States can't cite law and order to ban cleared films: Panel

PanelNew Delhi, Oct 10: In an effort to check arbitrary bans on films, a central panel has recommended that states should not be allowed to invoke law and order reasons to stop screening of motion pictures and instead approach a tribunal.

An empowered committee headed by Justice Mukul Mudgal, former chief justice of the Punjab and Haryana high court, has suggested that the Film Certification Appellate Tribunal (FCAT) be strengthened to act as a grievance redress mechanism.

In seeking to curb use of law and order as a plea to ban films despite the subject falling squarely in the domain of the states, the panel has argued that primacy must be accorded to the Cinematograph Act's powers to certify films.

The committee was established in February to look into the controversial issue of banning films in the aftermath of Tamil Nadu's decision to ban Kamal Hasan's 'Vishwaroopam', following the opposition of a section of a community. The state government promptly cited law and order concerns to stop exhibition of the film.

The panel also expressed strong concern on another matter that regularly kicks up controversy - criticism that members on advisory panels of the Central Board of Film Certification are often ill-qualified besides being political appointees.

The panel has recommended that censor board members should have some expertise in the arts, culture or any other professional field.

The report — submitted to I&B minister Manish Tewari on Wednesday — recommended that as far as films are concerned, the Cinematograph Act should be paramount. It suggested amendments to the Act so that if a state government or an individual or institution raised objections, they could approach FCAT instead of courts of law.

Given the sensitivity of states over federal issues, particularly with regard to law and order, it remains to be seen how far the Centre can go to accept the recommendation to amend the Cinematograph Act.

"The states' powers to maintain law and order are independent. But we believe that once a film has been certified, it should be allowed to be screened. If there are concerns or objections, an avenue can be created through the FCAT that will provide a quick resolution rather than an indefinite stay that plays havoc for the filmmakers and aggrieved parties," a source said.

Sources said the panel has backed increasing the powers of FCAT to hear cases other than those of filmmakers. As of now, only a film's producer or director can approach the tribunal.

The committee has also sought a uniform law for screening of films in theatres and on TV.

Sources said the Mudgal committee suggested that all promotional material including videos, posters and flyers be certified. "There is provision for certification of videos but now we have increased the ambit to include all promotional material," a source said. Posters and other material can be certified by an industry body, the report suggested.

Mumbai, Jun 16: Director Abhinav Singh Kashyap appealed to the government to launch a detailed investigation into the demise of actor Sushant Singh Rajput and shared a hard hitting Facebook post about his own experience of bullying in the Bollywood industry.

The 'Dabangg' director wrote, "My experience is no different. I have experienced exploitation and bullying first hand."

He further said, "Arbaaz Khan on Dabangg and ever since. So here is my story 10 years after Dabangg. The reason I moved out of making Dabangg 2 ten years ago is that Arbaaz Khan in collusion with Sohail Khan and family was trying to take control of my career by bullying me. because Arbaaz Khan sabotaged my second project with Shree Ashtavinayak Films that I was signed up with by personally calling their head Mr. Raj Mehta and threatening him with dire consequences if they made a film with me. I had to return the signing money to Shree Ashtavinayak films and moved to Viacom Pictures. They did the same thing. Only this time the sabotager was Sohail Khan and he intimidated the then Viacom CEO Vikram Malhotra. My project was sabotaged and I was made to return my signing fee of Rupees 7 Crores plus interest of Ninety odd lacs. Its only then that Reliance Entertainment came to my rescue and we forged an enduring partnership for my film Besharam."

The 'Yuva' director added, "But to behold... Mr Salman Khan and family sabotaged the release of the film and got their PROs to run a sustained negative smear campaign against me and my film Besharam before release. This scared the distributors from buying my film. Reliance Entertainment and I were capable and courageous enough to release the film ourselves but the battle had just begun. My enemies, which there were many ran a sustained negative Trolling and badmouthing campaign against the film till the Box Office of my film collapsed. But to their horror, Besharam had still netted 58 crores before it went out of theatres."

"So they fought on... They sabotaged the Satellite release of the film that was pre-sold to Mr Jayanti Lal Gada who was the main agregator for Zee Telefilms those days. With Reliance's goodwill, they were able to re-negotiate the satellite rights sale with Gada for a much lesser price," he further said.

