Tejpal's arrest imminent as sessions court denies anticipatory bail

Panaji, Nov 30: The sessions court on Saturday denied anticipatory bail to Tehelka editor-in-chief Tarun Tejpal. The decision was taken after a very long deliberations.

The Sessions Court Judge passed the order after hearing both defence and prosecution arguments.

jejpalEarlier, the sessions court in Goa said it will decide on the anticipatory bail application filed by Mr. Tejpal at 4.30 p.m. on Saturday, after both the parties completed their arguments in the morning session.

Mr. Tejpal is accused of sexually assaulting the junior female reporter during Tehelka's literary fest called ThinkFest at Hotel Grand Hyatt in Panaji, a fortnight ago.

Mr. Tejpal's lawyer Geeta Luthra argued that the police must be able to justify the arrest of an accused despite the fact that they have the power to do so.

"He (Mr. Tejpal) is willing to cooperate with the authorities on court's terms. He will do as police wants him to do, even stay in Goa for time period required by them," she told sessions judge Anuja Prabhudesai. Ms. Luthra referred to various judgments from the Supreme Court where the anticipatory bail was granted in the alleged cases of rapes.

The Special Public Prosecutor Saresh Lotalikar argued that the victim's statement in the case has remained unchanged right from the start. While the version of the accused kept changing.

"The accused is like a chameleon, who changes his colour every now and then," he said.

He countered the Defence argument that Mr. Tejpal is cooperating with the authorities. "His cooperation seems to be coming on his own terms. He was not available at his home when Goa police went there," he said. Mr. Lotalikar even accused Mr Tejpal of trying to keep matter sub-judice to avoid arrest.

Countering Ms. Luthra's claims that the present rape law is draconian, he said that no matter what she feels about the law, Mr. Tejpal will have to deal with the present law of the state.

"We require the custodial interrogation for truth to come out," he argued. The state argued that Mr. Tejpal is trying influence the victim's family members as he is in the position of influence.

Mr. Tejpal's lawyer however countered the state's argument saying that he will cooperate on court's terms and not on his own.

Meanwhile, sessions judge Ms Prabhudesai made it clear that she will not be entertaining any arguments alleging political interference in this case. She will announce the order on the anticipatory bail application at 4.30 p.m. on Saturday.

Meanwhile person wearing the flag of the Bharatiya Janata Party tried to throw a black cloth on Mr. Tejpal's car outside the session court here. However the police immediately detained the person

Arguments

Arguing in court on Saturday, Ms. Luthra said Mr. Tejpal was ready to stay in Goa till the time it was required by the investigating agency.

She said he will also not visit Mumbai, where the victim is currently residing.

“There should not be any fear that he (Tejpal) will tamper with witnesses or evidence,” the defence lawyer said.

Ms. Luthra also ruled out the possibility of Mr. Tejpal fleeing the country saying he has not fled before the FIR or after that.

“My client cannot tamper with the aggrieved girl as she will stand by her statement,” the lawyer said.

Wrapping up her arguments, Ms. Luthra said false allegation of rape can bring distress to the accused and cause equal damage to him as to the complainant.

She said as the rape law has become more stringent, so it all the more required for the accused to defend himself for which “his liberty may be preserved”.

Public Prosecutor (PP) Saresh Lotlikar argued that prima facie a case is established against Mr. Tejpal and so the police want his custodial interrogation.

Mr. Lotlikar said the CCTV footage of the hotel in Goa where the incident occurred early this month gives enough hints confirming the allegation of rape.

The PP argued that the accused should be in police custody so that he can be properly interrogated. He said Mr. Tejpal has been changing his version and is now saying that he has not been heard.

Pune, Jan 1: Maharashtra Deputy Chief Minister Ajit Pawar and Vanchit Bahujan Aghadi president Prakash Ambedkar paid tributes at the 'Jay Stambh' near here on Wednesday on the 202nd anniversary of Koregaon Bhima battle.

Lakhs of people congregate every year at the 'Jay Stambh' (victory pillar) near Koregaon Bhima village to offer tributes on the anniversary of the battle, which was fought on January 1, 1818 between the British East India Company and the Peshwa faction of the Maratha Confederacy.

