Trump to sign executive order on reform of H-1B visa system

Washington, Apr 18: US President Donald Trump is set to sign an executive order that would tighten the process of issuing the H-1B visas and seek a review of the system for creating an "entirely new structure" for awarding these visas, the most sought-after by Indian IT firms and professionals.

Trump1Trump is scheduled to travel to Milwaukee, Wisconsin, the home state of House of Representatives Speaker Paul Ryan, to sign the 'Buy American, Hire American' Executive Order.

This was a transitional step aimed at achieving a more skills-based and merit-based immigration system. The executive order would be signed a day after the US Citizenship and Immigration Services (USCIS) announced that it has completed the computerised draw of lots from the 199,000 petitions it received for the Congressional mandated 65,000 H-1B visas for the fiscal year 2018 beginning October 1 this year.

The lottery was held for the 20,000 H-1B visas for those applicants having higher education from US educational institutions. Opposing the traditional lottery system for H-1B visas, a senior administration official told White House reporters that these visas were being used by companies to bring in foreign workers at a low wage rate and displace local workers.

The official argued that there were enough qualified people within the country to meet the demand of technology professionals. "With respect to the H-1B visa programme in particular, which deals mostly with STEM jobs, we graduate about twice as many STEM students each year as find jobs in STEM fields.

"The issue of training workers for skilled manufacturing jobs is a different aspect of a policy then, say, the H-1B visa, which obviously is for STEM occupations," the official said. The official argued that the reality was that the US has large numbers of unemployed American workers. "Right now we're creating an environment with our guest- worker programmes where those workers are being bypassed," the official said.

"If you make it harder to abuse the guest-worker programmes, it creates more of a market for domestic workers, as well as more of a market for the kinds of job training and vocational training programmes that you're talking about," said the official, who spoke on condition of anonymity. Trump had made the alleged abuse and fraud in H-1B visa system a major election issue during his campaign.

The executive order signed by Trump today will call for the strict enforcement of all laws governing entry into the United States of labour from abroad, for the stated purpose of creating higher wages and higher employment rates for workers in America, the official said.

"It would further call on the departments of Labour, Justice, Homeland Security and State to take prompt action to crackdown on fraud and abuse, which should both be understood as separate problems, in our immigration system in order to protect workers in the United States and their economic conditions," the official asserted.

"As a practical matter, you're creating an entirely new structure for awarding these visas. I mean, it is a completely...total transformation of the H-1B programme," the official said. According to the senior administration official, these reforms were broadly supported by groups that represent American workers in the US, and that a lot of the driving action historically for these kinds of guest-worker reforms have been from groups that in fact even tilt Democratic.

"This (executive order) would apply across the board, but in particular, the executive order has an additional clause on the H-1B visa programme, and calls on those same four departments to put forward reforms to see to it that H-1B visas are awarded to the most skilled or highest-paid applicants," the official said. Noting that right now the H-1B visas were awarded by random lottery, the official said 80 per cent of H-1B workers were paid less than the median wage in their fields.

Only about five to six per cent, depending on the year, of H-1B workers command the highest wage tier recognised by the Department of Labour, there being four wage tiers, he said. "The highest wage tier, for instance in 2015, was only five per cent of H-1B workers. So 80 per cent received less than the median wage and only 10 per cent received the median wage," he noted.

"And, so only five per cent were categorised at the highest wage tier of the four wage tiers that are in place for the H-1B guest-worker visa," the official said. The result of that is that workers are often brought in well below market rates to replace American workers, sort of violating the principle of the programme, which is supposed to be a means for bringing in skilled labour, the official said.

"And instead, you're bringing in, a lot of times, workers who are actually less skilled and lower paid than the workers that they're replacing," he stated. The official said Trump has done more to bring a national spotlight onto the abuses in the H-1B guest-worker programme than anybody in the country has at any point in recent history.

"If you change that current system that awards visas randomly without regard for skill or wage to a skills-based awarding, it makes it extremely difficult to use the visa to replace or undercut American workers. These are not bringing in workers at beneath the market wage," he said. The top three recipients of the H-1B visas, the official said, were Tata (TCS), Infosys and Cognizant.

"Some companies oftentimes are called outsourcing firms. They're like the top recipients of H-1B visa. You know, are companies like Tata (TCS), Infosys, Cognizant. They will apply for a very large number of visas; more than they get. Like putting extra tickets in the lottery raffle, if you will," the official said.

"And then they'll get the lion's share of visas," the official said. As part of the executive order, the agencies have been asked to do everything they can, he said. "But you could be looking at things on the administration side like increasing fees for H-1B visas. You could be looking at things like if we could adjust the wage scale to have a more honest reflection of what the prevailing wages actually are in these fields," the official said.

Feb 11: China reported 108 new coronavirus deaths on February 10, the highest daily toll since the outbreak began in Wuhan late last year, as two senior officials in the hard-hit province of Hubei were removed from their jobs.

The total number of deaths on the mainland reached 1,016 in the 24 hours until midnight, the National Health Commission said on Tuesday.

Some 2,478 new cases were confirmed, bringing the total to 42,638.

