Uphaar fire: SC asks Ansal brothers to pay Rs 60 crore; no jail

New Delhi, Aug 20: The Supreme Court on Wednesday imposed a hefty fine of Rs 60 crore on Ansal brothers - Gopal and Sushil – who had been earlier convicted in the 1997 Uphaar fire tragedy case.

uphaarThe Supreme Court, however, ruled no jail term for the Uphaar cinema hall owners. The fine imposed on them has to be paid within three months. Each of the brothers will have to pay a fine of Rs 30 crore to the Delhi government within three months, the three-judge bench of the apex court ruled.

As per reports, two members of the three-judge bench hearing the case disagreed on the sentencing of the Ansal brothers.

Of the two brothers, Sushil Ansal had served a jail term of 5 months and 22 days and Gopal Ansal, 142 days.

Earlier during the hearing, the apex court said that the case of their conviction in the Uphaar fire tragedy can't be reopened and hearing will remain focussed on their sentencing.

Ansals' lawyer Ram Jethmalani had pleaded before the apex court to argue on facts relating to Ansals' conviction.

The apex court bench, however, asked him to raise it in a review petition later.

On March 5 last year, the Supreme Court had upheld the conviction of Gopal and Sushil Ansal in 1997 Uphaar fire tragedy case.

The Supreme Court then deferred decision on quantum of sentence for Ansal brothers and transferred the case to a three-judge bench.

Earlier, the high court had reduced their sentence from two years to one year whereas the CBI and victims of the fire tragedy had demanded that the Ansals be convicted under more stringent sections.

A total of 59 people died and 100 were injured when there was a big fire at Uphaar cinema hall, in the heart of south Delhi, while a film was being screened on the evening of June 13, 1997. The fire started in the parking lot and then engulfed the building in the busy Green Park area - most people died in the ensuing stampede or were asphyxiated.

In 2003, the Delhi High Court awarded compensation of Rs 18.5 crores to be paid - Rs 18 lakh to the next of kin of each victim above 20 years of age; Rs 15 lakh for victims below 20 years of age; and Rs 1 lakh each to the injured. The court ordered that this be paid with nine percent interest.

Mumbai, Jan 18: Maharashtra Tourism Minister Aaditya Thackeray on Friday said shops, restaurants, malls and pubs will remain open 24 hours on an experimental basis in a few areas of Mumbai from January 26.

The areas where these establishments will remain open all night are Fort and Kala Ghoda in south Mumbai and Bandra Kurla Complex in the west.

Thackeray had batted for all-night-open eateries and other establishments in the city during the earlier BJP-Shiv Sena regime too.

Thiruvananthapuram, Apr 27: BJP's Kerala state President K Surendran on Monday said it is 'highly irresponsible' of Chief Minister Pinarayi Vijayan to not attend PM's video conference with all chief ministers on prevailing COVID-19 situation earlier today.

"The Kerala Chief Minister not attending the important conference regarding a pandemic in the country is not good for the state," Surendran said.

The BJP state President believes Vijayan has sent a wrong message by not attending the conference.

"It is the irresponsible behavior of the Chief Minister. Prime Minister Narendra Modi says that team India is fighting this pandemic together. By not attending the meeting, the Kerala CM has sent a wrong message, " he added.

Surendran said that the meeting was of high priority as PM was meeting the state CM's regarding the important decision of lockdown in the country.

"From the last meeting, many things have changed. Other chief ministers who did not get a chance to speak, participated in the meeting. But Kerala CM chose not to attend the meeting and BJP condemns it, " he said.

Kerala CM Pinarayi Vijayan had not participated in the PM's video conference held earlier today and instead Kerala Chief Secretary Tom Jose represented the state in the meet.

According to sources, Kerala has given its suggestions in writing.

This was the fourth such interaction of the Prime Minister with the Chief Ministers, the earlier ones had been held on March 20, April 2, and April 11.

PM Modi in the meeting said the lockdown has yielded positive results as the country has managed to save thousands of lives in the past one and a half months.

Mumbai, Jul 14: Bhima Koregaon case accused Varavara Rao was admitted to JJ Hospital in Mumbai on Monday night.

Rao who is in Taloja proson was rushed to the hospital following complaint of dizziness.

Rao was arrested in November 2018 along with five others, for alleged links with Naxals and for inciting the violence.

On January 1, 2018, the violence at Bhima Koregaon village in Pune district left one dead and several others injured including 10 policemen.

Violence erupted after some people, reportedly with saffron flags, pelted stones at cars heading towards the village for the commemoration of 200 years of Bhima-Koregaon war on New Year's Day.

The police had filed 58 cases against 162 people.
