Gang-rape case: Sixth accused declared minor

New Delhi, Jan 28: The sixth accused in the case of December 16 gang rape and murder of a 23-year-old paramedical student here was on Monday declared by the Juvenile Justice Board (JJB) as a “minor”, which would enable him to walk free by June 4, this year when he attains the age of 18 years.

The accused, who was described as the most brutal of the six accused by the Delhi Police in its charge sheet, was declared as 17 years and six months and 24 days-old (as of today) by the JJB, which relied on his birth certificate and school documents produced before it.

Section 15 (g) of the Juvenile Justice (Care and Protection of Children) Act mandates that a juvenile aged between 16-18 years if convicted of any offence can be sentenced to be sent to a special home for a period of three years at the maximum, and, thereafter, be released on probation.

However, section 16 of the Act also provides that a juvenile can only be kept at the special home till he attains 18 years of age and he cannot be sent to jail thereafter, which in effect will result in his release.

The JJB also rejected the police’s plea for bone ossification test of the sixth accused for determining his age.

Lawyers appearing for the prosecution said they appeal against the JJB order in a higher court.

Earlier on January 15, the principal of the school, from where the juvenile had droppoed out, had submitted before the JJB that as per the school records he is 17 years and six months-old.

The present and the former headmasters of the school in Bhawanipur at Badaun in Uttar Pradesh, where the juvenile had studied till Class III, had appeared before the Board and said they cannot identify the boy but know that he took admission in the school in 2002.

The former principal said that during the time of admission, the boy’s father had come to admit him and mentioned his date of birth as June 4, 1995.

The five other accused -- Ram Singh, his brother Mukesh and their accomplices Pawan Gupta, Vinay Sharma and Akshay Thakur-- have been charged with the offences of murder, gangrape, attempt to murder, kidnapping, unnatural offences, dacoity, hurting while committing robbery, destruction of evidence, criminal conspiracy and common intention under the IPC.

The 23-year-old paramedical student was brutally raped and assaulted in a moving bus on December 16 and she died on December 29 in a Singapore hospital.

The juvenile is the eldest son of a mentally challenged father and his mother relied on farming to raise his two brothers and two sisters in a small hamlet at Badaun.

The investigators had said that around five to six years ago, he fled from his home and came to Delhi where he did small jobs till he met Ram Singh, who was driver of the bus.

The police sources had said that on the fateful night, all the accused had partied and had then gone on a joy ride in bus and to “pick some girl for sexual pleasure” .

They had first robbed Ramadhar Singh, who they had picked up from R K Puram Sector 4 and then dumped him near IIT gate.

And from Munirka, they had picked up the gang-rape victim and her male friend and dumped them on the road assuming they were dead, according to the sources.

Nagpur, Apr 5: A 23-year-old man allegedly committed suicide in Imambada area in Nagpur on Saturday due to financial distress, police said.

Nikhil Gavhane, who worked in a grocery shop, hanged himself as he had taken money from a person and was stressed over repayment, an official said.

"He was depressed since a week," the Imambada police station official said.

New Delhi, Jan 6: A blind student who is pursuing research in Jawaharlal Nehru University (JNU) was also attacked by the mob that perpetrated violence in the University yesterday.

"I thought that the mob which came yesterday would disperse after raising a few slogans but they indulged in violence. They were targeting ABVP students. They beat me with sticks and rods. When I went to the AIIMS Trauma Centre, I came to know that there are many other injured students there," Surya Prakash, the blind student pursuing research in the University told ANI.

"I talked to my family members. They are really worried about the situation here. I qualified in the National Eligibility Test (NET) last year but I want to study and hence I am continuing research in JNU. How can we do anything in this atmosphere of fear? I am receiving calls from anonymous numbers threatening me not to come in front of the media. They are saying that as I am blind, I would become the face of this case," he added.

Another PhD student, Santosh Bhagat recounted his experience.

"In the evening at around 7 pm, many masked men entered the hostel. They had rods and sticks in their hands. We tried to go out but the attackers had entered the premises by then. I locked my room from inside but the attackers broke the door and entered my room and attacked me. They pushed me from the first floor and I fell down and sustained an injury. Later, I took shelter at one of the Professor's flat. Later, I was taken to the AIIMS Trauma Cantre," Bhagat said.

On Sunday evening, more than 30 students of the university, including JNUSU President Aishe Ghosh, were injured and were taken to the AIIMS Trauma Centre after a masked mob entered the JNU and attacked them and professors with sticks and rods.

The JNU administration and political leaders, cutting across political lines, condemned the attack on students and urged the police to take action against the perpetrators.

Meanwhile, the situation remained tense but peaceful outside JNU on Monday morning as the university guards maintained a strict vigil at the gate, checking I-cards of all those entering the university.

Kota (Rajasthan), Jun 6: A 14-year-old boy allegedly hanged himself to death on early Saturday morning shortly after he stopped playing PUBG throughout the night and went to sleep, said police. 

Railway Colony police station’s in-charge Hansraj Meena said the boy, a class 9 student and son of an Army man, was found hanging from the grill of the ventilator in his bedroom on early Saturday morning. 

Meena said according to the boy’s family members, the boy had downloaded the gaming programme on his mother’s mobile phone only three days back but had been playing the game virtually continuously for the last three days. 

He kept on playing the game till 3 am in a room in which his brother was studying, said Meena, adding the boy went to adjoining to sleep after that. His body was found hanging from the ventilator’s grill in the morning, he said, adding the boy was rushed to MBS Hospital, where he was declared “brought dead”. 

No suicide note was recovered in the case, the SHO said. The boy lived in Gandhi Colony in the city along with his mother and brother, while his father, a Tamil Nadu native and Army man, is currently posted in Arunachal Pradesh. The boy’s body has been kept in hospital’s morgue for the postmortem, the SHO said.
