Tharoor urges HC to stop Arnab from misreporting on Pushkar

New Delhi, Oct 24: Congress MP Shashi Tharoor today urged the Delhi High Court to stop journalist Arnab Goswami and his news channel Republic TV from "misreporting" his wife Sunanda Pushkar's death, saying his "right to be left alone" and "right to silence" must be respected.

The submission was made before Justice Manmohan, who reserved the verdict on Tharoor's plea seeking to restrain Goswami and his channel from airing any news or debate about the death of Pushkar.

The journalist and the channel, on the other hand, said they had only placed the actual evidence and the police report while broadcasting the news.

The Thiruvananthapuram Lok Sabha MP has filed an interim application for stopping the channel from broadcasting the incident in the pending Rs two crore civil defamation suit against the TV anchor and Republic TV.

Senior advocate Salman Khurshid, appearing for Tharoor, submitted that the court must direct Goswami and the channel not to mention the expression "murder of Sunanda Pushkar", as it is yet to be established by a competent court that her death was "murder", and ensure that the trial is not prejudiced.

"Goswami and channel must not involve in rhetorical assertions," Khurshid contended.
Senior advocate Sandeep Sethi, appearing for Goswami and the channel, said they have neither "condemned" Tharoor, nor suggested that he was involved in the death of his wife.
The counsel also submitted that the Congress leader was not called "the killer" of his wife by the journalist or the channel, as claimed by Tharoor.

After hearing the arguments of all the parties, the court reserved its order.
Tharoor has filed three different applications through his counsel Gaurav Gupta seeking various directions, including not to make any defamatory publication against him in any manner.

Pushkar was found dead in a suite of a five-star hotel in south Delhi on the night of January 17, 2014. The matter is still under investigation.

Tharoor had on May 26 this year filed the civil defamation suit against Goswami and Republic TV in the High Court.
He had also sought a direction from the high court to restrain the TV channel from broadcasting any show relating to the death of his wife till the investigation is completed by the Delhi Police.

Tharoor has referred to the broadcasting of news items from May 8 to 13 when the TV channel claimed to have aired an expose connected to the death of his wife.

The politician has alleged that despite assurances given in the court on May 29 by the counsel for Goswami and Republic TV, they were engaged in "defaming and maligning" him.
The court had on May 29 said the journalist and his news channel could put out stories stating facts related to the investigation of Pushkar's death, but could not call the Lok Sabha MP a "criminal". It had also told their counsel to reduce the rhetoric.

Goswami and the channel had in their affidavit said that they have abided by the court's direction and in "no manner misreported or misled the viewers as the facts were correctly reported".

They have also claimed that the suit has been "instituted with an oblique and ulterior motive and is a misguided attempt to muzzle a media channel and the dissemination of true facts to the public".

New Delhi, Mar 21: A couple was deboarded from a Delhi-bound Rajdhani train on Saturday after co-passengers observed a home quarantine seal on the husband's hand, the Railways said Saturday.

Officials said the Delhi-based couple boarded the Bangalore City-New Delhi Rajdhani at Secunderabad on Saturday morning.

When the train reached Kazipet in Telangana at 9:45 am, a co-passenger noticed the quarantine mark authorities are putting on suspected coronavirus cases —on the husband's hand when he was washing his hands. Other co-passengers then informed the TTE onboard.

The train was briefly detained and the couple was taken to a hospital. The coach was completely sanitised in Kazipet and was locked, officials said.

The air conditioning was also switched off.

The train left for its destination at 11.30 am.

People fleeing quarantine has been a common problem reported from different parts of the country.

New Delhi Aug 6: In a new twist in the Vijay Mallya case, a certain document connected with the case in the Supreme Court has gone missing from the apex court files. 

A bench comprising Justices U.U. Lalit and Ashok Bhushan adjourned the hearing to August 20.

It was hearing the review plea filed by Mallya against a July 14, 2017 judgment wherein he was found guilty of contempt for not paying Rs 9,000 crore dues to banks despite repeated directions, although he had transferred $40 million to his children.

The bench was looking for a reply on an intervention application, which it seemed has gone missing from the case papers.Parties involved in the case sought more time to file fresh copies.

On June 19, the Supreme Court sought explanation from its registry regarding Mallya's appeal against the May 2017 conviction in the contempt case for not repaying Rs 9,000 crore dues to banks not listed for the last 3 years.

A bench comprising Justices Lalit and Bhushan had asked the Registry to furnish all the details including names of the officials who had dealt with the file concerning the Review Petition for last three years.

The bench said according to the record, placed before it, the review petition was not listed before the court for last three years. "Before we deal with the submissions raised in the Review Petition, we direct the Registry to explain why the Review Petition was not listed before the concerned Court for last three years," said the bench.In May 2017, the apex court held him guilty of contempt of court for transferring $40 million to his children, and ordered him to appear on July 10 to argue on the quantum of punishment.

The bench said let the explanation be furnished within two weeks. "The Review Petition shall, thereafter, be considered on merits," it added.In 2017, the apex court passed the order on a contempt petition against Mallya by a consortium of banks led by the SBI. 

The banks claimed Mallya transferred $40 million from Daigeo to his children's accounts, and did not use this money to clear his debt. Banks cited this as violation of judicial orders.

New Delhi, Mar 5: A Delhi court Thursday issued fresh death warrants for execution of the four convicts in the Nirbhaya gang rape and murder case for March 20 at 5.30 am.

Additional Sessions Judge Dharmendra Rana fixed March 20 as the new date of execution after it was told by the Delhi government that the convicts have exhausted all their legal remedies.

The lawyer for the four death row convicts also told the court that there was no legal impediment for the court to proceed in fixing the date of execution.
