Tribunal restrains ED From taking over Dr Zakir Naik’s assets; asks why no action against babas?

New Delhi, Jan 10: After NIA suffered an embarrassment with quashing of its Red Corner Notice request by the Interpol, the Enforcement Directorate (ED) on Tuesday was pulled up by a judicial tribunal over its investigation against peace activist and Islamic preacher Dr Zakir Naik.

Justice Manmohan Singh, who heads the Appellate Tribunal for PMLA (Prevention of Money Laundering Act) at New Delhi, restrained the agency from taking over Dr Naik’s properties attached by the agency, and drew a parallel between Naik and self-styled spiritual leader Asaram Bapu.

"I can name 10 babas who have properties worth more than Re 10,000 crore each and they are facing criminal cases. Have you acted against even one of them? What have you done against Asaram Bapu?" it asked the counsel for the ED.

Raising questions whether ED was being selective in acting against Dr Naik, the Tribuna’s chairman observed that the agency seems to have done nothing in the last 10 years about confiscating properties of Asaram but looked to act a lot quicker in this case.

The central probe agency, in March last year, had attached a school building in Chennai and a warehouse as part of its provisional attachment in the case and it was carried out under the stringent criminal provision of the Prevention of Money Laundering Act (PMLA).

As per the legal scheme under the Act, such an order goes to the Adjudicating Authority for final approval and in case the ED's action is endorsed, the affected party can appeal it before the Appellate Authority of the law.

The Appellate Authority (PMLA), now in a recent order, directed the agency to restrain from taking possession of the said attached immovable assets even as it posed several queries and questioned the agency's action in the case.

Official sources in the ED said the agency will appeal the order of the Appellate Authority or the Tribunal before a High Court and that it was not a "set back" in the case.

Officials said the tribunal order has not "quashed" the attachment but has directed that status quo be maintained. The tribunal, they said, has at the same time not barred the agency "from taking possession" of the movable assets attached in the same order that includes mutual funds worth about Rs. 9.41 crore and five bank accounts containing deposits worth Rs. 1.23 crore in the name of Naik's NGO Islamic Research Foundation (IRF).

Agency sources said the investigation conducted by the ED officials is independent of the NIA and that it has found that these assets were created by Naik and his associates using alleged "tainted funds".

The Adjudicating Authority had approved the ED order after being satisfied by the investigation, they said, adding this will be a point made in the appeal to the High Court.

The ED is looking into the charges of alleged laundering of illegal funds in the case and the subsequent proceeds of crime thus generated.

The National Investigation Agency (NIA) had first registered a case against the 51-year-old Naik under antiterrorism laws in 2016 for allegedly promoting enmity between different religious groups.

The NIA and Mumbai Police, subsequently, had also carried out searches at 10 places in Mumbai including residential premises of some of the office bearers of the foundation run by Naik.

The foundation was earlier put on restricted list by the Home Ministry for receiving funds from abroad.

Bengaluru, Apr 21: Hardline BJP leader and Bengaluru South MP Tejasvi Surya, who had deleted some of his old sexist tweets while contesting for Lok Sabha polls, yesterday deleted deleted his ugly remarks against Arab woman after it went viral and triggered sharp response from  many quarters, including from the Arab world.

In 2015, before Surya became an MP, he had said in a tweet, "95% of Arab women have never had an orgasm in the last few hundred years! Every mother has produced kids as an act of sex and not love. @Tarek Fatah."

The old tweet was picked up some influential members in the Arab community. Many intellectuals and various members of the royal families too have over the past few days condemned the attacks on Muslims in India and called out instances on Islamophobia. They have been highlighting derogatory comments about the Arab community purportedly made by supporters of the ruling BJP. It was then that a few found that even present day recognised leaders like Tejasvi had made similar comments in the past.

As the outrage grew, Tejasvi deleted the old tweet. A lot of BJP supporters on Twitter then started pointing out that Tejasvi Surya had merely quoted Canadian journalist Tareh Fatah, known for his anti-Islam comments. But by then someone had archived the tweet and Tejasvi's response to it in 2015.

In a thread to the same tweet, responding to criticism, Surya had said that these were not his opinion but attributed to Tarek Fatah. He also said that he agrees with Fateh's position that 'Islamofascism was a threat to all civilsations'.

Surya could not be reached for a comment.

However, a source close to Surya, said, "This is a 2015 tweet where Tejasvi Surya was quoting Tarek Fatah from an interview. It is being wrongly attributed to him with malicious intent. The main issue being addressed in the interview was about the barbaric and inhuman practice of genital mutilation of women. If there's any person to comment on it, it has to be Tarek Fatah."

Tejasvi Surya had landed in a similar controversy soon after his nomination as a candidate just ahead of the 2019 Lok Sabha elections.

The Congress also stepped in to criticise Surya and the BJP, national spokesperson Sanjay Jha said in a tweet, “The BJP gives tickets to Pragya Singh Thakur and #TejasviSurya etc because it helps popularise their hardline bigoted political profile. But the chickens usually come home to roost. Today, India stands embarrassed, humiliated.”

Bengaluru, Mar 19: Medical Education Minister Dr Sudhakar on Wednesday said that the government is increasing the number of labs for COVID-19.

"For the last two months, screening has been done at airports. Quarantine is also being done. The situation was reviewed by the state cabinet. All passengers from abroad will be home quarantined or they can stay at government facilities or budget hotels or resorts or private hospitals," Sudhakar said in the Assembly.

"We have issued many advisories. Until 31st March, pubs, and hotels, religious events, should not have an assembly of more than 100 persons. Two bulletins will be issued twice a day. All those who arrive from abroad will be stamped that they have arrived from abroad. Covid-19 is growing at a phenomenal pace. We need not panic but we need to be cautious," he said.

Sudhakar continued: "There are 54 labs in the country. Karnataka has five labs, the most among all states. We are increasing the number of labs. In our country, we have tested less than 10 per cent. In Karnataka, we should conduct test on more people."

The minister said the government will devise a way to be able to track down all those home quarantined through their mobile phones.

"Karnataka stands fourth after Maharashtra, Kerala and Uttar Pradesh. We are in the second stage. The next 2-3 weeks are detrimental. This is a pandemic situation. People have to also take responsibility. Social distancing is the real solution and key to eradicating this COVID-19. In the larger interest of the health of the state, we have to take drastic measures," he said.

"We are now in the 2nd stage. The next 3 weeks are very important. If we take care, the state can escape what's happening worldwide," he said.

Congress MLA UT Khader demanded action against those people who do not follow rules.

"Only shutting airports will not help. What about domestic passengers? Coronavirus must come under Ayushman Bharat. Keep isolated patients away from normal people in the ICU in government hospitals. Take action against those who do not follow the rules," he said.

Congress MLA Dr Yathindras said that screening is not enough and travelers need to be lab tested.

A total of 151 positive cases of coronavirus have been reported in India so far, the Union Ministry of Health and Family Welfare said on Wednesday.

Thirteen positive cases of COVID-19 have been reported in Karnataka till today.
