Uttarakhand crisis: HC dismisses petition of 9 disqualified Congress MLAs

Nainital, May 9: In a boost to sacked Chief Minister Harish Rawat, the Uttarakhand High Court today dismissed the petition of nine Congress MLAs against their disqualification, a decision that will bar them from participating in the confidence vote proceedings in the Assembly tomorrow.

Uttarakhand Justice U C Dhyani pronounced his order on the petition challenging Speaker Govind Singh Kunjwal's decision disqualifying them after they joined hands with the BJP during proceedings on the Appropriation Bill on March 18.

Today's order of the high court ensures that their disqualification stays and will keep the rebel MLAs out of the proceedings during the confidence vote for Rawat in the Assembly tomorrow ordered by the Supreme Court last week.

Ordering a floor test on May 10 in the Assembly, the Supreme Court had said "if they (disqualified MLAs) have the same status" at the time of vote of confidence, they cannot participate in the House.

A specially convened two-hour-long session during which the President's Rule will be kept in abeyance will be held between 11 AM and 1 PM for a "single agenda" of floor test, a bench of Justices Dipak Misra and Shiva Kirti Singh had said.

The apex court had said, "However, our observation in praesenti will not cause any kind of prejudice to the merits of the case of disqualified Members of Legislative Assembly, which is sub-judice before the High Court."

The proceedings were directed to be "video-graphed" by the apex court which said the confidence vote will take place by division under the watch of the Principal Secretary, Legislative Assembly.

The top court said before the floor test will be initiated, the President rule will be kept in abeyance from 10:30 AM to 0100 PM and during that period the Governor shall remain in-charge of the State.

It said the result of the voting shall be placed before it at 10:30 AM on May 11, 2016, in a sealed cover by the Principal Secretary, Legislative Assembly who will come with the documents in a sealed cover and the video recording of the proceedings.

At present, in the 70-member assembly, BJP has 28 MLAs, Congress has 27, BSP has 02, while there are three independent MLAs and one belongs to Uttarakhand Kranti Dal (P) lawmaker. Nine Congress MLAs are disqualified and one is a BJP rebel.

After CAA, Centre might bring population control law: Niranjan Jyoti

Mathura, Mar 2: Union Minister of state Sadhvi Niranjan Jyoti on Sunday said after the Citizenship (Amendment) Act (CAA), the Centre might bring a population control law.

Jyoti claimed that she has already spoken to Prime Minister Narendra Modi in this regard.

She said she believes that this issue is under the prime minister's consideration and he himself has discussed the importance of bringing this law.

Jyoti arrived here on Sunday to attend a tribute meeting held at Swami Vamdev Jyotirmath in Chaitanya Vihar. Unnao MP Sakshi Maharaj was also present at the event.

"There was a time when abrogation of Article 370 in Jammu and Kashmir was impossible. It was feared that if such thing happens, there will be bloodbath. No one will be hold the national flag in Kashmir. But this government can bring any law in favour of the nation," Jyoti said.

"Now, everyone believes that if Article 370 can be removed...Prime Minister Narendra Modi can bring any law which is important for the country," she added.

PM Modi criticised for not inviting AAP, RJD for all-party meeting on India-China border tension

New Delhi, Jun 19: RJD and AAP were not invited to the all-party meeting called by Prime Minister Narendra Modi on Friday to discuss the situation at the India-China border after 20 Indian soldiers were killed in a "violent face-off," leaving the parties fuming.

Top RJD leader Tejashwi Yadav criticised the government for not inviting the party to the meeting, asking on Twitter late Thursday night, "Just wish to know the criteria for inviting political parties for tomorrow's (Friday's) all-party meet on Galwan Valley. I mean the grounds of inclusion/exclusion. Because our party hasn't received any message so far."

AAP's Rajya Sabha leader Sanjay Singh joined the chorus, "there is a strange ego-driven government at the centre. AAP has a government in Delhi and is the main opposition in Punjab. We have four MPs. But on a vital subject, AAP's views are not needed? The country is waiting for what the Prime Minister will say at the meeting."

Sources said the government has set a criteria to invite only parties with five or more MPs in Parliament for the digital meet, where the Prime Minister will brief the top leaders of parties and hear their views on the way ahead. There are at least 27 parties in the Parliament, which have less than five members, while 17 have more than five members or more than five MPs.

Interestingly, RJD has five MPs in Rajya Sabha and its senior MP Manoj K Jha shared the Rajya Sabha website link on Twitter, which showed the party has five MPs. "We have not been invited and the government's bogus argument has been exposed," Jha said.

CPI leaders said General Secretary D Raja received a call from Defence Minister Rajnath Singh inviting him to the meeting and with a message that the Prime Minister's Office would coordinate but there was no follow-up after that.

"Exclusion of AAP and RJD in the all-party meet on a National debate does not augment well. AAP is ruling Delhi and has its CM. Why should people of Delhi be kept out in such an important debate on National integrity and Sovereignty?" former NCP MP Majeed Memon tweeted.

During the all-party meeting on COVID-19 too, the government had not called all parties with representation in Parliament to the all-party meeting in April and had set five MPs as a benchmark to be invited.

Raja had then written a letter to Modi demanding that the government should not get into "technicalities" and discuss the issue with all parties in Parliament.
