Mother, daughter ticked off for 'habit' of lodging rape cases

New Delhi, June 28: A woman and her mother have been ticked off by a Delhi court for their ''habit'' of lodging false rape cases with ulterior motives, including those for grabbing property.

The court, while acquitting a man accused of raping the woman, observed that she and her mother had earlier too lodged several cases of rape, some of which have already been found to be false.

The judgement came after the woman admitted during her cross-examination that she had lodged the false case and had deposed before the police "at the instance and in connivance" with her mother, who had developed a "grudge" against the accused, who ran a shop.

"...All these circumstances are making it evident that neither prosecutrix nor her mother has any regard for the truth and they seem to be in the habit of getting false cases registered either with a view to grab the property of other persons or for carrying out some other illegal design in their minds, best known to them," Additional Sessions Judge Rakesh Tiwari said.

"In view of my aforesaid discussion, the prosecution has miserably failed to bring home the guilt of the accused from any point of view and hence the accused is acquitted of the charges under section 376 (rape) and 506 (criminal intimidation) of IPC," the judge added.

The court in its judgements noted the statement made by the complainant during her cross-examination in which she admitted that her mother had earlier lodged a false case of rape against a woman school teacher and a man.

The court noted that the complainant had admitted that her mother was annoyed with the lady teacher and the accused man as they were not supporting their claim over a plot of land and for this reason her mother told her to lodge a complaint of rape against them.

Later she even apologised to the teacher and the man for lodging a false case of rape against them, the court pointed out.

The court said the complainant woman also admitted that she had lodged the case in hand at her mother's instant as the shopkeeper had asked them to leave the village, saying that the dubious people were visiting them and they were "indulging in bad acts."


The police had lodged the FIR in September 2008 when the complainant woman had deposed that she was raped by him.

Kolkata, Jul 4: Two people were killed and around four injured when the bombs they were allegedly manufacturing went off inside a house in Murshidabad district, a senior police officer said on Saturday.

Their identities were yet to be established as the condition of those injured and undergoing treatment at a hospital was still "critical", he said.

The thatched roof of the house, where they were allegedly making bombs, also blew off in the explosion, which occurred at Suti town in Jangipur subdivision of the district around 9:00 pm on Friday, the officer said.

The house has been damaged completely, and its owner is on the run, he said.

As of now, the wife of the house owner is being questioned in connection with the incident, the officer added.

Gorakhpur, Feb 16: Two unidentified policemen allegedly raped a 20-year-old woman in a hotel room near a railway station in Uttar Pradesh's Gorakhpur.

The incident took place on Thursday after which the woman informed her family members. The FIR was registered in the matter on Friday, police said.

A case under various sections of the Indian Penal Code (IPC) including gang rape has been registered against two unidentified police men at the Gorakhnath police station, they said.

No arrests have been made so far in this connection, the police added.

Members of various political parties including Congress, Samajwadi Party, BSP and Purvanchal Sena staged a sit-in demonstration at the office of the district magistrate (DM) demanding suspension of all staff members of the Gorakhnath police station as well as a magisterial probe into the matter.

"The girl is undergoing treatment at the district hospital. She has made serious allegation of rape by two policemen. During investigation we found that the hotel has CCTV footage and also took the statement of guard," SSP Gorakhpur, Sunil Kumar Gupta said.

"Prima facie, the woman went to the hotel room willingly with some men. However, a probe is underway and culprits won't be spared," he said.

The woman told media that both the policemen thrashed her and accused her of being involved in prostitution.

She claimed that she requested them to leave her but they beat her and raped her. Later, they asked her to go home in an autorickshaw.

The survivor also told media and investigating policemen that she will be able to identify the hotel room where the crime took place as well as the two policemen who allegedly raped her.

The woman said she runs coaching classes at her home and her father is a labourer.

The incident took place at deceased, Arvind's rented house in LBS Nagar inside HAL police station limits.

According to police, Arvind is an accused in a criminal case and recently walked out of jail on bail.
