Salman Khan wants fresh trial, prosecution calls it 'delay tactics'

Srikant Shivade argued that the actor had not been given an opportunity in the magistrate's court to cross-examine witnesses vis-a-vis the additional charge of culpable homicide which was imposed on him recently.

The prosecution, however, opposed Salman's plea saying "this was an attempt to delay the trial." The magistrate had adduced evidence on the basis of the deposition given by the witnesses. Hence, this evidence cannot be discarded, the public prosecutor argued.

Salman's lawyer pleaded that earlier it was a summary trial by the magistrate. However, as culpable homicide charge had been framed against the actor, the case was triable by a sessions court. "We should not be prejudiced because of want of cross examination of witnesses. Hence, a fresh trial may be conducted," he said.

Judge D W Deshpande reserved his order till December 5 on Salman's plea for a fresh trial.

A sessions court had on July 24 framed charges against Salman for culpable homicide for which he may face a jail term upto 10 years. Earlier, he was tried by a magistrate for rash and negligent driving which prescribes a two-year jail term.

Ten years after the accident in which Salman was found involved, the Bandra magistrate, mid-way during the trial, held that culpable homicide charge was made out against the actor and hence referred the case to a higher court for trial as this offence is triable only by the sessions court.

Apart from section 304(2) (culpable homicide not amounting to murder), the Bollywood superstar has also been charged under sections 279 (causing death by negligence), 337 (causing hurt by an act), 338 (causing grievous hurt), 427 (causing damage or mischief to property) of IPC, and provisions of Motor Vehicles Act and Bombay Prohibition Act.

One person was killed and four others were injured when the Land Cruiser, allegedly driven by Salman Khan, crushed a group of people sleeping on the pavement outside a bakery in suburban Bandra on September 28, 2002.

Mumbai, Apr 29: Irrfan Khan, one of India's finest and most versatile actors, lost his battle with a rare form of cancer and died in a Mumbai hospital on Wednesday, a statement from his family said. He was 54

Irrfan, who was diagnosed with neuroendocrine tumour in 2018, is survived by his wife Sutapa and his sons Babil and Ayaan.

It is the second tragedy for the family in less than a week. The ?Maqbool? actor lost his mother, 95-year-old Saeeda Begum, in Jaipur just four days ago and could not attend the funeral because of the nationwide lockdown.

Irrfan, that rare actor who straddled multiple worlds, making his mark in both international and Indian cinema in roles intense and light-hearted, was admitted to the intensive care unit of the Kokilaben Dhirubhai Ambani Hospital with a colon infection

?It's saddening that this day, we have to bring forward the news of him passing away. Irrfan was a strong soul, someone who fought till the very end and always inspired everyone who came close to him. After having been struck by lightning in 2018 with the news of a rare cancer, he took life soon after as it came and he fought the many battles that came with it,? the statement from his family said

?Surrounded by his love, his family for whom he most cared about, he left for heavenly abode, leaving behind truly a legacy of his own. We all pray and hope that he is at peace. And to resonate and part with his words he had said, 'As if I was tasting life for the first time, the magical side of it',? it added.

The news of his death was first confirmed by his "Piku" director Shoojit Sircar who sent his condolences to the family and doffed his hat to the actor's fighting spirit

"My dear friend Irfaan. You fought and fought and fought. I will always be proud of you.. we shall meet again.. condolences to Sutapa and Babil.. you too fought, Sutapa you gave everything possible in this fight. Peace and Om shanti. Irfaan Khan salute," the director said on Twitter.

Irrfan's death came the morning after news that he had been admitted to the ICU with a colon infection.

The self-effacing National Award winner, who acted in films as diverse as ?Life of Pi?, ?The Namesake? and ?Haasil?, had stayed away from the public eye after his diagnosis in 2018 when he went to the UK for treatment.

He returned home in 2019 and shot for "Angrezi Medium", the sequel to his 2017 hit "Hindi Medium". However, his health condition prevented him from promoting the movie, which hit the theatres in March just before the lockdown that began on March 25.

Mumbai, Jul 2: The Mumbai police have summoned noted filmmaker Sanjay Leela Bhansali for questioning in connection with the Sushant Singh Rajput suicide case. According to several reports, casting director Shanoo Sharma too might be questioned in connection with the star’s death.

Reports also state that Kangana Ranaut and Shekhar Kapur, who are not directly involved with the investigation, are likely to be asked to record their statements.

The development comes days after the cops had asked for the details of SSR’s contract with Yashraj Films. The MS Dhoni actor had starred in Shuddh Desi Romance and Detective Byomkesh Bakshi, which were backed by the banner. He was supposed to team up with YRF for Paani, directed by Kapur, but the movie was on hold due to creative differences between the Mr India helmer and the production house.

Sushant died by suicide on June 14, leaving his near and dear ones in a state of shock. Following his demise, fans alleged that several Bollywood biggies had tried to sabotage his career as he was an ‘outsider’, reigniting the nepotism debate.

SSR, who hailed from Patna, made an impact in the TV industry before entering Bollywood with the sleeper hit Kai Po Che. He impressed fans with his performances in PK and Shuddh Desi Romance, consolidating his standing in the industry. It was, however, MS Dhoni that established him as a bankable star. Chhichore was his last theatrical release before his death. Drive, backed by Karan Johar, released directly on Netflix. His last film Dil Bechara is slated to release on Disney+ Hotstar on July 24.

Mumbai, Aug 2: None of the sim cards that actor Sushant Singh Rajput was using was registered under his name, said the team of Bihar Police, probing his death case, on Sunday.

The team also informed that one of the sim cards that the late actor was using was registered the name of his friend Siddharth Pithani.

"We are now tracking the call detail records (CDRs)," the police said.

The team also said that they will interrogate the family of Sushant Singh Rajput's former manager Disha Salian, who died few days before Sushant's death.

"Even after constant attempts to connect with them on phone, we have failed to establish any contact," it said.

Earlier today, while talking to news agency, the Director-General of Police (DGP) of Bihar Gupteshwar Pandey hinted at the non-cooperation of Mumbai police with his team in their investigation.

"We don't have post-mortem report details, CCTV footage or any information that has been collected by Mumbai Police during probe till now. Our Chief Minister has requested the Maharashtra Chief Minister to ask his police force to cooperate with us," the DGP added.

When asked if Bihar Police want CBI probe into the case, he said, "We are more than capable of doing an unbiased investigation. We hope that Mumbai Police will cooperate with us and we'll conclude the investigation."

Rajput was found dead at his Mumbai residence on June 14. Mumbai Police who was investigating the case had earlier informed that they have recorded the statements of 41 people, including filmmaker Mahesh Bhatt, film critic Rajeev Masand, director-producer Sanjay Leela Bhansali, and filmmaker Aditya Chopra so far.

A team of Bihar Police is in Mumbai to probe the actor's death after an FIR was filed by Rajput's father KK Singh against late actor's girlfriend Rhea Chakraborty in Bihar in connection with the death case under several sections including abetment of suicide.

The Enforcement Directorate (ED) had also registered an Enforcement Case Information Report (ECIR) in Rajput's death case. ED registered the report after an FIR was filed by his father against Chakraborty.