Talking about his projects and how they were affected, Kashyap added, "Over the next few years, all my projects and creative endeavours have been sabotaged and I have been repeatedly threatened with life and rape threats given to/for the female members of my family. The sustained gaslighting and bullying destroyed my mental health and that of my family and led to my divorce and breaking up of my family in 2017. They erred and sent some of these threats as texts, sent to me as sms from several numbers. Armed with evidence, I went to the police in 2017 to file an FIR which they refused to register but registered a non-cognizable complaint. When the threats continued, I forced the police to trace the numbers but they couldn't be traced back to Sohail Khan (the suspected sender). My complaint remains open to date and I still have all the evidence."

The director further wrote, "My enemies are sharp, cunning and always attack me from the back and stay Hidden. But the best part is after 10 Arbaaz Khan and Sohail Khan years, I know who my enemies are. Let it be known that they are Salim Khan, Salman Khan, Arbaaz Khan and Sohail Khan for. There are many other small fry's but Salman Khan family is the head of this venomous serpent. They use a clever mix of their ill-gotten money, political clout and connections with the underworld to intimidate anyone and everyone. Unfortunately truth is on my side and I am not going to give up like Sushant Singh Rajput. I refuse to cow down and will fight on till I see the end of either them or me. Enough tolerance. It's time to fight back."

The 'Dabangg' director wrote, "The suicide of Sushant Singh Rajput brings to the forefront a much bigger problem of what many of us have been dealing with. Exactly what might compel a person to commit suicide?? I fear his death is just the tip of the iceberg just like the #metoo movement was for a much bigger malaise in Bollywood."

Kashyap also made allegations that talent management agencies ruin the career and life of an actor, "The death of Sushant Singh Rajput brings under scanner the role YRF talent Management Agency might have played in pushing him towards his suicide but that is for the authorities to investigate. These people don't make careers. They ruin your career and life. Having suffered personally for a decade, I can confidently say every Talent Manager and all Talent Management Agencies of Bollywood are a potential death Trap for Artists. They are all basically white collared Dalaals and everyone is involved. They all have an unspoken code of conduct they adhere to. Their one simple mantra is, 'Hamaam me sab nange aur jo nange nahin hain, unko nanga karo kyonki agar ek bhi pakda gaya to sab pakde jayenge'. Following is mostly their modus Operandi'."

The director shared how the agencies find talented people and get them to sign a contract, "First the talent scout (Casting Directors, etc.) working on a cut/commission spots a needy wild talent from out of Mumbai with little connections or property. The talent is then lured with free invites to Bollywood parties and random Restaurant launches on the pretext of introducing them to celebrities. The Blinding glamour of celebs and lure of easy money is unleashed on the unsuspecting. Mind you they are all ignored and treated very badly at these parties so they feel demoralized and their self-confidence breaks."

He added, "Once the confidence is broken, the scouts offer them a multi-year exclusivity contracts and pressure them to sign-up for it by promising to protect them from predators or offering a pittance. Mind you, breaking these legal contracts means heavy penalties for these budding talents but the scout makes sure through bullying and coercion that there is very little option for the talent but to sign up. Once the talent is signed up with the Talent management agency, they give up their right to exercise free choice and their discretion in any matter concerning career and they are made to work as bonded labor with very little money. Even if they are brave and manage to escape the clutches of their Talent Management agency somehow, they are systematically boycotted and their name smeared till they jump ship to another Agency in the hope of a better tomorrow."

Talking further about the struggle of an actor, Kashyap said, "But that tomorrow never comes. Their new agency turns out to be the same. Over a period of few years, mostly the prime of any actor, the talent is repeatedly broken till they either commit suicide or they succumb to Prostitution and escort services (Yes male escorts also) to feed the ego and sexual appetite of the rich and powerful, not just in Bollywood but also in Corporate world and politics."

He concluded by writing, "So this is not a threat, it's an open challenge. Sushant Singh Rajput has moved on and I hope he is happier wherever he is but I will make sure that no more innocent will kill himself over lack of work with dignity in Bollywood. I hope suffering actors and creative artists will share my post on various social media platforms as will the media and people who patronize the entertainment industry."

Mumbai: The 11th edition of KASHISH Mumbai International Queer Film Festival is going virtual this year due to the COVID-19 lockdown. The festival is coming up with a full-slate of 157 films from 42 countries.

Tipped as South Asia's biggest LGBTQIA+ film festival, it is the first Indian film festival to come up with a slate of new programs for this year.

