What've you done to curb black money: Supreme Court asks Modi govt

New Delhi, Sep 4: After a lull, the Supreme Court on Thursday put the spotlight back on black money by asking the Centre to give details of action taken on the special investigation team's (SIT) recommendations advocating stringent measures against irregularities in capitation fees, cricket, stock markets and trade-based money laundering.

blackmoneyThe SIT has recommended action against misuse of exemption of long-term capital gains tax for money laundering, misuse of participatory notes for money laundering, generation of black money in education sector through capitation fees and through donations to religious and charitable institutions, and, strict monitoring of match-fixing, spot-fixing and betting in cricket matches including T20 tournaments like IPL.

A bench of Chief Justice H L Dattu and Justices Madan B Lokur and A K Sikri asked attorney general Mukul Rohatgi, "What is the fate of these recommendations by the Supreme Court-appointed SIT? The Centre will tell us about it in the next hearing on October 28."

The bench also told senior advocate Dushyant Dave, who appeared for the SIT headed by former Supreme Court judges M B Shah and Arijit Pasayat, to ask the SIT to submit its fresh report by October 7 on ways and means to tackle the menace of black money.

Advocate Prashant Bhushan requested the court to make public the SIT reports but Dave objected, saying it would be unwise to make the reports public, except the recommendations. "The reports include analysis of intricate economic issues and policies. Till the government initiates action on these recommendations, it will not be proper to discuss the reports in public," he said. The bench agreed with Dave.

The SIT had given a string of recommendations in its third report submitted to the SC in May. The Centre will now be required to inform the SC on October 28 of the action it has taken on the following recommendations:

* To control generation of black money through huge capitation fees, mostly paid in cash, to technical and medical colleges for admissions. A specific provision should be inserted in Prevention of Corruption Act to make acceptance of cash by educational institutions a punishable offence.

* Large donations, including gift of ornaments, to religious and charitable institutions should be accompanied by PAN number of the donor.

* Illegal activity of cricket betting requires to be controlled by some provisions which are deterrent to all concerned. Considering the fact that large amount of black money is generated and used in this sector, it is suggested that some appropriate legislative directions or rules or regulations are required to be put in place to curb the menace of such betting.

* Ban on bulk transactions through cash. A number of European countries bar any cash transaction above a particular limit. This can be done in India.

* For holding cash/currency notes, there should be a limit by prescribing a reasonable threshold, may be Rs 10 lakh or Rs 15 lakh. This will control holding of unaccounted money to a large extent.

* SEBI needs to have an effective monitoring mechanism to study unusual rise of stock prices of companies while such a rise is taking place. In case it is established that stock platforms have been misused for taking long-term capital gains tax benefits, prosecution should be invariably launched.

* Obtaining information on 'beneficial ownership' of participatory notes is of crucial importance to prevent their misuse. SEBI needs to examine the issue and come up with regulations where the 'final beneficial owner' of participatory notes/offshore derivative instruments are known.

* Proactive detection of creation of shell companies, which are used to provide accommodation entries to launder black money. Deterrent penal action against persons involved in creation of shell companies and providing accommodation entries needed.

New Delhi, Aug 7: The Congress on Thursday demanded the removal of Karnataka minister KS Eshwarappa from the cabinet and his arrest for his statement that grand Krishna and Vishwanath temples would come up in Mathura and Kashi respectively after "liberating" them.

Mr Eshwarappa made the statement while reacting to Prime Minister Narendra Modi laying the foundation of the Ram temple in Ayodhya yesterday.

"By asking kar sevaks (volunteers) to launch a similar campaign, the minister (Eshwarappa) is trying to disturb peace in the society," Congress Karnataka unit chief DK Shivakumar said at a press conference in Ballari today.

"Such people should be arrested immediately, police officials should register a case against him and the Chief Minister should remove him from the cabinet,"he said.

