Trump's revised travel ban blocks new visas for 6 Muslim-majority nations

Washington, Mar 7: President Donald Trump signed a new travel ban Monday that administration officials said they hope will end legal challenges over the matter by imposing a 90-day ban on the issuance of new visas for citizens of six majority-Muslim nations.

In addition, the nation's refugee program will be suspended for 120 days, and it will not accept more than 50,000 refugees in a year, down from the 110,000 cap set by the Obama administration.

Trump signed the new ban out of public view, according to White House officials. The order will not take effect until March 16, officials said.

The new guidelines mark a dramatic departure from Trump's original ban. They lay out a far more specific national security basis for the order, block the issuance of only new visas, and name just six of the seven countries included in the first executive order, omitting Iraq.

The order also details specific sets of people who would be able to apply for case-by-case waivers to the order, including those previously admitted to the United States for "a continuous period of work, study, or other long-term activity," those with "significant business or professional obligations" and those seeking to visit or live with family.

"This executive order responsibly provides a needed pause, so we can carefully review how we scrutinize people coming here from these countries of concern," Attorney General Jeff Sessions said in announcing that the order had been signed.

Even before the ink was dry, though, Democrats and civil liberties groups asserted that the new order was legally tainted in the same way as the first one: It was a thinly disguised Muslim ban.

"While the White House may have made changes to the ban, the intent to discriminate against Muslims remains clear," said New York Attorney General Eric Schneiderman, D, who had joined the legal fight against the first ban. "This doesn't just harm the families caught in the chaos of President Trump's draconian policies - it's diametrically opposed to our values, and makes us less safe."

Said Omar Jadwat, director of the ACLU's Immigrants' Rights Project: "The only way to actually fix the Muslim ban is not to have a Muslim ban. Instead, President Trump has recommitted himself to religious discrimination, and he can expect continued disapproval from both the courts and the people."

State Department, Homeland Security and Justice Department officials defended the new order as a necessary measure to improve public safety. They said the countries implicated - Iran, Sudan, Somalia, Libya, Syria and Yemen - were either state sponsors of terrorism, or their territories were so compromised that they were effectively safe havens for terrorist groups. Iraq was omitted, Secretary of State Rex Tillerson said, because it is an "important ally in the fight to defeat ISIS," and its leaders had agreed to implement new security measures.

A Department of Homeland Security official, speaking on the condition of anonymity on a call with reporters, said Iraq was "treated differently" in part because the country had agreed to "timely repatriation" of its citizens if they were ordered deported from the United States.

The new order provides other exceptions not contained explicitly in previous versions: for travelers from those countries who are legal permanent residents of the United States, dual nationals who use a passport from another country and those who have been granted asylum or refugee status. Anyone who holds a visa now should be able to get into the country without any problems, though those whose visas expire will have to reapply, officials said.

The order claims that since 2001, hundreds of people born abroad have been convicted of terrorism-related crimes in the United States, and that more than 300 people who entered the country as refugees were the subject of counterterrorism investigations. It cites two specific examples: Two Iraqi nationals who came to the United States as refugees in 2009, it says, were convicted of terrorism-related offenses, and in October 2014, a Somali native brought to the country as a child refugee was sentenced to 30 years in prison for plotting to detonate a bomb at a Christmas tree-lighting ceremony in Oregon. That man became a naturalized U.S. citizen.

"We cannot risk the prospect of malevolent actors using our immigration system to take American lives," Homeland Security Secretary John F. Kelly said.

U.S. officials declined to specify the countries of origin of the 300 refugees now being investigated in terrorism cases, and they declined to detail those people's current immigration status.

A Department of Homeland Security report assessing the terrorist threat posed by people from the seven countries covered by President Trump's original travel ban had cast doubt on the necessity of the executive order, concluding that citizenship was an "unreliable" threat indicator and that people from the affected countries have rarely been implicated in U.S.-based terrorism.

The Department of Homeland Security official, speaking on the condition of anonymity, criticized the report as being incomplete and not vetted with other agencies, and he asserted that the administration should not be pressed by the judiciary to unveil sensitive national security details to justify the ban.

"This is not something that the Department of Justice should have to represent to a federal district court judge," the official said.

The order represents an attempt by the Trump administration to tighten security requirements for travelers from nations that officials said represent a terrorism threat. A more sweeping attempt in January provoked mass protests across the country as travelers en route to the United States were detained at airports after the surprise order was announced. The State Department had provisionally revoked tens of thousands of visas all at once.

Officials sought to dismiss the idea that there would be any confusion surrounding the implementation of the new order. Officials said they delayed implementation so the government could go through the appropriate legal processes and ensure that no government employee would face "legal jeopardy" for enforcing the order.

"You should not see any chaos, so to speak, or alleged chaos, at airports. There aren't going to be folks stopped tonight from coming into the country because of this executive order. If they are, it's pursuant to our ordinary screening procedures," the Department of Homeland Security official said. "We're going to have a very smooth implementation period."

