come to a halt once we combat them ideologically and after resorting to the provisions of Indian Constitution.
