Time has not come for any rethink on AFSPA, says Army chief

New Delhi, Jan 28: Time has not come for any rethink on AFSPA or making some of its provisions milder, Army Chief General Bipin Rawat has said, asserting that the army has been taking adequate precautions in protecting human rights while operating in disturbed areas like Jammu and Kashmir.

Rawat's remarks assume significance as they come against the backdrop of reports that several rounds of high-level discussions have taken place between the defence and home ministries on the "need to remove or dilute at least some provisions" of the Armed Forces Special Powers Act (AFSPA).

The act gives the security forces special rights and immunity in carrying out various operations in disturbed areas.

There has been a long-standing demand from various quarters in J&K and the Northeast to withdraw it.

"I do not think time has come to even rethink on AFSPA at the moment," said Gen Rawat when asked about reports that government was re-examining the demand for a milder version of AFSPA in these states.

The army chief said though AFSPA has certain strong provisions, the army is concerned about collateral damages and ensuring that its operations under the law do not inconvenience the local people.

"We have never been strong in applying the force the way it could be applied (under AFSPA). We are very concerned about human rights. We are absolutely concerned about collateral damage. So do not get too much concerned because we are taking adequate measures and precautions," he said.

Gen Rawat said the army has rules of engagements for various operations at every level to ensure that no inconvenience is caused to the people while it is operating under AFSPA.

"The AFSPA is an enabling provision which allows the army, in particular, to operate in such difficult areas and let me assure you that the Army has got quite a good human rights record," he said.

Asked whether time has come to adopt a combined approach involving all three services to deal with Pakistan-sponsored terrorism in J&K, the army chief did not give a direct reply but added that the armed forces have "options available" to conduct various kinds of operations.

"Yes, we have options available to conduct various kind of operations but these cannot be divulged because of the nature of the operations we have to conduct will only alert the other side," he said.

To a question on whether there was room for synergy among external and internal intelligence gathering to effectively contain cross-border terrorism in Jammu and Kashmir, he said the armed forces and all other agencies have been operating in unison.

"At this juncture, the kind of cooperation we are having among the intelligence agencies is of a very high order. Today all the intelligence agencies and the security forces are operating in unison. There is an excellent synergy among all of us and I do not think we can take it to the next higher level from what is happening at the moment. I think this is the best way and right way," the army chief said.

Kota, Jun 19: In a shocking incident, a COVID-19 patient in Rajasthan's Kota district died after his family disconnected the ventilator to plug in the air cooler to combat the scorching heat.

The incident happened on June 15 in the Maharao Bhimsingh Hospital (MBS) hospital.

A committee was formed soon after the death was reported, which will submit its report on Friday at 4 p.m., hospital Medical Superintendent Naveen Saxena told media persons.

He said, "We have set up the committee to investigate the incident based on the primary information. The committee includes deputy superintendent of the hospital, nursing superintendent and CMO. We will look into the matter and then shall explore further action for a need to go to the police."

The family members of the COVID-19 patient, who came to meet him in the MBS hospital unplugged the ventilator and had put on the cooler switch which they had brought from outside. The ventilator worked for some time on the battery but later it collapsed and the patient turned critical.

The doctors were reported of the patient's critical condition who came rushing and did all they could do to save his life, but the result was unfavourable and the patient died.

The relatives, on the other hand, attacked the resident doctors after the patient died.

Doctor Varun, on duty, submitted a written complaint to the officials, alleging that the patients' relatives misbehaved with the staff. Other resident doctors also supported him and boycotted work very briefly, but then later resumed work.

Thiruvananthapuram, Apr 5: Eight more COVID-19 positive cases were reported from Kerala on Sunday, four among whom attended the Tablighi Jamat congregation in Delhi and six people were cured, Health Minister K K Shailaja said.

With this, the total number of affected people under treatment in the state has gone up to 256, she said.

"Out of the eight cases, five are from Kozhikode, and one each from Pathanamthitta, Kannur and Kasaragod districts.

In the case of Kozhikode, four out of the five returned from Nizammuddin meet and one from Dubai.

As of date, 10 people who had returned from Nizammuddin in Delhi have been tested positive," the minister said in a release

A total of 314 cases have been reported from Kerala so far and 56 people have been cured, she said

"We have sent 10,221 samples for testing," she said.

A total of 1.58 lakh people are under observation in the state, out of which 776 are in isolation wards in hospitals.

New Delhi, Jul 18: National carrier Air India on Friday said that it is in a ‘very challenging financial’ situation and is taking recourse to several initiatives, with a view to ensuring the continuance of its operations.

The airline, in a statement, noted that it has introduced the partially voluntary 'Leave Without Pay' (LWP) scheme on July 14.

"The scheme primarily enables employees to avail the benefits of proceeding on leave without pay on a voluntary basis. The LWP scheme has been introduced for grant of leave without pay and allowances for permanent employees for a period of six months or two years, which is extendable upto 5 years," the statement said.

"Air India had brought out similar scheme earlier... Several hundred employees have, in the past, availed of the LWP Scheme."

As per the statement, in the wake of the ongoing Covid-19 pandemic, there may be employees who are unable to attend their office duties in person on account of personal reasons.

"The LWP scheme enables employees to take a break from their office responsibility for a defined period of time with the approval of the management, while retaining their employment with the company," the statement said.

"They will continue to avail facilities such as passage, medical and housing at specified rates."

Accordingly, the LWP scheme provides the opportunity to employees to take up alternative employment with the approval of the management during the period of the said leave, the airline said.

"The LWP scheme is a win-win situation for both the management as well as employees as it provides flexibility to employees and simultaneously reduces the wage bill for the company," the statement said.

"It is important to note here that the Covid-19 outbreak has very seriously impacted the airline sector and currently, the airline operations of the company are a small fraction of the prior Covid level operations."

The airline said that employees are encouraged to apply for availing the benefit of the scheme, in the prescribed format, by August 15.

"The only addition in this scheme as compared to the earlier LWP scheme is that the management can pass an order requiring the employees to go on leave for a period of six months or two years (extendable upto 5 years) compulsorily taking into consideration 'Suitability, Efficiency, Competence, Quality of performance, Health, Non-availability of employee and Redundancy'," the statement said.

Furthermore, the airline said that this provision has been introduced for use, "very sparingly", with a view to ensuring that the overall efficiency of the organisation, improves and the management will ensure that this will be implemented with complete fairness and transparency as per prescribed procedure.

Consequent to the announcement of the scheme, Air India unions are discussing their strategy against the move which might involve legal recourse.

An Air India union leader on Friday told IANS: "This is going to affect the livelihood of many. Why not every employee of AI take LWP a few days every month. This way the burden can be shared."

"The motive of the top management is to save their money by snatching money from lower employees."

According to Air India PIM document, as on November 1, 2019, the airline, on a standalone basis (without subsidiaries), had around 14,000 employees, including fixed term contract staff.

The development comes as the Centre has re-initiated the airline's divestment plan with new norms.

Interestingly, this time, it has sweetened the deal by substantially reducing the debt on the airline's account books and offered a 100 per cent stake in the loss-making airline.

The last date for bid submission to acquire Air India has also been extended to August 31.