A federal district judge in Washington state first suspended the travel ban Feb. 3, and a three-judge panel of the U.S. Court of Appeals for the 9th Circuit later upheld that freeze.

That setback was a blow to the White House, which was criticized for failing to include lawmakers and stakeholders in its deliberations.

The revisions to the order will make it more defensible in court - limiting the number of people with standing to sue - though the changes might not allay all the concerns raised by judges across the country. The three-judge panel with the 9th Circuit Court of Appeals, for example, said that exempting green-card and current visa holders from the ban would not address their concern about U.S. citizens with an interest in noncitizens' travel.

The administration, too, will have to wrestle with comments by the president and top adviser Rudolph Giuliani that seemed to indicate the intent of the order was to ban Muslims from entering the United States, which could run afoul of the Establishment Clause of the First Amendment.

On the campaign trail, Trump called for a "total and complete shutdown of Muslims entering the United States." After the election, Giuliani, a former New York City mayor, said: "So when [Trump] first announced it, he said, 'Muslim ban.' He called me up. He said, 'Put a commission together. Show me the right way to do it legally.' "

A federal judge in Virginia referenced those comments in ordering the ban frozen with respect to Virginia residents and institutions, calling it "unrebutted evidence" that Trump's directive might violate the First Amendment.

Feb 26: Looking out over the world’s largest cricket stadium, the seats jammed with more than 100,000 people, India’s prime minister heaped praise on his American visitor.

“The leadership of President Trump has served humanity,” Prime Minister Narendra Modi said Monday, highlighting Trump’s fight against terrorism and calling his 36-hour visit to India a watershed in India-U.S. relations.

The crowds cheered. Trump beamed.

“The ties between India and the U.S. are no longer just any other partnership,” Modi said. “It is a far greater and closer relationship.”

India, it seems, loves Donald Trump. It seemed obvious from the thousands who turned out to wave as his motorcade snaked through the city of Ahmedabad, and from the tens of thousands who filled the city’s new stadium. It seemed obvious from the hug that Modi gave Trump after he descended from Air Force One, and from the hundreds of billboards proclaiming Trump’s visit.

But it’s not so simple.

Because while Trump is genuinely popular in India, his clamorous and carefully choreographed welcome was also about Asian geopolitics, China’s growing power and a masterful Indian politician who gave his American visitor exactly what he wanted.

Modi “is doing this not necessarily because he loves Trump,” said Tanvi Madan, the director of the India Project at the Brookings Institution in Washington, D.C. “It’s very much about Trump as the leader of the U.S. and recognizing what it is that Trump himself likes.”

Trump likes crowds — big crowds — and the foot soldiers of India’s political parties have long known how to corral enough people to make any politician look popular. In a city like Ahmedabad, the capital of Modi’s home state of Gujarat and the center of his power base, it wouldn’t take much effort to fill a cavernous sports stadium. It was more surprising that a handful of seats remained empty, and that some in the stands had left even before Trump had finished his speech.

For India, good relations with the U.S. are deeply important: They signal that India is a serious global player, an issue that has long been important to New Delhi, and help cement an alliance that both nations see as a counterweight to China’s rise.

“For both countries, their biggest rival is China,” said John Echeverri-Gent, a professor at the University of Virginia whose research often focuses on India. “China is rapidly expanding its presence in the Indian Ocean, which India has long considered its backyard and its exclusive realm for security concerns.”

“It’s very clearly a major concern for both India and the United States,” he said.

Trump isn’t the first U.S. president that Modi has courted. In 2015, then-President Barack Obama was the first American chief guest at India’s Republic Day parade, a powerful symbolic gesture. Obama also got a Modi hug, and the media in both countries were soon writing about the two leaders’ “bromance.”

Trump is popular in India, even if some of that is simply because he’s the U.S. president. A 2019 Pew Research Center poll showed that 56% of Indians had confidence in Trump’s abilities in world affairs, one of only a handful of countries where he has that level of approval. But Obama was also popular: Before he left office, he had 58% approval in world affairs among Indians.

The Pew poll also indicated that Trump’s support was higher among supporters of Modi’s Hindu nationalist party.

That’s not surprising. Both men have fired up their nationalist bases with anti-Muslim rhetoric and government policies, from Trump’s travel bans to Modi’s crackdown in Kashmir, India’s only Muslim-majority state.

And Trump’s Indian support is far from universal. Protests against his trip roiled cities from New Delhi to Hyderabad to the far northeastern city of Gauhati, although those demonstrations were mostly overshadowed by protests over a new Indian citizenship law that Modi backs.

Modi, who is widely popular in India, has faced weeks of protests over the law, which provides fast track naturalization for some foreign-born religious minorities — but not Muslims. While Trump talked about ties with India on Tuesday, Hindus and Muslims fought in violent clashes that left at least 10 people dead over two days.

In some ways, Modi and Trump are powerful echoes of each other.

They have overlapping political styles. Both are populists who see themselves as brash, rule-breaking outsiders who disdain their countries’ traditional elites. Both are seen by their critics as having authoritarian leanings. Both surround themselves with officials who rarely question their decisions.

