US court asks Sonia Gandhi to show passport

Sonia_GandhiNew York, Mar 21: A US court has asked Congress Party president Sonia Gandhi to provide a copy of her passport to show that she was not in the US between Sep 2 and Sep 9 last year.

Gandhi had filed a motion in a federal court in Brooklyn, New York, seeking dismissal of a human rights violation case against her relating to the 1984 anti-Sikh riots, asserting she had not been served the summons as she was not in the US during that time.

However, holding that Sonia Gandhi's January 10 declaration is insufficient to prove her absence from US, Judge Brian M. Cogan of Brooklyn Court Thursday asked her to "provide a copy of her passport, showing her most recent entry and exit stamps into and out of the United States."

"This would appear to obviate both the need for any documents from the hospital-resolving defendant's medical privacy concerns - and the need to rely upon a third party government agency like Customs and Border Protection", the order states.

"Whatever form this evidence takes, defendant must provide it by April 7, 2014" Cogan ordered.

In his March 20 order the Judge said "the court cannot find that a sufficient showing of non-presence has been made based on the affirmation without plaintiffs having received some discovery to confirm it".

"The defendant must provide some documentary evidence to corroborate her otherwise unsupported declaration stating that she was not in the United States at the time of service", he said.

The 1984 human rights violation case against Gandhi hinges on the issue whether she was served on Sep 9 as claimed by Sikhs for Justice (SFJ) or she was not present in the US during that time as per her claim.

SFJ claims that on Sep 9, it had served the summons and complaint on the hospital and security staff at Memorial Sloan-Kettering Cancer Centre in New York where Sonia Gandhi was believed to be undergoing medical treatment.

The Brooklyn court had in Sep 2013 issued summons against Gandhi on the complaint filed by SFJ and some victims of anti-Sikh violence in India in November 1984.

The group has sought compensatory and punitive damages against Gandhi for her alleged role in shielding and protecting Congress party leaders including Kamal Nath, Sajjan Kumar and Jagdish Tytler from prosecution for their alleged role in the 1984 violence

New Delhi, Feb 3: Union minister Prakash Javadekar on Monday said Delhi Chief Minister Arvind Kejriwal had called himself an "anarchist" and there is not much of a "difference between an anarchist and a terrorist".

His remarks come a few days after the Election Commission issued a show cause notice to BJP MP Parvesh Verma for allegedly calling Kejriwal a "terrorist".

Addressing a press conference here, Javadekar raked up the issue of Kejriwal "staying a night at the Moga residence of Khalistan Commando Force chief Gurinder Singh during the Punjab Assembly polls".

"You knew it was a militant's house. Still, you stayed there. How much more evidence do you need?" he said.

"Kejriwal is now asking with a sad face, 'am I a terrorist?' You are a terrorist and there is a lot of evidence to prove that. You yourself had said you are an anarchist. There is not much of a difference between an anarchist and a terrorist," the senior BJP leader said.

Flanked by Delhi BJP chief Manoj Tiwari and Union minister Anurag Thakur, Javadekar said the Aam Aadmi Party (AAP) was supporting Shaheen Bagh, where slogans of "Assam ko azadi", "Jinnah wali azadi" were being raised. "Supporting such slogans is also terrorism".

He alleged that Kejriwal stood with Jawaharlal Nehru University (JNU), where "anti-India slogans were raised, and did not grant sanction to prosecute (those who raised the slogans)".

"On January 26, you threatened that you would stop their prosecution. How much more proof do you need? The people of Delhi now know that you are the chief of liars, you are an anarchist and sympathise with terrorists.

"You are supporting Shaheen Bagh, JNU, the slogans being raised there and all such anarchists...then you are definitely a terrorist. This is your identity, no matter how innocent face you make," he said.

On Thursday, the Election Commission had issued a show cause notice to Verma, the BJP MP from West Delhi, for allegedly calling Kejriwal a "terrorist".

He was earlier barred from campaigning for 96 hours (four days) for making controversial remarks at a poll meet recently.

An emotional Kejriwal had later said it was for the people of Delhi to decide whether they consider him their son, brother, or a terrorist.

"How have I become a terrorist? I've arranged for medicines...did so much for the needy. I've never thought of myself or my family... am ready to give my life for the nation," he had said at a press conference.

New Delhi, Feb 23: Dreaded underworld don Ravi Pujari, operating from overseas, has been reportedly arrested in South Africa and efforts are on for his deportation to India.

Pujari, who parted ways with underworld don Chhota Rajan, had jumped bail from Senegal, last year and had escaped to South Africa, where he was involved in big-time drug trafficking and extortion racket.

Sources in Indian Intelligence said that Ravi Pujari, who was hiding with a false identity of Anthony Fernandes, a Burkina Faso passport holder, was located in a remote village in South Africa.

On a tip-off from Indian external intelligence agency, the Senegal police air dashed South Africa last week. Pujari, 52, wanted in over 200 cases of heinous crimes, including murder and extortion, was detained with the help of South African agencies.

Sources in Mumbai Police said that Pujari's arrest has not yet been confirmed officially but Ministry of External Affairs is in touch with its mission in South Africa. An official in MEA refused to speak on the issue. Embassy of Senegal in Vasant Vihar, New Delhi, also did not respond to IANS' queries in connection with Pujari's arrest.

The mafioso first came into news in early 2000 when he started extorting huge amounts from famous Bollywood personalties and builders. He was involved in an attempt to murder case, aimed at killing a prominent lawyer of Mumbai.tip-off

Pujari's wife Padma and three children also fled India and some of them hold Burkina Faso passport. His son who was recently married in Australia reportedly holds an Australian passport.

Earlier last year Ravi Pujari, living under the identity of Anthony had jumped bailed from a Senegal court through fraudulent means. IANS had accessed the don's new passport. Pujari now goes under the name of Anthony Fernandes and is a citizen of Burkina Faso, a West African country, his date of birth is shown as 25.1.1961.

Pujari, a movie junkie influenced by Amitabh Bachchan's portrayal as Anthony Gonsalves in 'Amar Akbar Anthony' was using the name, Anthony Fernandes. This passport was issued on 10.7.2013 and is valid till 8.7.2023. The passport showed his profession as Agent Commercial which means that he is designated as a businessman running a chain of restaurants Namaste India in Senegal, Burkina Faso and neighbouring countries.

Pujari's lawyers in Senegal had argued in the court citing that he is Anthony Fernandes, a businessman from Burkina Faso as mentioned in his passport and not a fugitive as claimed by the Indian Government.

Clearly indicating a collision between top government functionaries of Burkina Faso and Pujari in which an influential Indian businessman, who is his partner in a restaurant chain, may have played the role of a conduit.

New Delhi, Jan 24: The Election Commission of India on Friday told the Supreme Court that its 2018 direction asking poll candidates to declare their criminal antecedents in electronic and print media has not helped curb criminalisation of politics. The poll panel suggested that instead of asking candidates to declare criminal antecedents in the media, political parties should be asked not to give tickets to candidates with criminal background.

A bench of Justices R F Nariman and S Ravindra Bhat asked the ECI to come up with a framework within one week which can help curb criminalisation of politics in nation's interest.

The top court asked the petitioner BJP leader and advocate Ashiwini Upadhyay and the poll panel to sit together and come up with suggestions which would help him in curbing criminalisation of politics.

In September 2018, a five-judge Constitution bench had unanimously held that all candidates will have to declare their criminal antecedents to the Election Commission before contesting polls and had called for a wider publicity, through print and electronic media about antecedents of candidates.
