Cow vigilantism: SC seeks response from Haryana, UP, Rajasthan

New Delhi, Jan 29: A plea seeking contempt action against the governments of Rajasthan, Haryana and Uttar Pradesh for not following its order to take stern steps to stop violence in the name of cow vigilantism, today led the Supreme Court to seek responses from the three states.

The contempt petition has been filed by Tushar Gandhi, the great-grandson of Mahatma Gandhi, saying the three states have not complied with the top court order of September 6 last year.

A bench of Chief Justice Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud issued notice and sought the replies from the three states by April 3.

Senior advocate Indira Jaising, appearing for Gandhi, said that despite the apex court order, violent incidents were still being witnessed in various parts of these states.

The bench said it will hear the contempt petition along with the main writ petition filed by Gandhi earlier.

On September 6 last year, the apex court had asked all the states to take stern measures to stop violence in the name of cow protection, including appointing of senior police officers as nodal officer in every district within a week and acting promptly to check cow vigilantes from behaving like they are "law unto themselves".

Observing that such acts of violence "must stop", it had directed the states to form a dedicated task force in each district. It had asked their chief secretaries to file a status report giving details of actions taken by them to prevent incidents of cow vigilantism.

"The senior police officer shall take prompt action and ensure (that) vigilante groups and such people are prosecuted with quite a promptitude," the top court had said.

It had observed that the people "should not take the law into their hands" and "they should not behave as if they were the law unto themselves".

The top court had also asked the Centre to respond to the submission that it could issue directions under Article 256 (obligation of states and Union) of the Constitution to all state governments on issues related to law and order.

It had said that "some kind of planned action is required so that vigilantism does not grow" and efforts have to be made to stop such vigilantism.

"How will they (states) do it is their business, but this must stop," the bench had observed.

It had directed the states to ensure highway patrolling after it was pointed out that such incidents mostly took place there on the pretext that vehicles were carrying beef.

The Centre had told the apex court that it does not approve any such incident of people taking the law into their hands.

Gandhi in his earlier PIL had sought various reliefs, including a direction to all state governments to take preventive measures against cow vigilantism.

Besides Gandhi, Congress leader Tehseen Poonawalla has also filed a similar petition.

Mumbai, Jan 3: The Shiv Sena on Friday targeted the Centre by questioning the "efficacy" of the 2016 surgical strike and said the perception that it would demoralise Pakistani terrorists remained an "illusion" as Indian soldiers continue to get killed in terror attacks in Kashmir.

Accusing the Modi government of boasting about how Pakistan was straightened out after the surgical strike, the Sena sought to know whether it has really happened.

It also observed that troubled borders were not good for the country's well-being.

The Sena's remarks come in the wake of the death of an Army soldier from Maharashtra, Naik Sandip Raghunath Sawant, who was killed during a counter-insurgency operation in Jammu and Kashmir on Wednesday.

"The New Year did not begin on a positive note in Kashmir. Our jawan from Satara, Sandip Sawant, attained martyrdom in Kashmir along with two other soldiers. In the last one month, seven to eight jawans from Maharashtra were killed in the line of duty. The Maha Vikas Aghadi government in Maharashtra is not responsible for this," the Sena said in an editorial in party mouthpiece 'Saamana'.

The party also questioned whether the situation in Kashmir has improved after the surgical strike and abrogation of Article 370 provisions.

The party, however, maintained that scrapping Article 370 was a good move.

India had conducted the surgical strike on September 29, 2016, across the Line of Control (LoC) as a response to a terrorist attack on an Indian Army base in Uri sector of Jammu and Kashmir earlier that month.

Without naming the Centre, the Sena alleged, "Circulating news that only the Pakistanis were getting killed in Kashmir will not change the reality as tricolour-draped bodies of Indian soldiers, like Sawant, are reaching their respective villages."

"There is a bloodshed along the Kashmir border and mounting anger among the families of martyred jawans. The perception that surgical strike will demoralise Pakistani terrorists has turned out to be an illusion. In fact, the (terror) attacks have increased," it added.

The Uddhav Thackeray-led party accused the ruling BJP of boasting about straightening out Pakistan after the surgical strike.

"But has Pakistan been really straightened out? Rather Pakistan has been indulging in ceasefire violations along the LoC every day," it added.

The Shiv Sena also questioned the government's claim that the situation in Kashmir was under control after the nullification of Article 370.

"It is good that Article 370 was scrapped. Before that, surgical strike was carried out in Pakistan. But has the situation in Kashmir improved? The terror attacks continue. It's only that there is a control in reporting (these incidents)," it said.

The Sena also alleged that there was no clarity as to what was transpiring in Kashmir after the scrapping of Article 370 and only the media reports of soldiers sacrificing their lives have been coming out from that state

In a veiled attack on the BJP, its erstwhile ally, the Sena, also accused it of exploiting the surgical strike for political gains.

Kozhikode, Aug 8: A tailwind or crosswind could be the reason for the Air India Express flight mishap at Kozhikode international airport in Kerala, according to some aviation experts. 

Team of DGCA and AIE already reached the spot. With the death of the captain and co-pilot in the mishap, the investigation would be focusing mainly on the voice recorders and other technical aspects.

It is learnt that the ill-fated aircraft, IX 1344 with 190 onboard including crew, was initially planning to land on runway-28 of the airport. But later the pilot opted runway-10 which is toward the other direction. Pilots would be taking the decisions on the basis of inputs from ATC.

The questions now doing the rounds are what made the pilot opt runway-10 and whether the tabletop runway lacked adequate safety parameters.

An aviation expert, who didn't want to be quoted, said that Capt Deepak Sathe, who was commandeering the aircraft, was a well-experienced pilot and was also familiar with the terrains. Hence the chances of any error from his part was very unlikely. Hence a fair in-depth probe was required to find the exact cause.

Though the Kozhikode airport has an Instrument Landing System, it was of category-I for which pilot's visibility is very crucial toward a touchdown. Since it is a tabletop airport and rough weather prevailing in the region, the chances of tailwind was also high, said sources.

There had been safety concerns about the airport over quite some time. In 2011 aviation safety consultant captain Mohan Ranganathan reportedly gave a report citing the safety issues, especially the buffer zones at the end of the runway.

However, an AAI officer said that rectification steps were already done by last year by widening the Runway End Safety Area (RESA) from 90 metre to 240 metre. However, the length of the runway had to be reduced to 2,700 metre from 2,850. The AAI was also constantly pressing for increasing the runway length to 3,150 metres. But that was getting delayed due to land acquisition issues pending with the state government.

New Delhi, Aug 7 : Congress leader Rahul Gandhi on Friday slammed the Central government as India crossed the 20 lakh COVID-19 positive cases.

Taking to Twitter, the Congress leader reiterated his earlier tweet, sent out on July 17, which stated "The 10,00,000-mark has been crossed.

With the rapid spread of COVID-19, by August 10, more than 20,00,000 will be infected in the country. 

The government must take concrete, planned steps to stop the epidemic."
"20 lakh-mark has been crossed, Modi government is missing," the Congress leader tweeted today.

The Union Health Ministry has said active cases as a percentage of total cases have seen a significant drop from 34.17 per cent on July 24 to 30.31 per cent.