Rural Development and Panchayat Raj minister Eshwarappa had said on Wednesday that he was of the firm opinion that "if not today, tomorrow, Mathura and Kashi temples will be liberated and grand temples would be built there."

"A place of devotion has to be built in both Kashi and Mathura. There too, grand temples have to be constructed. The mosques have to be removed from there," he said.

Mr Eshwarappa, a former BJP state president, said the centres of Hindu belief, Ayodhya, Kashi and Mathura were a kind of a symbol of "slavery" as "temples of our Rama, Krishna and Vishwanath were destroyed and mosques built."

Stating that Mr Eshwarappa is not an individual but a minister who represents the government, Mr Shivakumar on Thursday sought to know from the Chief Minister whether this was his government's stand.

New Delhi, Jul 12: With the highest single-day spike of 28,637 new cases and 551 deaths being reported in the last 24 hours, India's COVID-19 count reached 8,49,553 on Sunday.

According to the Union Health and Family Welfare Ministry, this includes 2,92,258 active cases, and 5,34,621 cured and discharged or migrated patients. The toll due to the disease has reached 22,674 in the country.

Maharashtra with 2,46,600 cases continues to be the worst affected state by COVID-19 in the country. The state has 99,499 active cases while 1,36,985 patients have been cured and discharged so far. The death toll due to the disease now stands at 10,116.

Tamil Nadu with 1,34,226 cases, including 46,413 active ones, is the next worst affected in the country. While the number of cured and discharged patients is at 85,915 in the state, the toll due to the disease is at 1,898.

The national capital has recorded 1,10,921 confirmed cases so far. However, the number of active cases in Delhi is at 19,895 and 87,692 patients have been cured and discharged so far. With 3,334 deaths being reported due to COVID-19 in the city.

New Delhi, Feb 4: Uttar Pradesh Chief Minister Yogi Adityanath on Monday accused Arvind Kejriwal of having a "partnership" with Pakistan and appealed to the people in Delhi to not vote for the AAP chief as it will make Pakistan happy.

Ramping up his attack on the Shaheen Bagh protest, Adityanath said that the protest against the Citizenship Amendment Act (CAA) is merely an excuse for people to vent their anger against the scrapping of Article 370.

"You must have seen their partnership on 370. Arvind Kejriwal used to speak in the same voice as Imran Khan on Article 370. You must have heard it.

"Now when elections are taking place in Delhi, who is speaking in favour of Arvind Kejriwal? It is the ministers of Pakistan. They are aware that Kejriwal is feeding 'biryani to protesters at Shaheen Bagh'," he said, referring to Pakistan minister Fawad Chaudhry's tweet asking Indians to defeat Prime Minister Narendra Modi.

Adityanath addressed three rallies on Monday in the national capital ahead of assembly elections.

"Will Pakistan decide who Indians should vote for. If voting for Kejriwal will make Pakistan happy, should it be done," he asked at a rally in Mehrauli.

Adityanath said his Delhi counterpart Kejriwal has become a "toy in the hands of anti-social and anti-India elements".

Addressing a rally in Vikaspuri in west Delhi, he said that Kejriwal is not bothered about key issues such as providing clean drinking water but is concerned about Shaheen Bagh, the anti-citizenship amendment act protest site.

At another rally in Uttam Nagar in west Delhi, Adityanath said Kejriwal has played with the emotions of the people of Delhi for the last five years.

"He obstructed the development of Delhi. And knowingly and unknowingly, he became a toy in the hands of anti-social and anti-India elements," Adityanath said.

The protest at Shaheen Bagh, he said, has disrupted traffic across the capital.

"A guest with an appointment to meet him at 9.30 am could only reach at 11. He told me he had left as early as 7 am but got stuck because of the traffic in Shaheen Bagh," he said.

The Uttar Pradesh chief minister also slammed Kejriwal for "sympathising" with elements who he said gave anti-India slogans in Jawaharlal Nehru University.