The slate of films include 30 films from India, as well as films from countries like Belarus, Iran, Iceland, Lebanon, Macedonia, Malaysia, Puerto Rico, Tunisia, etc.

"We are extremely delighted to launch the registration for the KASHISH 2020 Virtual with a full slate of films as well as panel discussions, filmmaker Q&As, etc, almost replicating the ground event. Only this year not only Mumbaikars but people across India and the world can participate in the festival and enjoy amazing LGBTQIA+ films, discussions and performances!", said Sridhar Rangayan, festival director.

"We are thrilled by almost 95 per cent of the filmmakers whose films were selected to screen at the ground festival, agreeing to screen with us at our online festival. We are overwhelmed by the response from the filmmakers, and we are really glad to reach their films out to the world. This speaks a lot about their trust and support towards the festival", said Saagar Gupta, Director, Programming.

The registrations to attend the festival is now open and details can be viewed at the festival website http://mumbaiqueerfest.com/attend/ along with information about the film line-up. There are early-bird full-festival passes at a modest price in India and outside India. The early-bird offer will be open for a week.

Mumbai, Jul 3: Bollywood woke up to the shock news of their beloved 'masterji' Saroj Khan's death on Friday, with many celebrities remembering the veteran choreographer as a "genius" and an "inspiration" to others.

Khan, the name behind some of the most famous songs in Bollywood such as "Dhak Dhak" and "Ek Do Teen", died of cardiac arrest early on Friday morning. She was 71.

Superstar Akshay Kumar termed Khan's demise as a "huge loss" to the industry.

"Woke up to the sad news that legendary choreographer #SarojKhan ji is no more. She made dance look easy almost like anybody can dance, a huge loss for the industry. May her soul rest in peace," he tweeted.

Choreographer Farah Khan said she was among the countless artistes who were inspired by Khan's work.

"Rest in peace Sarojji... You were an inspiration to many, myself included. Thank you for the songs," she wrote on Twitter.

Choreographer-turned-filmmaker Remo D'Souza said, "#RIP Saroji, you will be missed... Big loss to dance fraternity."

Actor Taapsee Pannu said she will forever cherish the memories of working with the veteran choreographer.

"At least I had a chance to dance in your company. I am going to hold on to those memories tight... real tight. We lose another star to the sky. Your songs will make every girl remember you for ever and ever," the actor tweeted.

Nimrat Kaur said there will be no one in the industry who could do what Khan did in her lifetime.

"Saroj ji’s name introduced the word ‘choreographer’ to my life. A genius who immortalised stars and the music that defined an era with her iconic work. May her loved ones find strength and courage at this terrible hour. There’ll never be another...#RIPSarojKhan #Legend #Masterji" she said.

Genelia Deshmukh said she is grateful to have worked with the legendary artiste.

"RIP Saroji ... I thank God I got a chance to be choreographed by you...Prayers and Strength to the Family... #SarojKhan" she said.

"Woke up to the heartbreaking news of the legendary choreographer #SarojKhan’s demise. Her iconic dance moves inspired me at a very young age. Rest in peace Saroj Ji. You are truly irreplaceable," tweeted Tamannaah Bhatia.

Rakul Preet Singh mourned that her dream of working with Khan will remain unfulfilled.

"Always dreamt of doing at least one song Choreographed by her. Your grace and contribution to Indian cinema shall always be remembered. May your soul RIP. Strength to the family," she said.

Filmmaker Sanjay Gupta said he learnt a lot while working with Khan.

"The first song I conceived 'Tamma Tamma Loge' to 'Dil Dil Dil' the first song of my debut film 'Aatish' we’re choreographed by the legendary Saroj Khan. Learnt so much from her. RIP Saroj Ji and keep smiling like you always did," he wrote on the micro-blogging site.

"Saroj Khan my beloved Masterji. #RIPSarojKhan From Music Videos to films we had a long journey together. Now you’ve left me and gone. I will do and make what we spoke about one day, my promise to you," tweeted filmmaker Kunal Kohli.

Khan, a three-time National Award winner, was not keeping well for some time. She was admitted to Guru Nanak Hospital in Bandra last Saturday after she complained of breathing issues. She had tested negative for Covid-19.

The veteran choreographer is survived by son Raju Khan and daughter Sukaina Khan.

Her funeral was held on Friday morning at a cemetery in suburban Malad.