Of the new deaths, 103 were in the province of Hubei, including 67 in the provincial capital of Wuhan. The virus is thought to have originated there in a market that sold seafood as well as wild animals.

Two senior health officials in the province - Zhang Jin who was Party Secretary of the health commission for Hubei and Ling Yingzi who was director of the Hubei Provincial Health Commission - were both removed from their posts, state media reported on Tuesday,  a day after Chinese President Xi Jinping visited health facilities in Beijing.

In his first public appearance since the outbreak began, Xi donned a face mask and had his temperature checked while visiting medical workers and patients in the capital.

"We have seen very little of Xi Jinping since the outbreak began but he was out and about in Beijing on Monday," Al Jazeera's Katrina Yu said from Beijing. "He has been trying to rally the troops saying: 'We can win this battle.' But it's also a sign that the battle is far from over."

The other fatalities on Monday were in the provinces of Heilongjiang, Anhui and Henan and the cities of Tianjin and Beijing, the National Health Commission said.

During a meeting chaired by Premier Li Keqiang on Monday, a group of leaders tasked with beating the virus said it would work to solve raw material and labour shortages and boost supplies of masks and protective clothing.

They said nearly 20,000 medical personnel from around the country had already been sent to Wuhan, and more medical teams were also on the way.

Jakarta, Mar 15: Indonesia's transport minister is in intensive care after testing positive for the novel coronavirus, an official has said, as schools and tourist attractions were ordered to close over the health threat.

Transportation Minister Budi Karya Sumadi was receiving treatment at an army hospital in Jakarta, State Secretary Pratikno said on Saturday.

A hospital spokesman said Sumadi was encountering difficulty breathing but that his condition was improving.

Pratikno said Sumadi was involved in virus mitigation efforts, particularly the evacuation of Indonesians from epicenters of the outbreak, and that President Joko Widodo had called for tests to be carried out on other ministers.

Cases of the virus in Indonesia, the world's fourth most populous country, have jumped from zero two weeks ago to 96, with five deaths, according to government spokesperson Achmad Yurianto.

He also said the virus has spread outside Greater Jakarta to Bandung in West Java, Solo in Central Java, Manado in North Sulawesi, Pontianak in West Kalimantan, as well as holiday havens Yogyakarta and Bali.

Following the increase, the government on Saturday established a task force on COVID-19 mitigation.

Jakarta's Governor Anies Baswedan announced that schools would close for two weeks starting Monday, and ordered the closure of city-owned tourist attractions, such as Ragunan Zoo and Ancol beach.

He emphasized that Jakarta would not be locked down but urged people "to be responsible" and called for social distancing when possible.

Similarly, the administration of Solo, Central Java, Friday announced that schools and tourist attractions would close after a coronavirus patient died in the region.

The World Health Organization has said it is particularly concerned about high-risk nations with weaker health systems, which who may lack the facilities to identify cases.

A day after declaring the coronavirus outbreak to be pandemic this week, WHO chief Tedros Adhanom Ghebreyesus called Indonesia's president Widodo and both agreed to "scale up cooperation."

Seoul, Apr 15: Wearing masks and gloves, South Korean voters cast their ballots on Wednesday to elect 300 parliamentary lawmakers amid the coronavirus outbreak.

Voting kicked off at 6 am (local time) and was to run until 6 pm (local time) at 14,330 polling stations across the country, according to the National Election Commission (NEC). The number of eligible voters is 44 million, according to Yonhap news agency.

The once-in-four-years legislative election is widely seen as a referendum on President Moon Jae-in, whose five-year term will end in mid-2022, as well as a test of the country's fight against COVID-19 under the leadership of Moon, The Strait Times reported.

South Korea has received international praise for its massive testing capability and other innovative measures, such as drive-through testing and high-tech contact tracing.

Experts, therefore, expect the ruling Democratic Party (DP) to extend its lead in Parliament, given that the government's handling of the virus outbreak is viewed positively both at home and abroad, as per The Strait Times.

At least 10,564 people in the country have been infected by coronavirus, which has claimed 222 lives. About 2,800 patients are undergoing treatment.

The number of new cases has fallen from a high of 813 on February 29 to below 50 for six days in a row as an intensive social distancing campaign that started on March 21 remained in place.

Several surveys cited by the newspaper also showed that voters consider the pandemic as the biggest factor in their decision. A recent poll showed that 72.6 per cent of respondents rated the government's response to the outbreak as positive.

The NEC has said that public safety at polling stations will be a priority to prevent any possible spread of the virus.

All 14,330 polling stations and 251 counting stations will be disinfected on polling day, the NEC was quoted.

Voters will undergo temperature screening and those registering temperatures of 37.5 degrees Celsius or higher or display respiratory symptoms will have to exercise their franchise at a separate booth.

Tuesday was the last of 13 days of campaigning, which saw most candidates reducing their ground activities and face-to-face encounters with voters. Instead, the candidates boosted their online presence with videos and social media engagements in a bid to win votes, according to The Strait Times.

In addition, the government has also decided to temporarily lift quarantine rules to permit self-isolators to vote in the elections. Some 50,000 people in self-isolation who have no symptoms and expressed a willingness to vote will be allowed to cast ballots after the regular voting ends in the evening.
