Uber received complaint about rape accused driver from another woman

December 10, 2014

Uber cab driverNew Delhi, Dec 10: A US-based woman came forward on Tuesday saying she had filed a complaint with Uber against the driver, accused of raping a 25-year-old executive, almost a week ago. However, no action was taken by the app-based cab hailing service, she alleged.

Shiv Kumar Yadav has been sent to police custody after the reported attack on Friday, when the woman said he raped her in his taxi, threatened to insert a metal rod inside her and ordered her not to tell authorities about the incident.

Nidhi Shah, who took Yadav's cab on November 26, first revealed her experience with Yadav on Twitter. In a series of tweets, Shah posted pictures of the taxi receipt, which had the driver's name written on it, and of her email complaint to Uber.

"I took a cab with Shiv Kumar Yadav in Delhi on November 26, scares me beyond belief," Shah tweeted.

"I had reported Him to Uber. They replied via email that they would check on him," she wrote.

"I was coming from Chandni Chowk and the driver started staring at me and giving me lecherous glances. He kept smiling at me and looking at me using the rare view mirror. The situation became so bad that I had to hide behind the seat to avoid his stares. I later filed a written complaint with Uber but no action was taken against the driver," said Shah told NDTV.

She said she received a reply from Uber saying "someone will have a chat with the driver", but there was no further follow-up.

Shah went back to the US few days after the incident but said that the laid back attitude of people encourages such perpetrators.

"I blame myself for not taking the complaint seriously. Maybe if I had insisted on stricter action, the (rape) incident could have been avoided," she told the TV channel.

Uber's head of Asia operations Allen Penn told Hindustan Times his firm is deeply sorry for the woman who was sexually assaulted and will do everything to support her family.

When asked whether they check the antecedents of the drivers, Penn said his company checks vehicles and all documents in person when a driver registers with them.

"We check drivers license, commercial vehicle registration and banking information. We get that for all the drivers. We have had frequent communication with the police and we hope justice is brought. We know the documents that are required. All payments to drivers are made electronically to their bank accounts. Banks have KYC for all account holders. We will see what else can we do. We will continue to improve."

The 32-year-old has emerged as a notorious serial sexual offender and also got bail in other cases, including one that charged him with illegal possession of a gun.

Yadav was arrested in Mainpuri in 2013 on rape charges but released on bail six months later. Delhi Police have already revealed his involvement in another previous case of rape in 2011, for which he spent seven months in Tihar jail but was let off after the case fell.

Official records show Yadav has a string of criminal complaints against him, including two molestation cases, but managed to obtain a character reference signed by a police officer that appeared to have been forged.

Hyderabad, Jun 20: IAF Chief Air Chief Marshal RKS Bhadauria on Saturday said that the force is well prepared and suitably deployed to respond to any contingency and it will never let the sacrifice of the bravehearts of Galwan go in vain.

"It should be very clear that we are well prepared and suitably deployed to respond to any contingency. I assure the nation that we are determined to deliver and will never let the sacrifice of the braves of Galwan go in vain," IAF Chief Air Chief Marshal Bhadauria said here.

Bhadauria was speaking at the Combined Graduation Parade (CGP) at Air Force Academy in Hyderabad.

His remarks come days after 20 Indian soldiers lost their lives in the violent face-off on June 15-16 during an attempt by the Chinese troops to unilaterally change the status quo during the de-escalation in eastern Ladakh.

Speaking about the current border situation with China, he said: "We are aware of the situation, be it on LAC or beyond, be it their air deployments, their posture and kind of deployments. We've full analysis and we have taken necessary action that we need to take to handle any contingency that may come up."

"We are monitoring all the moments and we are aware of the full situation," he added.

He further said that in spite of the "unacceptable Chinese action" at Galwan Valley in eastern Ladakh, which claimed lives of 20 Indian Army personnel, efforts are underway to ensure that the current situation at the Line of Actual Control (LAC) is resolved peacefully.

He asserted that the IAF is determined to deliver and the development at the LAC in Ladakh is a small snapshot of what the force is required to handle at short notice.

The IAF Chief further appealed to people to join him in paying tribute Colonel Santosh Babu and his brave men who made the sacrifice while defending the LAC in Galwan valley.

"The gallant actions in a highly-challenging situation have demonstrated our resolve to protect India's sovereignty at any cost," the Indian Air Force (IAF) chief said.

Bhopal, Mar 12: The Madhya Pradesh Congress on Thursday took a dig at Jyotiraditya Scindia, who broke ranks with the party and joined BJP on Wednesday, by pointing out that neither Prime Minister Narendra Modi nor Amit Shah had not even put out as much a tweet to welcome him in the party, and construed it as "humiliation" for the "maharaja".

"Not even a tweet by Narendra Modi-ji or Amit Shah-ji to welcome Scindia-ji! Modi-ji, Shah-ji, at least do not do it so soon. It has not even been 24 hours yet and you guys have already started humiliating him...!" Madya Pradesh Congress tweeted in Hindi.

Taking a jibe at Mr Scindia, a member of the erstwhile royal family of Gwalior who ended his 18-year-long association with the Congress party on a bitter note, the state Congress said: "He is a maharaja, the one whose history is often mentioned by Shivraj-ji (former Madhya Pradesh Chief Minister Shivraj Singh Chouhan)."

On Wednesday, Jyotiraditya  Scindia joined BJP in New Delhi in the presence of party president JP Nadda. He had resigned from Congress a day earlier after meeting Amit Shah and Prime Minister Narendra Modi.

Mr Scindia will file his nomination for the Rajya Sabha elections on March 13. He is expected to go to Bhopal today.

Mar 11: Thirteen of the 22 rebel MLAs in Madhya Pradesh have given an assurance that "they are not leaving the Congress", senior party leader Digvijaya Singh said on Thursday while expressing confidence that the Kamal Nath-led government in the state will win a floor test.

"We are not keeping quiet. We are not sleeping," Singh told PTI, a day after Congress leader from the state Jyotiraditya Scindia quit the Congress and 22 MLAs submitted their resignations from the assembly in Madhya Pradesh.

Scindia was offered the post of Madhya Pradesh deputy chief minister but wanted his nominee, Singh said. However, Kamal Nath refused to accept a "chela", he said.

Scindia, he said, could have been a Congress nominee to the Rajya Sabha but "only Modi-Shah" can give a Cabinet post to the "over-ambitious" leader.
