Clean chit to Narendra Modi as Zakia Jafri's plea is rejected

December 26, 2013

Ahmedabad, Dec 26: Narendra Modi gets clean chit in 2002 Gulbarg society case as metropolitan magistrate rejects Zakia Jafri's plea against SIT's clean chit.

A magistrate court in Ahmedabad pronounced its order on Zakia Jafri's petition against Special Investigation Team (SIT) closure report that gave a clean chit to Gujarat Chief Minister Narendra Modi and others in 2002 Gujarat riots.

Magistrate BJ Ganatra had earlier said he would deliver the order on October 28, but it was deferred to December 2, and then to December 26.

Jafri is the wife of former Congress MP Ehsan Jafri, who was among 69 people killed in the Gulbarg Society massacre here during the 2002 riots.

SIT had submitted its report on February 8 last year, clearing Modi’s name in any conspiracy.

She had filed a petition against the SIT report in April seeking its rejection and an order to file chargesheet against Modi and others during the 2002 riots.

Gujarat_riotsAhmedabad, Dec 26: A court in Ahmedabad is likely to deliver its verdict on Thursday on Zakia Jafri's protest petition challenging the clean chit to Gujarat chief minister Narendra Modi and others in the Gulbarg Society massacre case.

Zakia's husband, former Congress leader Ehsan Jafri, was among the 69 people of Gulberg Society in Ahmedabad, killed by a mob on February 28, 2002.

The court will decide whether the clean chit granted by the Special Investigation Team (SIT) can be upheld as the SIT found no prosecutable evidence against those named in the Zakia's complaint.

Zakia's lawyers had argued that adequate evidence was available to initiate criminal proceedings against Modi and others, who had allegedly conspired to target the minority community after a Muslim mob torched the Sabarmati Express on 27 February 2002 near Godhra in which 59 kar sevaks were burnt to death.

In the subsequent riots across the state, more than 1,000 people were killed under the watch of Modi administration.

In her petition, Zakia has stated that "Modi instructed top officials to allow Hindus to vent their anger on Muslims after the Godhra train burning incident. IPS officer Sanjiv Bhatt's affidavit supports this allegation. Modi indulged in hate speeches that amounted to creating enmity between communities. Ministers were posted at police control rooms to interfere with effective police functioning."

Following the September 2011 Supreme Court order, the SIT filed a closure report in the magisterial court in February 2012.

SIT lawyer RS Jamuvar had said that the investigative agency did not find any evidence against Modi and hence the closure report had been filed.

The SIT disregarded the affidavit of Sanjiv Bhatt against Modi.

Jaipur, July 13: Amid a deepening political crisis in Rajasthan where the number 2 leader of the Congress party Sachin Pilot has revolted, over 200 Income Tax (I-T) sleuths raided the residences and properties of two of Chief Minister Ashok Gehlot’s close confidants.

The Income Tax department has carried out searches at over a dozen locations linked to Congress leader Dharamender Rathore as well as jewellery firm owner Rajiv Arora, both of whom are considered close to Gehlot.

Officials said that the raids that are underway in Jaipur, Kota, Delhi, and Mumbai were done after a complaint of tax evasion was made. Under the scanner, they said, are transactions that were made outside the country.

The curious timing of the Income Tax department’s action against Gehlot’s aides has made the Congress accuse the sleuths of acting on the behest of the BJP.

Congress spokesperson Randeep Singh Surjewala tweeted: “After all, BJP's lawyers came on the field. The Income Tax Department started raids in Jaipur. When will ED arrive?”

The Congress is facing a cliffhanger in Rajasthan after the open rebellion by deputy chief minister Sachin Pilot, who on Sunday night claimed that he had the support of 30 MLAs and that Gehlot was leading a minority government in the state.

However, Congress leader Avinash Pande on Monday said 109 MLAs have signed a letter of support to the chief minister, well above the majority mark of 100. The party has issued a whip to all the MLAs, asking them to attend the Congress Legislature Party meeting at 10.30 am.

New Delhi, Mar 3: Delhi's Tihar Prison authorities had made all necessary preparations for the hanging of four convicts in the Nirbhaya gangrape-and-murder case which was scheduled for Tuesday, officials said Monday.

However, on Monday evening, a city court deferred the hanging till further orders.

Postponing the execution, Additional Sessions Judge Dharmender Rana said the hanging cannot be carried out pending disposal of Pawan Gupta's mercy plea before the President, observing any condemned convict must not meet his "Creator" with grievance against courts for not acting fairly on the opportunity to exhaust legal remedies.

"We had made all the necessary arrangements for the execution of the four convicts which was scheduled for Tuesday at 6 AM. Now, the execution has been postponed and we are waiting for the further order by the court," a senior jail official said.

The hanging of the four men -- Mukesh Kumar Singh (32), Vinay Kumar Sharma (26), Akshay Kumar Singh (31) and Pawan -- who are lodged in Tihar jail, was fixed for March 3 in Tihar jail on a court order.

"We had checked the ropes. Hangman was called and dummy executions were carried out," another senior jail official said.

Barring Pawan, the other three had in the previous weeks moved curative petitions and mercy pleas which were all dismissed.

The first date of execution -- January 22 -- fixed on January 7 was postponed by the court to February 1. But on January 31, the court indefinitely postponed the hanging. On February 17, the court again issued fresh date for execution of death warrants for March 3 at 6 AM.

The court in its orders observed that the four convicts cannot be hanged since a mercy plea of one or the other convict was pending.

New Delhi, Jun 17: Petrol and diesel prices were increased in metros on Wednesday, marking the eleventh straight day of increase since state-owned oil companies returned to the normal practice of daily reviews following a 12-week pause. With effect from 6 am, the price of petrol was increased by 55 paise per litre, and diesel by 69 paise per litre in Delhi, compared to the previous day. While the price of petrol was revised to Rs 77.28 per litre in the national capital from Rs 76.73 per litre the previous day, the diesel rate was increased to Rs 75.79 per litre from Rs 75.19 per litre, according to notifications from state-run Indian Oil Corporation, the country's largest fuel retailer. In the 11-day period, the price of petrol has been increased by a cumulative Rs 6.02 per litre, and diesel by Rs 6.49 per litre.

International crude oil prices retreated on Wednesday, weighed down by an increase in US crude inventories and worries about a potential second wave of the coronavirus pandemic. Brent crude futures - the global benchmark for crude oil - were last seen trading 1.0 per cent lower at $40.56 per barrel.

State-run oil marketing companies revise the prices of petrol and diesel from time to time, besides aviation turbine fuel (ATF) - or jet fuel - and liquefied petroleum gas (LPG). However, since March 16, the oil companies had kept petrol and diesel prices on hold, possibly due to the volatility in global oil markets.

Fuel retailing in the country is dominated by state refiners - Indian Oil Corporation, Bharat Petroleum Corporation and Hindustan Petroleum Corporation. The three own about 90 per cent of the retail fuel outlets in the country.
