Even case diaries missing in Salman Khan's hit and run case, cops tell court

August 21, 2014

Mumbai, Aug 21: Expressing unhappiness over the failure of police to trace original documents in the 2001 hit-and-run case involving actor Salman Khan, a sessions court on Thursday gave them a last chance to locate the papers by 12 September.

salman casePolice informed the court for the first time today that even the case diaries were missing. Earlier, they had stated that only 7 of the 63 original statements of witnesses were traceable, although true copies were available.

Salman's lawyer Srikant Shivade argued that as per law the original papers were required to be produced before the trial court, while the police argued that as per practice in Mumbai courts the trial can go on with the true copies.

Judge DW Deshpande asked police to inform their line of action on the next occasion. The court would then verify what documents they have and what are in the possession of the accused to decide whether it will be appropriate to carry on with the trial.

According to police, the original papers were kept in a Magistrate's court where the trial was held since 2001. However, when the trial was recently shifted from Magistrate's court to sessions court after the charge of culpable homicide was added in this case, the original papers and case diaries were not traceable.

The judge also asked the then Investigating officer Kishan Shengal, who is now retired from service, to appear in person on 12 September and throw light on the missing papers.

Shivade said that the case was very sensitive and involved a serious offence. Hence, they wanted the original documents to be placed before the court as per the law. True copies would not suffice, he argued.

The court had on 25 July asked the Bandra police to also produce the case diaries on 21 August, but the police informed that even the case diaries are missing.

The trial in the case is being conducted afresh by a sessions court.

On 5 December last year, the sessions court had ordered a fresh trial on the ground that witnesses had not been examined in the context of aggravated charge of culpable homicide not amounting to murder, which was invoked against the actor by a magisterial court midway through the hearing.

The charge of culpable homicide not amounting to murder attracts a 10-year sentence. The actor had earlier been tried by a magistrate for a lesser offence of causing death by negligence, which entailed an imprisonment of two years.

The case, dragging on for over a decade, had taken a twist when the magistrate, after examining 17 witnesses, held that the charge of culpable homicide not amounting to murder was made out against Salman and referred the matter to a sessions court, as cases under this offence can only be tried by a higher court.

On 28 September, 2002, the actor's car had allegedly rammed into a bakery, killing one person and injuring four others sleeping on the pavement outside.

London, Jul 4: Hollywood star Chris Hemsworth says he is really excited about the biopic on WWE legend Hulk Hogan, which is currently in development.

"The Thor" actor revealed that he will bulk up his physique for the much-anticipated film to be directed by “Joker” helmer Todd Phillips.

“This movie is going to be a really fun project. As you can imagine, the preparation for the role will be insanely physical. I will have to put on more size than I ever have before, even more than I put on for Thor.

''And then there is the accent as well as the physicality and the attitude. I will also have to do a deep dive into the rabbit hole of the wrestling world, which I'm really looking forward to doing,” Hemsworth told British magazine Total Film.

The project was announced last year, with “8 Mile” scribe Scott Silver and John Pollono attached to pen the script.

It is expected to look into Hogan's rise from the Florida wrestling circuit to becoming the face of the World Wrestling Federation in the 1980s where he squared off with villain Andre the Giant.

The 36-year-old actor, however, said that the team is still “quite a way away” from starting production on the film.

“'I haven't even seen a script yet. The project is deep in development. Todd Phillips and I met to chat about it maybe a year or two ago. We talked about the idea for the film, which I think was going to be a TV series at one point.

''There were a few different ideas about what portion of his life it was going to be set in, so we spitballed about what it could be and what I thought it might be. Thankfully, they ran with a few of those ideas and the script is in the process of being written - but Hulk Hogan is still quite a way away.''

The biopic will be produced by Michael Sugar through his Sugar23's first-look Netflix deal along with Joint Efforts' Phillips and Bradley Cooper, Eric Bischoff, and Hemsworth.

Hogan will also serve as executive producer along with Sugar23's Ashley Zalta. Steve Desmond and Michael Sherman will serve as co-producers.
