Vadodara, Aug 22: A local court has summoned actress Mallika Sherawat in connection with an obscenity case filed against her by late Narendra Tiwari, who was an advocate.

MallikaThe actress and the owner of a five-star hotel in Mumbai have been asked to appear before the court on August 25 for the hearing. Tiwari, who was the then Baroda Bar Association (BBA) president, had registered a case against Sherawat in January 2007 under IPC sections 294 and 114.

Tiwari had stated in his complaint that Mallika's dance in a five-star hotel on 31st December 2006 was obscene and provocative. He had even claimed that a spectator in the hotel had tried to stop the dance by climbing on the stage but he was allegedly ridiculed by the organizers. The court had asked the police to investigate the case under IPC section 202.

"The court has summoned Mallika and the hotel owner after hearing in the case resumed on Wednesday. The matter had reached Supreme Court after Gujarat high court refused to quash the complaint against Sherawat last year. Supreme Court didn't quash the complaint and asked Vadodara court to hear the case," said advocate Bhaskarrao Nilak, who is representing Tiwari.

Nilak added that the summons has already been sent to the parties concerned through courier. Tiwari, who was suffering from mouth cancer, passed away in April this year. Nilak, however, said hearing of the legal suit filed by Tiwari would continue in the court.

A local court had issued summons to Mallika and the hotel owner in 2007 following which they approached Gujarat high court and filed revision petition to quash the summons. The Gujarat high court had rejected their petition and asked the lower court to continue the proceedings.

A local court had even issued a bailable warrant against Mallika in July last year after she or her advocate failed to appear before the court.
