Governor is neither 'guide' nor 'mentor' to assembly speaker

Bengaluru, Jul 19: As the Karnataka governor gave two deadlines to the chief minister to prove his majority, a 2016 Supreme Court verdict assumes significance in which it had held that it is not within the governor's domain to interfere with the functions of the Speaker as he is "neither a guide, nor a mentor" to the latter.

In 2016, the apex court had held as unconstitutional the decision of Arunachal Pradesh governor J P Rajkhowa to advance the floor test.

Karnataka Governor Vajubhai Vala set two deadlines for the H D Kumaraswamy government to prove majority on the floor of the assembly by Friday.

A five-judge Constitution bench headed by the then CJI J S Khehar had restored the dismissed Congress government led by Nabam Tuki in Arunachal Pradesh and had dealt in details the power of the governor under the Constitution.

"It is not within his domain to interfere with the functions of the Speaker, as the Governor is neither a guide, nor a mentor to the Speaker and has no role whatsoever in the removal of Speaker or Deputy Speaker...Both the Governor and the Speaker have independent constitutional responsibilities," the bench had said.

It had held that the governor cannot be an "overriding authority" over the people's representatives and there can be no interference at his behest so long as the democratic process in the assembly functioned through a majority government.

"It is not within the realm of the governor to embroil himself in any political thicket. The governor must remain aloof from any disagreement, discord, disharmony, discontent or dissension, within individual political parties.

"The activities within a political party, confirming turbulence, or unrest within its ranks, are beyond the concern of the governor. The governor must keep clear of any political horse-trading, and even unsavoury political manipulations, irrespective of the degree of their ethical repulsiveness," it had said.

Bengaluru, Mar 23: The Karnataka government on Monday decided to purchase 1,000 ventilators from medical devices company Skanray Technologies and five lakh Personal Protective Equipment (PPE), amid rising COVID-19 cases.

Health Minister B Sriramulu convened a meeting with officials to review the situation in the wake of the coronavirus outbreak, and with the Mysuru-based firm through a video conference.

"In the meeting, it was decided to buy 1,000 ventilators immediately", the Minister tweeted.

He said the government has already taken steps to buy ten lakh masks, and decided to purchase five lakh PPE.

"The Health Department has been working on a war- footing to halt the spread of the (COVID-19) infections", Sriramulu tweeted.

The Minister appealed to the citizens to strictly follow social distancing.

Six new COVID-19 cases were confirmed in Karnataka on Sunday, taking the total number of infections to the respiratory disease to 26 -- the highest number of positive cases in a single day in the State.

The Karnataka government has announced shutdown of all commercial activities barring essential services in nine districts, where COVID-19 cases have been reported, till March 31.

They are: Bengaluru city, Bengaluru Rural, Mangaluru, Mysuru, Kalaburagi, Dharwad, Chikkaballapura, Kodagu and Belagavi, Home Minister Basavaraj Bommai said.

Bengaluru, Jun 29: A 99-year-old woman has successfully recovered from coronavirus in Bengaluru, leaving the medical fraternity and her family elated.

The woman had contracted the pathogen after coming in contact with her grandson and was hospitalised on her 99th birthday on June 18.

The woman was taken to the government Victoria Hospital along with her 70-year-old son, daughter-in-law and grandson.

"While we three developed symptoms like cold, cough and fever, my mother remained asymptomatic," the woman's son said.

The family members are still wondering how they got infected by the virus as all except the woman's grandson, were confined to their home most of the time.

Her 29-year-old grandson was the only one who went out to buy groceries.

Initially, the family approached a private hospital nearby for treatment, but they refused to accept COVID-19 patients.

Left with no option, the family got admitted to the Victoria hospital.

"We had reservations about Victoria hospital, but it turned out be a good one.

We did not spend a penny since the day we were admitted and my mother and son fully recovered," the woman's son said.

According to Dr Asima Banu, nodal officer of the Trauma Care Centre at the Victoria hospital, the woman was reluctant to get treatment at the hospital.

"With moral support from doctors and nurses at the Trauma Care Centre, she recovered very fast. She is always positive in life," the doctor said.

Bengaluru, July 31: Denying irregularities in covid-19 equipment purchase by the Karnataka government, the state unit of the BJP has issued legal notices to Congress leaders Siddaramaiah and D K Shivakumar demanding that they apologize or face a defamation suit. 

The notices seek a public apology for the allegations levelled against the government on irregularities in the procurement of Covid-19 equipment and supplies. 

Both Siddaramaiah and Shivakumar, the Karnataka Congress president, have been doggedly pursuing allegations of corruption against the BJP government and have demanded a judicial inquiry. 

BJP general secretary N Ravi Kumar said that while the Congress leaders claimed that Rs 4,157 crore was spent during Covid-19, they also allege that the government has not responded to any of the 20 letters written by them. "If the government has not provided any answer to the Opposition, where did they get the figures from," he said.

None of the allegations of corruption is specific and the statements made are factually incorrect. "These statements, without any basis, have been issued calculatedly to lower the image and damage the reputation of the government, the Bharatiya Janata Party, representatives of the party and the ministers in the government," the notice issued on behalf of Ravi Kumar read.