Violence broke out during the bicentenary celebrations of the Koregaon Bhima battle on January 1, 2018 in which one person was killed and several others were injured.

Police have made elaborate security arrangements to ensure no untoward incident takes place during the congregation at the victory pillar, an official said.

Talking to reporters after visiting the victory pillar, Pawar said he came to offer tributes on behalf of the people of Maharashtra.

"This pillar has history and every year lakhs of people come here. Some untoward incidents took place two years ago, but the government is taking utmost care and elaborate police bandobast has been made here to ensure that no untoward incident takes place," he said.

Pawar also urged people to visit the war memorial in a peaceful manner.

"I appeal to people to come here and offer their tributes, but maintain peace and do not believe in rumours," the NCP leader said.

Prakash Ambedkar also offered his tributes at the victory pillar.

Pune Police last week issued notices to several people, including right-wing leaders Milind Ekbote and Sambhaji Bhide, and members of Kabir Kala Manch, barring them from entering the district for four days from December 29.

The notices, as part of preventive action, were issued to all those against whom cases were registered in connection with the violence two years ago.

Ekbote was arrested in March 2018 for allegedly instigating and orchestrating the violence around Koregaon Bhima.

Bhide was also booked and named in the FIR, but never arrested.

The police attributed the violence to the Elgar Parishad conclave held here on December 31, 2017, where provocative speeches were allegedly made.

They are also probing the alleged "Maoist link" of some activists to the Elgar Parishad conclave.

Several Dalit groups observe the anniversary of the Koregaon Bhima battle, in which the British defeated the Peshwas of Maharashtra.

The memorial, located at Perne village on Pune- Ahmednagar road, was constructed by the British in the memory of soldiers who died in the battle.

Dalit leaders commemorate the British victory as soldiers from the Mahar community were part of the East India Company's forces.

The Peshwas were Brahmins, and the victory is seen as a symbol of assertiveness by Dalits.

Thiruvananthapuram, Aug 6 : Kerala Chief Minister Pinarayi Vijayan has said that Congress is known for adopting a soft Hindutva agenda and that there was nothing new in the remarks of Priyanka Gandhi Vadra and Rahul Gandhi on Ayodhya temple construction.

"I am not surprised regarding, Priyanka Gandhi's remark on Ayodhya. From Rajiv Gandhi and Narasimha Rao, Congress had followed a similar stance. I don't think Congress has any stand when it comes to secularism. 

If it was the case, then our country would not have reached such a level," the chief minister said when asked about the 'Bhumi Pujan' ceremony at the Ram temple in Ayodhya on Wednesday.

"There is nothing new on Rahul Gandhi or Priyanka Gandhi's position on the issue. They are following the Congress' soft Hindutva agenda. There is no element of surprise," Vijayan said.

Further, Vijayan said that CPI(M) Politburo had made clear the party's viewpoint on the Ayodhya temple construction.

"When it comes to Ayodhya issue. I want to ask who had allowed worship there. It was Congress. Who had allowed to lay the idol there? It was Congress. 

Who gave permission to Karseva? It was Congress. Even when it came to demolition of Babri Masjid too who shut their eyes and gave a silent nod for it- wasn't it the Congress regime at the centre? And Muslim League (IUML) was part of it. These are all part of our history," said Kerala Chief Minister.

He said instead of involving in discussions on it, more time should be utilised towards containing the COVID-19 spread in the country and helping the poor who are suffering due to the pandemic.

Mumbai, May 10: Air India, which is operating flights to evacuate Indians stranded in foreign countries, have asked its pilots to undertake coronavirus test before they operate such flights, the sources said.

"Five Air India pilots have tested positive for coronavirus. These pilots were tested one after one. We suspect it could be a case of faulty testing kit as well," one of the sources said.

The five pilots fly Boeing 787 planes, the second source said.

Air India spokesperson did not offer any comment.

A senior airline official said the five pilots had not operated any flight in the last three weeks.

"These pilots had operated cargo flights to China prior to April 20," the official said.
