HC awards life term for two in acid attack case

Bangalore, March 20: In a major relief to an acid attack victim, the High Court on Monday sentenced two persons convicted of the offence to life imprisonment along with imposing a fine of Rs 10,000 each.

The verdict, which came after a span of 10 years, can be seen as justice delivered to Sudesh, a resident of KGF, who was blinded in the acid attack.

The Division Bench comprising Justice K Bhaktavatsala and Justice H S Kempanna, which set aside a trial court order, has not only sentenced the accused Amanullah and Moinuddin to life imprisonment, but has also directed them to pay a sum of Rs one lakh each to the victim.

Sudesh, a diploma student in KGF, was in love with Naheeda, his neighbour.

Although Sudesh’s parents had consented for the marriage as Naheeda’s parents objected to it.

However, Sudesh and Naheeda continued the affair. Being aware of it, Moinuddin, the girl’s brother, threatened Sudesh with dire consequences.

When the couple did not heed his threat, Moinuddin and his friend Amanullah hatched a plan. On May 1, 2002, the two threw nitric acid on Sudesh at a library.

The acid blinded Sudesh in both the eyes. He also suffered severe burns on the face, neck and chest.

On July 3, 2006, the trial court acquitted Moinuddin and Amanullah citing lack of evidence. The court acquitted the accused on the grounds that victim Sudesh, the prime witness in the case, could not reveal the identity of the accused during the medical examination.

When the State appealed before the High Court, Additional State Public Prosecutor (ASPP) N S Sampangiramaiah submitted that the trial court had erred in not considering the evidence. The ASPP highlighted a Supreme Court order which laid down that the victim need not mention the name of the accused in the FIR or even testify before the doctor.

The Division Bench upheld the contention of the State, setting aside the trial court order and observed that the duty of the doctor was not to record any statement but to treat the patients. The Bench said that the victim, being in a state of unbearable pain at the time of the incident, could not possibly be in a position to identify the accused or reveal details and motive of the accused.

Muzaffarnagar, Jun 11: Three persons have been arrested for allegedly using plastic scrap to make jaggery at Bhokaheri village under Bhopa police station here, as official said on Thursday.

 Police raided a jaggery manufacturing unite (kolhu) and arrested three persons on Wednesday, SHO, Bhopa police station Sanjive Kumar said.

Police have registered a case against five persons including the trio that was arrested while two of them managed to escape, he said, adding that two loaded tractor trollies of plastic scrap have been seized.

The West Bengal government has suspended two women teachers in East Burdwan district on the charge of teaching pre-primary students from an English alphabet book consisting of a portion derogatory to the people with a dark complexion.

While presenting the alphabets with corresponding words and images, the book says U is for "Ugly". The illustration printed beside the letter is that of a boy with a dark complexion.

"The book is not part of the textbooks referred by the education department. It was introduced by the school itself. We have zero-tolerance for acts which instil prejudices into the minds of students," Education Minister Partha Chatterjee told reporters here on Thursday.

He said the two teachers of a local municipality-run school have been placed under suspension with immediate effect based on a preliminary investigation and stricter action would be taken against them later.

Though the school is now closed because of the lockdown, the matter came to light when the father of a student of the school was teaching him with the help of that book. He informed other parents and the education department was apprised of the issue, sources said.

Moradabad, Jun 17: Two children died after they accidentally got locked inside a car while playing in Uttar Pradesh's Moradabad, the police said.

Four children, aged between 4 and 7 years, locked themselves inside the car while playing and were found unconscious soon after, the police added.

"All four children were found unconscious in a car and they were taken to the hospital. Two of them died and the other two are undergoing treatment at the hospital," said Amit Kumar Anand, superintendent of police (city) Moradabad.

The children were related to each other, the police said.

The man who owns the car said the children had locked themselves inside. "When we reached, the children were in an unconscious state. Two of the four children died. The incident occurred around 8 am."