But are they friends?

Trump says yes. “Really, we feel very strongly about each other,” he said at a New Delhi press briefing.

But many observers aren’t so sure.

“The question is how much of this is real chemistry, as opposed to what I’d call planned chemistry” orchestrated for diplomatic reasons, said Madan. “It’s so hard to know if you’re not in the room.”

Certainly, Modi understands America’s importance to India. While the two countries continue to bicker about trade issues, the prime minister organized a welcome that impressed even India’s news media, which have watched countless choreographed mass political rallies.

“There is no other country for whose leader India would hold such an event, and for which an Indian prime minister would lavish such rhetoric,” the Hindustan Times said in an editorial.

“The spectacle and the sound were worth a thousand agreements.”

Beijing, Jun 17: China said Wednesday it wanted to avoid further clashes with India along their border after the first deadly confrontation between the two nuclear powers in decades.

The two countries have traded blame for Monday's high-altitude brawl that left at least 20 Indian soldiers dead, with China refusing to confirm so far whether there were any casualties on its side.

Chinese foreign ministry spokesman Zhao Lijian insisted again Wednesday that it was Indian troops who illegally crossed the border and attacked the Chinese side.

This led to "a serious physical confrontation between both sides that caused deaths and injuries", Zhao said at a regular briefing, without providing more details about the casualties.

He said China urges India to "strictly restrain frontline troops, do not illegally cross the border, do not make provocative gestures, do not take any unilateral actions that will complicate the border situation".

But he added that the two sides "will continue to resolve this issue through dialogue and negotiations".

"We of course don't wish to see more clashes," Zhao said.

For the first time in the 15 years of the Global Risks Report, the climate change and environment risk has occupied all the top five slots.

According to the 15th edition of the World Economic Forum's (WEF) Global Risks Report, the top five risks in terms of likelihood are extreme weather, climate action failure, natural disasters, biodiversity loss and human-made environmental disasters. They all fall in the one category of climate change and related environmental disasters.

WEF President Borge Brende said the world was feeling long-mounting and interconnected risks.

The report also points to how citizens are protesting across the world as discontent rises with failed systems that are creating inequality. The citizens' discontent had hardened with systems that had failed to promote advancement, it said.

"Disapproval of how governments are addressing profound economic and social issues has sparked protests throughout the world, potentially weakening the ability of governments to take decisive action should a downturn occur. Without economic and social stability, countries could lack the financial resources, fiscal margin, political capital or social support needed to confront key global risks," it said.

Listing the grim scenario, Borge said the global economy was faced with "synchronised slowdown", the past five years had been the warmest on record and cyber attacks were expected to increase this year.

The report warns that while the myriad risks were rising, time was running out on how to prevent them.

Borge said the growing palpability of shared economic, environmental and societal risks indicated that the horizon had shortened for preventing "or even mitigating" some of the direst consequences of global risks.

"It's sobering that in the face of this development, when the challenges before us demand immediate collective action, fractures within the global community appear to only be widening," he said.

The report points to grave concern about the consequences of continued environmental degradation, including the record pace of species decline.

Pointing to an unsettled geopolitical environment, the report said today's risk landscape was one in which new centres of power and influence were forming and old alliance structures and global institutions were being tested.

"While these changes can create openings for new partnership structures in the immediate term, they are putting stress on systems of coordination and challenging norms around shared responsibility. Unless stakeholders adapt multilateral mechanisms for this turbulent period, the risks that were once on the horizon will continue to arrive," it said.

Calling it a "an unsettled world", the WEF report notes that powerful economic, demographic and technological forces were shaping a new balance of power. "The result is an unsettled geopolitical landscape in which states are increasingly viewing opportunities and challenges through unilateral lenses," it said.

"What were once givens regarding alliance structures and multilateral systems no longer hold as states question the value of long-standing frameworks, adopt more nationalist postures in pursuit of individual agendas and weigh the potential geopolitical consequences of economic decoupling. Beyond the risk of conflict, if stakeholders concentrate on immediate geo-strategic advantage and fail to re-imagine or adapt mechanisms for coordination during this unsettled period, opportunities for action on key priorities may slip away," the WEF said.

In a chapter on risks to economic stability and social cohesion, it said a challenging economic climate might persist this year and members of the multi-stakeholder community saw "economic confrontations" and "domestic political polarisation" as the top risks in 2020.

The report also warned of downward pressure on the global economy from macroeconomic fragilities and financial inequality. These pressures continued to intensify in 2019, increasing the risk of economic stagnation.

Low trade barriers, fiscal prudence and strong global investment, once seen as fundamentals for economic growth, are fraying as leaders advance nationalist policies. The margins for monetary and fiscal stimuli are also narrower than before the 2008-2009 financial crisis, creating uncertainty about how well countercyclical policies will work.

The strategic partners for the WEF report included Marsh & McLennan and Zurich Insurance Group. The academic advisers were National University of Singapore, Oxford Martin School, University of Oxford and Wharton Risk Management and Decision Processes Center, University of Pennsylvania.
