Want to come to India but passport suspended: Mallya to Court

New Delhi, Sep 9: Liquor baron Vijay Mallya today informed a Delhi court that he wants to come to India but is unable to travel back as his passport has been suspended by Indian authorities.

mallyaMallya made the submission through his counsel before Chief Metropolitan Magistrate Sumit Dass in a case lodged for allegedly evading summons in connection with a FERA violation matter.

On July 9, the court had cancelled the exemption from personal appearance granted to him and had directed him to appear before it. In his application moved through senior advocate Ramesh Gupta, Mallya requested the court that some time be given so that his appearance can be secured.

The counsel submitted the copy of an email sent by Mallya, stating that his passport was suspended on April 23, 2016 without giving him any opportunity of being heard.

Enforcement Directorate (ED), however, told the court that Mallya is already evading proceedings in several other cases and sought time to reply to the plea moved by him today. The court has now put up the matter for further hearing on October 4.

The exemption from personal appearance to Mallya was granted in December 2000 on ED's complaint for evading summons issued to him by it. The agency had issued summons to the businessman in connection with alleged payment of 200,000 dollars to a British firm for displaying Kingfisher logo in Formula One World Championships in London and some European countries in 1996, 1997 and 1998.

It had claimed that the money was allegedly paid without prior approval from RBI in violation of FERA norms. In its plea against Mallya filed through prosecutor N K Matta, ED had also sought issuance of non-bailable warrant against the Chairman of the now-defunct Kingfisher Airlines to secure his presence in the ongoing trial of the case, which is at its final stage.

The agency's plea had said Mallya was reported to be in the United Kingdom and his presence in the trial was essential and had sought court's direction to him to remain personally present in every hearing.

Matta had argued that the court should recall its December 2000 exemption order as a PMLA court in Mumbai has recently issued an open-ended warrant against him in connection with a money laundering case.

According to ED, Mallya was summoned on four occasions for questioning in connection with a contract signed in December 1995 with London-based firm Benetton Formula Ltd for promotion of the Kingfisher brand abroad.

When Mallya failed to appear before ED in response to the summons, a complaint was filed on March 8, 2000 before a court here and later on charges were framed against him under FERA.

Why no action against the Bankers who are alleged for having intentionally failed to do due diligence before releasing money to Kingfisher Airlines. The question which comes to ones mind again and again is the loan was for an airline company and not the individual.Why only the individual is being targeted .even a high school child will know that such huge amounts are not given just at the asking for it. Who were the other politicians,Babus,Bankers being protected by ensuring Vijay Mallya staying at London. Is there a bigger Drama happening?

Bengaluru, Feb 23: Bolstered by the Supreme Court's interim nod for the gazette notification of the Mahadayi Water Dispute Tribunal award by the Central government, Karnataka decided to allot funds for the drinking water project in the state's northwest region, an official said on Saturday.

"Funds will be allotted in the state budget for fiscal 2020-21 to complete the Kalasa-Banduri project across the Mahadayi river for supplying drinking water to the four drought-prone northern districts in the state," the official of the water resources department told media on anonymity.

As Chief Minister B.S. Yediyurappa also holds the finance portfolio, he has agreed to allocate funds for the project, held up for years in the legal battle with the neighbouring Goa and Maharashtra over the sharing of the river water among the three coastal states.

Yediyurappa is slated to present the state budget for the ensuing fiscal in the legislative assembly on March 2.

"We will resume the project work once the Centre notifies the award though it will be binding on the final outcome of the apex court's hearing the review petitions of Goa and Maharashtra against the Tribunal award," the official noted.

A division bench of Justice D.Y. Chandrachud and Justice Hemant Gupta on Thursday passed an interim order on the Tribunal award, allowing the central water resources ministry to notify it for implementation and posted the case for final hearing in July.

The Tribunal on August 14, 2018 allocated 13.42 thousand million cubic feet (tmcft) of the river water to the southern state for irrigation and drinking water supply to towns and villages across Bagalkot, Belagavi, Dharwad and Gadag districts, which are in the arid region of the Deccan plateau.

The four districts are about 400-550 km northwest of Bengaluru in the southern state.

Of the 13.42 tmcft water, 5.5 tmcft will be used in the river basin and for diversion into the depleted Malaprabha reservoir while the balance 7.92 tmcft will be utilized for hydel power generation instead of allowing the water to go into the Arabian Sea on the state's west coast through Goa.

Goa, which opposed Karnataka's demand for 36.66 tmcft, was allocated 24 tmcft, while Maharashtra got 1.3 tmcft.

The Tribunal assessed that 188.06 tmc feet water is available at 75 per cent dependability.

The three-member Tribunal is headed by Chairman Justice J.M. Panchal, Justice Viney Mittal and Justice P.S. Naayana.

The Union government had set up the inter-state Tribunal on November 16, 2010 for the djudication of the Mahadayi basin water allocation among the three riparian and contiguous states.

Goa and Maharashtra claimed 122.6 tmc feet and 6.35 tmc feet of the river water respectively.

The Tribunal, which commenced sittings on September 6, 2012, held 1,209 sittings for over 6 years.

Supreme Court senior counsel F.S. Nariman represented the state before the Tribunal to present its case.

The Tribunal's chairman and two members inspected the river basin area across the three coastal states from December 12-24, 2013.

The 77km-long Mahadayi or Mandovi river originates at Bhimgad in the Western Ghats in Belagavi district and flows into the neighbouring Goa through Maharashtra and joins the Arabian Sea off the west coast.

Though the river flows 29 km in Karnataka and 52 km in Goa, its catchment area is spread over 2,032 km in the southern state as against 1,580 km in the western state (Goa).

Mangaluru, JuJ 2: Dr Shivaram Karanth Biological Park at Pilikula, which was recently reopened after covid-19 lockdown, will again be shut from July 4 to 31. 

“The authorities have decided to close the park for visitors from July 4 to July 31 due to the rapid increase of the spread of coronavirus in Dakshina Kannada,” said, Jayaprakash Bhandary, director of the Park.

Mr Bhandary said that after the reopening of the Park, the number of visitors has drastically decreased due to corona scare. 

“There are around 100 staff and over 30 caretakers at the zoo. After closing the zoo, only essential staff will come to the zoo take care of the animals. We are planning to reopen it for visitors on August 1,” he said.

Bellari, Feb 23: Fringe outfit Sri Ram Sena leader Sanjeev Maradi said on Friday said that organization will reward Rs 10 lakh to the person who will 'eliminate' those who have raised "pro-Pakistan" slogans including Amulya who recently raised "Pakistan Zindabad" slogan at an anti-CAA protest in Bengaluru.

"We request both state and central government not to release them (Pro-Pakistan sloganeers) on bail. If they will be released Sri Ram Sena will eliminate them or will give a reward of Rupees 10 lakh to those who kill them," said Sanjeev Maradi.

"We condemn such slogans. This is like a virus. First, it happened in Jammu and Kashmir, then in JNU, then Mysore and then a student named Amulya raised pro Pakistan slogan in Bengaluru," he added.

A girl named Amulya raised 'Pakistan Zindabad' slogan on Thursday at an anti-CAA protest where AIMIM chief Asaduddin Owaisi was also invited.

Thereafter, a case was registered under Section 124A (Offence of sedition) of the Indian Penal Code against the student.

Meanwhile, Imran Pasha, the organizer of the anti-CAA protest said that Amulya was not invited to the event.

"We were the organizers of the event. At around 6:45 pm on Thursday, when I and Member of Parliament Asaduddin Owaisi were entering the stage area, we did not notice Amulya was present there. I did not invite her," Pasha told media.
