Vijay Mallya declared proclaimed offender by court

Mumbai, Jun 14: Beleaguered businessman Vijay Mallya was today declared a proclaimed offender by a special PMLA court here on a plea by the Enforcement Directorate(ED) in connection with its money laundering probe against him in an alleged bank loan default case.MALLYA

"The ED application is allowed and proclamation is issued against Vijay Mallya," ordered Special Judge PR Bhavke.

The agency had moved the court to issue an order under Section 82 CrPC and term the liquor baron a proclaimed offender as he has "multiple" arrest warrants pending against him including a non-bailable warrant (NBW) under the Prevention of Money Laundering Act (PMLA).

According to the ED, there are multiple arrest warrants pending against Mallya in various cases like that of cheque bounce and he is also wanted in a money laundering case.

The agency has told the court about the status of investigations in the case and the need to get Mallya join the probe.

A person can be termed a proclaimed offender in a criminal case probe if the court has reasons to believe that the accused against whom a warrant of arrest has been issued by it, has absconded or is concealing himself so that such warrant cannot be executed.

As per Section 82 of the CrPC, the court can publish a written proclamation requiring such an accused to appear at a specified place and at a specified time in not less than 30 days from the date of publishing of such a proclamation.

Officials said that the agency also has the option to seek action under Section 83 of the CrPC (attachment of property of person absconding) if Mallya does not comply with proceedings initiated under Section 82.

ED has been wanting Mallya to join investigations "in person" in its PMLA probe against him and others in the Rs 900 crore alleged loan fraud of IDBI bank and has virtually exhausted all legal remedies like seeking an Interpol arrest warrant and getting his passport revoked.

It is also seeking to invoke the India-United Kingdom Mutual Legal Assistance Treaty (MLAT) to extradite Mallya from Britain.

Mallya had left India on March 2 using his diplomatic passport.
The agency has registered a money laundering case against Mallya and others based on an FIR registered last year by the CBI.

ED is also investigating financial structure of Kingfisher Airlines and looking into any payment of kickbacks to secure loans.

On Saturday, the ED had attached assets worth Rs 1,411 crore of Mallya and one of his companies in connection with its money laundering probe in the bank loan case.

It is also seeking to invoke the India-United Kingdom Mutual Legal Assistance Treaty (MLAT) to have him extradited from Britain.

New Delhi, Feb 16: Aam Aadmi Party (AAP) national convener Arvind Kejriwal was on Sunday sworn-in as the Chief Minister of Delhi for the third time in a row at Ramlila Maidan here, after his party registered a massive victory in the recently concluded Delhi Assembly polls.

Kejriwal was administered the oath of office and secrecy by Delhi Lieutenant Governor Anil Baijal.

The sprawling Ramlila Maidan reverberated with sounds of thousands of people cheering for the AAP leader.

Kejriwal who received a hero's welcome here had extended an invitation to the people of Delhi urging them to attend the swearing-in ceremony to witness "the son of Delhi" taking oath today.

The AAP nearly repeated its 2015 performance in the elections, sweeping the Assembly polls winning 62 seats in the 70-member Assembly, in the face of a high-voltage campaign by the BJP, which fielded a battery of Union Ministers and Chief Ministers in its electioneering spearheaded by Home Minister Amit Shah.

New Delhi, Jun 30: Amid calls for boycotting Chinese products after India-China face-off in eastern Ladakh, Congress leader Rahul Gandhi on Tuesday hit out at Prime Minister Narendra Modi-led government claiming that imports from China have increased under the NDA regime.

"Facts don't lie. BJP says: Make in India. BJP does: Buy from China," Gandhi tweeted along with a graphic of the percentage of imports from China during the UPA rule and the NDA government.

The graphic claims that imports from China were at 12-13 per cent when the Congress-led UPA government vacated office in 2014 but now stood at 17-18 per cent in 2020.

The Congress leader has been vehemently targeting the Centre on the India-China border situation after 20 Indian soldiers were killed in violent face-off with Chinese troops in Ladakh's Galwan valley earlier this month.

Indian intercepts have revealed that the Chinese side suffered 43 casualties, including dead and seriously injured, in the face-off.

India's COVID-19 tally raced past the seven lakh-mark with 22,252 fresh infections on Tuesday, five days after crossing the six lakh post, while the death toll climbed to 20,160 as 467 more people succumbed to the disease, according to the Union health ministry.

With this, the country has recorded over 20,000 cases of the infection for the fifth consecutive day.

India's coronavirus infection caseload stands at 7,19,665, the ministry's data updated at 8 am showed.

With a steady rise, the number of recoveries stands at 4,39,947, while there are 2,59,557 active cases of coronavirus infection in the country.

"Thus, around 61.13 % of patients have recovered so far," an official said.

The total number of confirmed cases also includes foreigners.

Of the 467 deaths reported in the last 24 hours, 204 are from Maharashtra, 61 from Tamil Nadu, 48 from Delhi, 29 from Karnataka, 24 from Uttar Pradesh, 22 from West Bengal, 17 from Gujarat.

Telangana and Haryana reported 11 deaths each; Madhya Pradesh nine; Andhra Pradesh seven; Jammu and Kashmir six; Rajasthan and Punjab five each; Bihar, Kerala and Odisha two each; and Arunachal Pradesh and Jharkhand one each.
