Give life ban to convicted MPs, MLAs from contesting polls: EC to Supreme Court

New Delhi, Nov 1: In a significant development, the Election Commission on Wednesday pressed for a life ban on convicted MPs and MLAs from contesting polls.

According to news agency, the poll panel made this submission before the Supreme Court during a hearing.

The Election Commission said it favours barring convicted MLAs, MPs for life.

BJP leader Ashwani Upadhyay had filed a PIL seeking a lifetime ban on MPs, MLAs from contesting elections.

The central poll body has earlier faced flak from the Supreme Court for not taking a clear stand on the BJP leader's appeal seeking to bar convicted politicians for life during a hearing in July.

An apex court bench comprising Justices Ranjan Gogoi and Navin Sinha slammed poll panel and asked whether it was ‘constrained’ to give its thoughts on the issue.

“Is silence an option for you (ECI)? You must say either ‘yes’ or ‘no’ on whether you are supporting the petitioner. You are the ECI and here is a citizen of India who has come here to seek lifetime debarment of convicted persons. Can you say I will be silent? No, you cannot,” the bench had then said.

“If you (ECI) feel constrained by the legislature, then let us know. If you are even constrained to the extent of giving your view, feel free and say so clearly,” it said.

After ECI’s response, the apex court said that it was clear that the poll body has supported the cause advocated by petitioner, Ashwini Kumar Upadhyay, who had sought a life ban for convicted politicians.

What the current law says

Under the current law, a lawmaker can be debarred for six years from contesting elections once he is convicted for heinous or moral offences.

Various pleas have knocked the Supreme Court’s door arguing that the ban should be lifetime at par with the judiciary and executive where a person cannot hold office for life post-conviction.

The Election Commission’s latest submission in the apex court could have far-reaching consequences on top leaders like Rashtriya Janata Dal chief Lalu Prasad who has been convicted in the fodder scam.

Former Bihar CM Lalu Prasad was sentenced to five years in prison in October 2013 after being convicted in a 17-year-old case related to the embezzlement of Rs 37 crore meant for the purchase of cattle fodder for farmers in the state.

Kozhikode, Aug 8: A tailwind or crosswind could be the reason for the Air India Express flight mishap at Kozhikode international airport in Kerala, according to some aviation experts. 

Team of DGCA and AIE already reached the spot. With the death of the captain and co-pilot in the mishap, the investigation would be focusing mainly on the voice recorders and other technical aspects.

It is learnt that the ill-fated aircraft, IX 1344 with 190 onboard including crew, was initially planning to land on runway-28 of the airport. But later the pilot opted runway-10 which is toward the other direction. Pilots would be taking the decisions on the basis of inputs from ATC.

The questions now doing the rounds are what made the pilot opt runway-10 and whether the tabletop runway lacked adequate safety parameters.

An aviation expert, who didn't want to be quoted, said that Capt Deepak Sathe, who was commandeering the aircraft, was a well-experienced pilot and was also familiar with the terrains. Hence the chances of any error from his part was very unlikely. Hence a fair in-depth probe was required to find the exact cause.

Though the Kozhikode airport has an Instrument Landing System, it was of category-I for which pilot's visibility is very crucial toward a touchdown. Since it is a tabletop airport and rough weather prevailing in the region, the chances of tailwind was also high, said sources.

There had been safety concerns about the airport over quite some time. In 2011 aviation safety consultant captain Mohan Ranganathan reportedly gave a report citing the safety issues, especially the buffer zones at the end of the runway.

However, an AAI officer said that rectification steps were already done by last year by widening the Runway End Safety Area (RESA) from 90 metre to 240 metre. However, the length of the runway had to be reduced to 2,700 metre from 2,850. The AAI was also constantly pressing for increasing the runway length to 3,150 metres. But that was getting delayed due to land acquisition issues pending with the state government.

New Delhi, Jun 22: With an increase of 14,821 new cases and 445 deaths, India's COVID-19 count reached 4,25,282 on Monday.

According to the latest update by the Union Ministry of Health and Family Welfare (MoHFW), 13,699 deaths have been recorded due to the infection so far in the country.

The rise in confirmed cases today is lower than the highest spike of 15 thousand plus cases registered on Sunday.

The count includes 1,74,387 active cases, and 2,37,196 cured/discharged/migrated patients.

Maharashtra with 1,32,075 confirmed cases remains the worst-affected by the infection so far in the country. The state's count includes 60,161 active, 65,744 cured, discharged patients while 6,170 deaths have been reported due to the infection so far.

Meanwhile, the national capital today became the second-worst affected region in the country with the number of confirmed cases in Delhi reaching 59,746 as opposed to Tamil Nadu's 59,377 cases.

While 2,175 deaths have been reported in Delhi due to the infection so far, the toll in Tamil Nadu stands at 757.

New Delhi, Apr 18: With 957 new cases of COVID-19 in the last 24 hours and 36 deaths, India's total count of coronavirus cases has surged to 14,792, said the Union Ministry of Health and Family Welfare on Saturday.

The total cases are inclusive of 2,014 cured and discharged patients, one migrated and 488 deaths. At present, there are 12,289 active COVID-19 cases in the country.

Lav Aggarwal, Joint Secretary, Ministry of Health and Family Welfare said that mortality rate due to COVID-19 in our country is around 3.3 per cent.

"An age-wise analysis will tell you that 14.4 per cent of deaths have been reported in the age group of 0-45 years. Between 45-60 years it is 10.3 percent, between 60-75 years it is 33.1 percent and for 75 years, and above it is 42.2 percent," Aggarwal said at a press conference here.
