Denying maternity leave for 3rd child unconstitutional: HC

Nainital, Aug 4: The Uttarakhand High Court has come to the rescue of a government servant who was denied maternity leave for her third child, terming a state government rule to this effect "unconstitutional".

Hearing a writ petition by Haldwani resident Urmila Manish, the single judge bench of Justice Rajiv Sharma said denial of maternity leave to women for their third child under the Second Proviso of Fundamental Rule 153 of Financial Handbook of the Uttar Pradesh Fundamental Rules, adopted by Uttarakhand, went against the letter and spirit of the Constitution.

The court in its July 30 order said the rule should be struck down as it went against the Article 42 of the Constitution which provides for "just and humane conditions of work and maternity relief," and also the Section 27 of the Maternity Benefit Act, 1961.

Taking a humanitarian view, it ordered that the petitioner be granted leave.

Manish was denied maternity leave on the ground that she already has two children and could not be granted the same for her third child in consonance with the Second Proviso of Fundamental Rule 153.

New Delhi, Jul 28: India on Wednesday reported 47,704 more COVID-19 cases in the last 24 hours, taking the country's count of coronavirus cases to 14,83,157, informed the Union Ministry of Health and Family Welfare.

Out of the total cases, there are 4,96,988 active cases in the country while the number of patients cured/discharged and migrated stands at 9,52,744.

With 654 deaths due to COVID-19 in the country reported in the last 24 hours, the death toll rises to 33,425.

The recovery rate among COVID-19 patients has increased to 64.23 per cent. The recoveries to deaths ratio is 96.6 per cent:3.4 per cent, informed the Centre.

As per the data provided by the Ministry, Maharashtra continues to be the worst-affected state from the infection with 1,48,905 active cases and 13,656 deaths due to COVID-19. Tamil Nadu has a total of 53,703 active cases and 3,494 deaths.

Delhi has a total of 11,904 active cases and 3,827 deaths.

The Health Ministry further informed that more than 5 lakh COVID-19 tests were conducted in a single day over two consecutive days. On 26th July, India tested a total of 5,15,000 samples and on 27th July, a total of 5,28,000 samples were tested.

The total number of COVID-19 samples tested up to July 27 is 1,73,34,885 including 5,28,082 samples tested yesterday, said the Indian Council of Medical Research (ICMR).

New Delhi, Jun 26: The Road Transport and Highways Ministry has issued a notification to enable citizens with mild to medium colour blindness to obtain a driving licence.

An official release said that the Ministry has been taking measures to enable divyangjan citizens to avail transport-related services, especially driving licence.

It said the ministry received representations that the colour blind citizens are not able to get a driving licence due to requirements in the declaration about physical fitness (Form I) or the medical certificate (Form IA).

The release said that the issue was taken up with expert medical institution and advice sought.

The recommendations received were that mild to medium colour blind citizens be allowed to drive and restrictions should only be on the severe colour blind citizens.

"This is also allowed in other parts of the world," the release said.

The notification seeks to amend Form 1 and Form 1A pertaining to Central Motor Vehicles Rules 1989.

United Nations, Jul 10: India is a "good example" as solar auctions have seen popularity amidst the height of the COVID-19 pandemic, UN chief Antonio Guterres said on Thursday, underlining that renewable energy is the only energy source expected to grow in 2020 and offers more jobs than the fossil fuel industry.

In his remarks to the International Energy Agency "Clean Energy Transition Summit'', UN Secretary-General Guterres urged the international community to commit to further usage of coal and to end all external financing of coal in the developing world.

"Coal has no place in COVID-19 recovery plans. Nations must commit to net-zero emissions by 2050 and submit more ambitious national climate plans before COP-26 next year," he said.

"The seeds of change are there. Renewable energy is the only energy source expected to grow in 2020. Solar auctions have seen popularity amidst the height of the pandemic. India serves as a good example. Renewables offer three times more jobs than the fossil fuel industry," Mr Guterres said.

Last month, Adani Green Energy said it has bagged the first of its kind manufacturing-linked solar contract worth Rs 45,000 crore from the Solar Energy Corporation of India (SECI) to develop 8 GW electricity generation capacity and 2 GW equipment manufacturing facility in the country.

Mr Guterres said he has asked all countries to consider six climate positive actions as they rescue, rebuild and reset their economies.

"We need to make our societies more resilient. We need green jobs and sustainable growth," he said, adding that bailout support to sectors such as industry, aviation and shipping should be conditioned on alignment with the goals of the Paris Agreement.

Countries also need to stop wasting money on fossil fuel subsidies and place a price on carbon, he said, noting that countries need to consider climate risk in their decision making.

"Every financial decision must take account of environmental and social impacts. Overall, we need to work together," he said.
